Active pPeriodicals conned my son into paying 64.83 for magazines for 16 months. When we detected the scam we called and tried to close the account. They refused. They did however agree over the phone (but would never send us a written statement of the agreement) that they would accept a payoff amount. We paid that ($127.00) but they continue to hound us for information on my son and are now passing on to a thrid party collection agent.

Door to door sales?

If these bozos showed up at his door to make the sale, the 3 day cooling off rule of the FTC applies. This means your son had 3 days to cancel the agreement. Further, they were required to provide a WRITTEN STATEMENT to that effect at the time of sale as well as contact information and complete cancellation proceedures.

IF THEY DIDN'T COMPLY with these requirements, that's grounds for a FULL REFUND as well as a FORMAL COMPLAINT to the FTC, your State AG and the AG of the State inwhich they are incorporated or licensed to do business.

You might call them and and claim that they violated this mandatory 3 day cooling off rule and inform them that if they don't cancel the subscriptions and give a complete and total refund of monies paid that you will follow up with WRITTEN complaints to the FTC and the appropriate State AG offices.

Further, because they failed to comply with FTC rules and provide your son with adequate cancellation proceedures to exercise his right to cancel, all reporting to credit agencies should be removed immediately or you will seek remedies as allowed by the Fair Credit Reporting Act.

It goes without saying that any collection attempts should stop immediately.

You could use the ploy that you're willing to "forgive" their violating FEDERAL law and regulations PROVIDED that they immediately cancel the subscriptions and provide a complete refund of monies paid.

When you talk to them, demand a mailing address so that you can mail them a certified, return receipt requested letter to demand the cancellation and refund, and to put them on written notice that if they do not comply written complaints will be made with the FTC and appropriate State AG offices.

It's worth a shot.
