On or about April 14, 2009, my son's contract with Work Out World of Fall River, MA expired. The contract rolled over to a month to month agreement, that my son wanted terminated because he had joined the US Marines.
We sent ABC Financial Services, via first class mail, a letter (per contract requirement) stating our desire to end this contract arrangement. They claimed never to have received such notice and continued to attempt to withdraw the funds from my son's checking account to the point that the bank suspended my son's account because of insufficient funds and the many attempts ABC financial made to get money they were not entitled to get.
My son, not being here, asked me to look into the situation. I called ABC financial in May and asked why they did not cancel the contract and was told that they never recieved any request to cancel and insisted, that to close the contract, a letter needed to be mailed along with the several months of "overdue" payments and late fees that amounted to over 150% of the monthly dues. I explained that we did mail a letter and would supply a copy. They refused to accept that as a legimate response to their claim.
I contacted the Better Business Bureau of Arkansas and filed a complaint. They in turn contacted ABC Financial Services who replied that we needed to prove that they recieved a letter that a request to cancel was made. In my response, I sent a copy of the letter to them and just got a letter stating that it was "not sufficient proof" that a letter had been recieved by them and we should remit the amount due.
I contacted the gym and spoke to a man named "Mike", who identified himself as the Regional Manager, and explained the frustration we are experiencing with ABC Financial and he promised to get the matter resolved today. I told him that if this matter was not resolved today and we did not get a letter indicating that the account has been closed and no further money's are due, I was going to file a complaint with the General Attorney's Office Consumer Affairs Division and ask them to investigate this practice.
While my son is busy Serving His Country, this business is busy destroying his credit, caused him to overdraw on his account and causing me grief in trying to resolve the concerns we have.
My son does not owe ABC Financial Services any monies and we will not be paying them one red cent. We are considering looking for others that this company has tried to screw and perhaps file a class action lawsuit against them to stop this predatory practice. I also am considering making the Gym wholly responsible for ABC Financial Service's Actions and perhaps they may reconsider ABC Financial Services as their billing managment company.
If your Gym uses ABC Financial Services beware when you try to cancel. Use the return receipt certfied mail option so they have to sign it and can't claim non receipt of your request. If you are about to join a Gym, ask them who their Billing Managment compnay is and if they name ABC Financial Services, tell them Thanks, But No Thanks because you have heard that they are a ripoff company and do not abide by the contract agreements and force people to jump through hoops to end them.
