I have been leasing merchandise from Aaron's for almost 2-years. Within that two years I sent my 52'inch HDTV in for repair after some problems we were experiencing with it. We waited and paid for five months for merchandise we didn't even have. Finally, I decided I would not pay on any of my other accounts until I have some sort of difinitive answer on what was going on with my TV. It ended up taking a phone call to the corporate office which I had to find on my own because it is apparently against company policy to give that information out. Anyway, after being tired of getting blown off and told we will check into it by the store's manager I cantacted the corporate office. Low and behold they had lost my TV! I had been paying on a TV they couldn't locate and didn't want to tell me they had lost, no loaner TV was even offered until I got corporate invloved. After getting corporate involved the store manager, Robert wanted to get all pushy, telling me to come in and pick ut a new one, problem was I had just had a premature baby and couldn't get in to the store when they wanted me to. So they picked one out for me, and not a new one, a used one. Fine I have still been making my payments until this month, December 2005, when I allowed my payments to fall behind for no other reason than being forgetful with all the holiday stuff going on. My family goes out of town and when I get home I have messages from family members and business associates telling me they called them and told them that we owed them money, which is against the federal law! I have previously requested that my accounts be relocated to another store since this store's manager and I have bad blood, and have been denied, so now my friends and family have to be harrassed? I would be stupid not to finish out paying for my lease since I only have four months left to pay on it, but I will not put up with this, I will contact anyone and everyone who will listen to my story in order for it to stop, even if I have to file suit against this company. Beware to those looking to lease from this comapny, it's not oly more expensive to lease/purchase through them, but they also practice illegal and unethical business practices.

Made a payment today...

I made my payment today and was told that I actually owed more than the normal. Normally I pay $300 per month for both of my accounts, which is actually $25.75 more than the actual payment owed, Anyway, I asked why so much and Robert had the nerve to tell me $15 late fee and $20 per visit to my home. I asked if he could prove that he had actually been out to my home, mostly because he was being baligerant, anyway I was told my payment would not be accepted because it was for $300 and I owed $366.80? Not quite sure how he came up with that figure, nor was I willing to continue the screaming match with this individual so I told him i would bring the remaining payment by and drop it in the night box. I began thinking about it and read over my original lease which states the late fee is $10 after the 7th day and $15 per visit to location of rental property. He must really think I am a fool. I am going to ask for a copy of my rental/payment history to be faxed to me as well as a detailed statement of the money I supposedly owe, then I am telling him to come get his merchandise and I am leaving after them to the court house. This is rediculous.

If you feel that the company has violated the FDCPA (which it sure sounds like it has) then when you need to do is the following:

1) Get documentation. Get copies of times and numbers that were called from off of Caller ID by the offending business.

2) Keep documentation on who you spoke to, times and dates you spoke to this person, and keep this list in a secure place.

3) Get sworn statements from the associates and family/friends who were called by the offending business. Sworn statements hold much more water than just regular statements.

4) Hire an attorney. See if he can subpoiena the phone records of the offending business to see where and when he called your family and friends.
