On Jan-15-2010, I ordered a color laser printer for $10. After 3 days, they turned around and claimed they listed the wrong price. They said it was supposed to be $139.99. Can I sue them base on this? Thank you.

Perfectly legal

What they did is perfectly legal. Since it was obviously a mistake and they never accepted your order they are legally fine. I am also pretty sure there website states that prices may change, but either way they don't have to honor a price that is in errror.

The general rule at common law is that if one party has made a mistake as to the terms of the contract and that mistake is known or could have possibly be known or assumed by the other party, then the contract is not binding.


The laws on e-commerce give an e-tailer discretion over when to decide that an order is accepted and conclude a contract.  


Therefore, if a customer could reasonably be expected to be aware that there was a mistake as to the price of an item prior to placing an order, and the e-tailer chooses not to accept a payment offered for an item, there is no agreement between the parties.



Unfortunately, the orders came into the Adorama website while the offices were closed on Friday afternoon and Saturday.

It was only when Adorama staff members returned to the office on Sunday morning that the tech team could see what had taken place, were able to take immediate action to remove the mis-priced item, and to send an email of apology to each person who had placed an order.


The Adorama Management Team regrets most sincerely that it was necessary to inform customers that this item was incorrectly priced on the website, and as you can imagine many thousands of orders were received - at a time when the offices were actually closed for the weekend so nobody was aware of this issue until Sunday morning.


It is appreciated that many people may have been disappointed; however, it is hoped that all customers who were affected by this pricing error will understand that this was a genuine mistake by a single programmer, and accept this deep apology that it would not be possible to process all of the orders at the previously published incorrect price.


While every effort is made to try and ensure that all prices on the Adorama website are accurate, with the thousands of items available pricing errors may occur, (please see the terms and conditions), and everybody's understanding is received with gratitude.


In accordance with the Adorama Terms and Conditions of Web Site Use and the Pricing and Availability Policy, there was no choice but to cancel all affected orders. If any customers still wished to purchase this item, they were invited to place a new order which would be charged at the correct price.


Any customers who preferred that their entire order be cancelled, were given that option.
