I came across Wendy on a Google search and she was offering a discount, so I thought it may be interesting to try out her service. The initial $50 service was fine. Since I had a good initial impression, I offered to gift her a seascape painting of my choosing for her to keep and also provide another painting of my choosing to be displayed in the waiting area with my artist bio and contact information if anyone wants to reach out to the artist to discuss purchasing it. Wendy had assumed that both paintings I dropped off were a gift, where the agreement was that one, “Twilight Mist” was the gift and the other of my choosing, “Old Man & the Sea” was the one that was suppose to be in the lobby for display with my artist bio for people to contact if they want to purchase it from me. Below is a copy of the email stating the agreement in question:

I am very clear in the agreement that one painting is a gift and the other of my choice is for the business to display. Now this is where the confusion took place from Wendy. She thought that both paintings were gifts. Whenever I tried to clarify myself, she manipulated the conversation in emails and in person saying I said both of them are gifts. So for 3 years now, I keep trying to reason with Wendy to let me pick up my painting that was supposed to be on loan and since no one has made an offer to purchase them, I have since tried to get my larger “Old Man & the Sea” painting back. She never picks up phone calls, so I stopped. She does not email back unless I probe her with some offer to buy it back after telling me that it’s priceless, which then she switches her tune to see how much money she can make by making the artist buy back their own artwork.

The Facebook pictures are great, but since we like both of them so much, it would be easier (or harder) to choose which one we would like, if we could see them, perhaps at your appointment so we can all look at them in the office where it would actually be hanging?

Meanwhile, Wendy wanted to try her new couple’s counseling service and needed some clients to test out her skills on. My fiancé and I decided to try it out for $400 upfront with no receipt. After 2 sessions, we did not want to continue. When I came to drop off the gifted painting, “Twilight Mist” and the one on loan for display at the office, “Old Man & the Sea”, I asked Wendy for a $200 refund of unused services and she refused. I then asked if I could gift the unused sessions to a friend and she refused. She said she will not refund me anything. I was so upset at the turn of events and felt very manipulated, that I did not want to argue with her anymore about clarifying which painting I dropped off was the gift and which was the loan, while she was holding my paintings. I left with the intent of contacting her later to check in to see if anyone enjoyed the painting on display. After numerous emails to get the status of my painting on display, I got no emails back. I drove by the office and never saw her name on it, so I thought maybe she must've gone out of business since another client that I referred to her said so. I emailed every year for 3 years until I decided to see if asking to buy it from her and agreeing to her confused notion that I “gifted” her both paintings would trigger a response. It did. She wrote in the email that her clients enjoyed it and that it’s priceless, but with that, how much do I want to pay for it? Below is Wendy’s email where she tries to manipulate me to buying back my painting that was agreed to be the one on display that I can follow-up on and pick up anytime.

Hi ----,

The painting is loved by many of the patients who come into the doctor's office.  There are several who use it as an inspirational point in order to get ready for their visit, it calms them and helps them center. I don't think they would like the idea of it disappearing.

One mom brings her daughter in early just to look at the painting and use it to help the little girl calm down by pretending she is a mermaid in that setting and how comfortable she would feel.  She loves going to see Dr. Kat now since her mom started that.

So honestly, in their cases, the painting is irreplaceable, so I can't put a price to it. 

What are your thoughts on a price with this information?

As you can see, Wendy does not run an ethical business. She has manipulated me as a former client to get the money and property (painting) she desires, thinking that people will not challenge her. I have posted this warning about working and using her services on Yelp and the BBB as a warning. Do your research and do not take her word for it. If you don’t do as she pleases, then she will manipulate you and when you try to clarify things up with her, she refuses to reason with you. This is not “Angel” therapy as she claims. There’s nothing angelic about the way she runs her business. Since I’ve tried to reason with her, she sends me this message:

Last I heard from you, you were going report me -to the Better Business Bureau for not returning a gift that you gave me in early March of 2013. I would like to suggest however that you bring the dispute to the Snohomish County Courthouse in Lynnwood since they are the appropriate place to take such a dispute. 

 

I just want you to know that I have archived every business email that I have received in the last 10 years including all of the emails in which you and I discussed the gift of the painting, including the email where you sent me about 6 paintings to choose from. Since there is no written contract for this gift then it is those emails that the judge or mediator will use to determin what actually transpired between us.

At the time, as the emails describe, the painting was gifted to me as a permenant gift intended for the office. As such, I do not owe you anything in any way. At no time was it mentioned in the emails that you expected that by hanging the painting in the office you expected we would sell that painting for you. I would never have agreed to such an agreement.

If you think differently then you should file a complant in Snohomish County District Court and we will let the dispute ressoltion people assigned to the case, or the judge determin what the origional intent of the gift of the painting was at the time that you made it. 

The painting was hanging in the lobby of the office until you brought up this situation. It has since been moved away from the office location. It will be kept in a safe place out of the public until this issue is resolved.

So, I’ve tried for years to clarify which painting is the gift and which one if the loan to be displayed on the lobby that I can pick-up at anytime. Since she loves it so much, she refuses to buy it or give it back, because she claims I gifted both of them to her. Every year, I go to the office to see if it’s hanging and I do not see it in the lobby. I also do not see Wendy’s name on the office name plates or business display, so I thought she maybe went out of business. As I said, it wasn’t until I emailed her one last time 3 years later by offering to buy it that she responded for the chance of getting money. I gave up on trying to get my $200 back from her as she never gave me a receipt that I can use for each session used and unused to prove the transactions. I even thought that I’d just drop trying to ask for my $200 back as  fair exchange for my large painting back. No such luck. Wendy does not want to refund the unused services and does not want to give back my painting that was originally discussed as a loan. So instead of taking this to court as Wendy wanted, I have decided to just post a consumer review of how she runs her business and if you see my painting in her business, then you know the truth behind how she acquired it.
