Aames Home Loans Aka Fairbanks Capital Now Dba Select Portfolio...$40 Million Lost In Court, Did Anyone Get Paid Something Worth Talking About??? Aames Home Loans Aka Fairbanks Capital Now Dba Select Portfolio.. We haven't won the lottery, we're still trying to break away from these jerks. That class action lawsuit was a joke to me. We could of save the money spent on the stamp for what our refund was. As a matter of fact, we received two checks. One for $74 & the other for 33 cents Salt Lake, Los Angeles California Utah

Last time I wrote here, I mentioned how the company was sending us to the poor house and how I wanted to nail them to the wall.

That's right. 33 ^@#&% cents!! Under $80 dollars doesn't even come close to the strong arm tactics we've gotten over the years. Its my mother's house, but we've been at this crap before they had a name for it. (predatory lending).

To back up a bit, like so many here I've watched my mother send in payments 3 weeks early, only to get hit with a late charge. We sent payments in that required a signature, and those bastards still posted it late. I've watched ,my mother's health decline. Its not from old age, she's only 66. From worrying all the time and not seeing an end in sight has taken its toll on her. Her hair is thinning and she has lost a few teeth. I blaim this company for this. She could of been retired by now. My mother's a good person, she doesn't deserve to be treated like ^&%.

Some years ago, Aames sent a letter and said they had the loan now, then some months later, a letter from Fairbanks came in saying they had the loan. After some time with crappy service, Aames sent another letter claiming the loan. A few years before the class action suit, Fairbanks came back in the picture, got sued, changed their name and low and behold there was Aames again.

Now Aames, Fairbanks /SPS all say they are seperate companies. Yeah right. They have the same 800#, sometime same address not to mention the same rusty knife used to stab one of us in the back while the other is held one up by the ankles for more.

A wopping 11.1% is what we have been trying to get out of for the longest. Everyone has "deals" now, but after been raked over the coals by Aames and Fairbanks we're almost back were we started.

Aames, Fairbanks, Select, (tony soprano?)...suck royal eggs. From where I stand, the government doesn't care about the little people. If they did,they would of thrown the crooks in jail, put those rude customer service reps on the unemployment line, bulldozed their buildings and given my mother a check to make up for what they've put her through, instead of the slap in the face and getting done with out a kiss, for 33 cents.

I applaude you and share your concerns. I urge you to keep on fighting for your mom against this ugly monster! I've done some research, and the scary thing is that Aames, Fairbanks, and a long list of others like Countrywide, Equifax, on and on are only satilitte subsidiary companies acting for investors. All these companies are "loan servicers" and "debt collectors".

The investors they work for are filthy stinking rich and want more, they are motivated by greed. A huge corporation fueled by greed has no conscience, as hundreds, maybe thousands of unsuspecting consumers have come to find out the hard way. The investors are the source of your woes, they only care about lining thier wallets with stolen money.

My mortgage was part of that Fairbanks suit, but I opted out. Thank God, but nevertheless, it has no bearing on what has happened to your mom since the settlement. I want to help you help your mom. I know you are angry and insulted by the measley amount of the check, but here's hoping the next one will have plenty of "zeros" behind the numbers!

I don't know what agencies you have contacted or if you ever had a lawyer, so bear with me. Go to the Countrywide Home Loans complaints in this website and read the complaints/rebuttals from Ionia, Mi. they can apply to any mortgage company trouble.

Gather up every document you have that pertains to your complaint and make 3-4 copies of each, keep the originals. Tell your mom to send her payments by registered mail, it will cost a little, but prove her point! Follow the directions for filing a complaint with the FTC and send a complaint in writing to your U.S. Senator of your state. Send copies to Attorney General and Dept. of Consumer Industry Services.
Complaints must be in writing in order for them to take action, and they must have some documentation of offenses.

Call HUD, seek a loan through them or another government/state sponsored agency. THEN, call Aames and ask about options, such as getting a loan modification/refinance through a government agency. Ask for any negotiations or option to be put in writing! Then Aames will get the idea that the "feds" are likely involved.

Be diligent, keep a journal/records of all conversations, dates, times, person's first and last name and details of the conversation.
Then, send a letter requesting "proof of debt" with your lenders name and your loan number to FTC Consumer Response Center, Room 240-H, Washington, D.C., 20580,;

Under RESPA;Real Estate Settlement Procedures Act, if a borrower submits in writing,a qualified request for information, the mortgage servicer-within 20 business days--either to take the requested action or acknowledge in writing it has recieved the request. State that you are requesting this and the reasons you believe you have been unfairly charged late fees ,etc. and send supporting documents. Ask for what you believe you are entitled to, like reimbursement of late charges, credit repair, etc.

After the initial response, they then have 60 days to respond/correct the problem or explain their actions. You have a chance at letting your mom get some justice! Tell her that she is in my prayers and I will keep posting updates as they become available. God Bless.
