Today is December 28th. Currently we have not received our deposit back from a property that was vacated October 31st. We gave our "60 day" notice on August 14th, however we were required to pay rent through October 31st, which of course we did. We never received a statement from Central Property Management stating that they were imposing claims on us, listing an exact amount. We too (as others here have mentioned) were sent an "estimated bill" for claims mostly revolving around repairs to overhaul the A/C unit. Please note that per Florida Law, they are required to send us a letter via certified mail detailing the exact charges to be imposed on us within 30 days. We received said letter December 2nd (after the 30 day statute had expired).

I'm no expert, which is why I'm looking for a lawyer, but I believe that i fulfilled my duty as concerned to the A/C by replacing my air filter once every three (3) weeks. I believe that all other concerns as relating to the A/C unit are the responsibility of the owners/property managers.

Here are a few other issues:

Contacted Marilyn, Doug, Jonelle and Bleu on December 4th, left voicemail one week later, and followed up by email on December 17th. At this point I have still not heard back from any of them as to the status of my deposit check. Remember, our lease expired the last day of October.

In general we always had issues getting in touch with someone at central property. I would be happy to provide dated emails as proof, with their response typically being anywhere from one (1) to three (3) weeks after our initial inquiry.

Status: still waiting for deposit to be returned to us 60 days later
Suggestion: Avoid Central Property Management

I'm following up to take legal action, in addition to contacting multiple agencies to make sure that they are aware of Central Property Management's illegal tactics.

Central property management rip off

I also had a realy bad experience with central property mangement both doug and marilyn, they changed the lock on my unrented house and when i tried to visit i could not get in cost me hundreds of dollars to get a lock smith as they would not give me the keys to my own house Can u believe it?. among many other things they have done, if u are going to court let me know..i will join you they deserve the F rating on the bbb from dissatisfied consumers, although they will tell u otherwise.  i would never recommend them they are dishonest

We have had similar issues with Agape/Central Property Management.  We have also found that Doug Campbell has a problem with the truth.  Make sure that you consult the state of Florida, specifically the Department of Business and Professional Regulation and Florida Department of Agriculture and Consumer Services (bogus security deposit charges) and the Florida Real Estate Commission.

Here's my latest email from Doug. I am beginning to file a lawsuit to get my deposit back, so I needed the company address. Google showed conflicting addresses for the company, so I cordially asked (5 times) for the company address. Here's his email back to me, quoted word-for-word:

What? Where have you been mailing your rent for over the past 2 years? I think the courts would look at the fact that you rented a property from Central Property for over 2 years and now all of the sudden you don't know where you mailed the rent to. You also have mentioned that you have reviewed the lease regarding the repairs, so since you have the lease in hand could you not just read the address off the lease?

I'll let you in on an internet secret I learned. There's this place called 'google'. It can find just about anything you're looking for. Including our company!

I also see that you had been emailed by Jonnelle at least 6 times between October & November 2009. I'm sure that if you had taken the time to actually read the email, everything you need was right there.

It's not so much a pattern of neglect on our part, but since all the information you were requesting was in all of your paperwork I thought you would find it on your own. I guess I was too optimistic. But I took 30 minutes out of mine and Jonnelle's time to respond to you. So here you go!

Since I haven't sent rent in 4 months (since I moved out), I thought it might be a good idea to double-check the address. Since I found google listed a new address, I double-checked with 4 people at Central Property (Marilyn Campbell, Bleu Santana, Doug Campbell and Jonnelle). This is the lovely email I received from Doug.

I would also like to point out I've been requesting the address for over a week, with 5 requests sent by email and 2 by voicemail.

and I believe Florida law is on your side.

The state Department of Agriculture and Consumer Services handles landlord-tenant disputes. Beyond the time issues - which they may violated, though I think Florida allows postmarks as proof of mailing - I see a few issues here:

1) They are not stating specifically what they are deducting from your deposit - Florida law requires them to do so 2) Typically, tenants are not responsible for normal wear and tear or for appliances that need repair for something that is not due to a tenant's neglect. Hopefully, you provided them a notice of dispute of deposit withholding within 15 days as required by the law.
