MS. Leigh with ACA RECOVERY has called my jobs several times threating to garnnish my wages and thier attorney would be filing a lawsuit if i did not make a good faith payment by 8/27/2004. Several times she has stated she would need to recieve my payment before the attorney would not take my case to criminal court as she has rasied my payment from 375.00 to 515.00 for attorney fees.

I have sent in a 100.00 to them to keep my self from going to court. They have threatened to take me to criminal court several times and if i do not pay them. Along with calling my job. They never gave me an address just enough to western union them.


I should have checked before ever sending them anything/ What should i do from here on out i do owe a debit, however i will not send them another dollar.

THEY CAN'T TAKE YOU TO CRIMINAL COURT OVER A CIVIL MATTER.

You did not specify what the debt is for or even if it's valid, but please note that you CANNOT be arrested or tried criminally over a debt. Additionally, the collector who told you that is in clear violation of the Fair Debt Collections Act and the collection agency can be sued by YOU for making a threat to do so. Basically, a collector cannot threaten you with jail or even garnishment of your wages if they don't have the authority to do so. They cannot raise your payment for "attorney fees". Attorneys fees are awarded in civil court by a judge. DO NOT send additional money over and above the amount of the debt (if owed).

Additionally, by law, they have to provide you with a legal mailing address. You can tell them that they are NOT to contact you at work and failure to do so is another violation of the FDCA.

You need to contact your state Attorney General and file a complaint.
