I started employment with KT2 LLC dba Cheetah 1 Express in January, 2017 as a company driver.  It took her over 4 weeks to make the first payroll direct deposit to my account, which was far less than what I had earned.  When I questioned the owner, Abbey Kizy, as to why I was not paid what was owed to me, she responded that she was going through a rough time and waiting on receivables to come in. 

Within the second month of employment, the fuel card she had provided to me to fuel her company truck was declined when I attempted to fill the truck while I was loaded and out of state. She told me to use my own credit card to fuel the truck so that the load would be delivered on time.  I had to beg her several times to reimburse me.

The truck I had been given to drive had just come out of service, and continued to have problems while I drove it.  It broke down on me several times.  I reported this to her, and she informed me to just keep driving and to deliver the loads.  While out of state, the truck had to be serviced again, which took several days.  I believe that she knew this truck had major problems, and was waiting for it to blow up and catch fire in order to blame the driver and make an insurance claim. 

Additionally, I was not compensated in any way for the two weeks of down time while I was out of state that the truck was being repaired.  No wages, no food allowance.

After two months of employment with her, Friday came, and no payroll direct deposit.  I immediately called to inquire, and she told me that she had no idea why the deposit didn't go through.  Again, I was out of state, so the only thing I could do was continue to work.  My wife had to deposit money into my account just so that I could eat.  This was an extreme hardship on my family.  The next Friday came and went, and again no direct deposit. 

I insisted on coming home when two pays were not received, so she booked loads to bring me back.  When I went to the office in person to collect my overdue pay, she was not in the office.  When I inquired as to where she was, and when she would be back, the police were called on me.  The officers were apparently informed that it was unknown as to who I was, and why I was looking for her.  After speaking with me, they asked me to phone her and return when she was on site.   It took an additional week before she wrote me a small check, far less than what I was owed for working.

I continued to work for her two more weeks, in good faith that she was going to pay me.  When yet again the direct deposits did not go through, I returned her truck the next time I was home, and informed her that I had quit because I could not continue to work and not receive my pay.  She asked me to come to the office and return her phone and declined fuel card, which I did.  She, however, did not pay me.  She declared that according to a contract I had signed, she had 45 days in which to give me my final pay.    

About a week later I received a letter in the mail from her, stating that I would receive my final compensation after 45 days had passed.  I patiently have waited the 45 days, and contacted her by phone today since yesterday was the 45th day.  Now she is claiming that I did not return the phone charger cord or declined fuel card, and that according to her contract, she will not pay me until they are returned.  I did return both items, over 45 days ago.  She is arguing that I did not.  Further, she stated that the missing items, along with "other" expenses would need to be deducted from my pay.  I have had it with this lier and cheat of a woman.  She is stalling, making up excuses, and not paying me what I worked for and earned.
