Alamo Rent A Car has filed a false claim that I damaged one of their rental cars; claim #00728496

Upon renting the car on July 23, 2010 I was simply handed the keys and told where it was parked in the garage.  There was no paperwork to fill out as outgoing inspection; I inspected the vehicle myself noting there was no damage to the vehicle and drove away.

When I returned the vehicle they told me to leave the keys in the vehicle and would have someone check the gas tank levels-which I had filled 1/2 tank over the agreement by the way.

There was no inspection papers upon my return either--this was the first time I had not had inspection papers from any rental car place, but having seen no damage to the car when taking it, and having inspected it myself upon return I know that the car was undamaged. Additionally, Alamo rep. went into the garage to verify gas levels upon return and made no mention of damage to driver door as they later claim.  There was no paperwork signed upon return about the vehicle, just gas levels.  After 4-5 minutes I returned to the garage to retrieve my umbrella from the trunk to find the garage attendant in the car ready to move and clean it up.  There was no damage to the car at that time.

The insurance carrier says they received a picture of the supposed damage that was taken in August 2010.  I returned the car on July 23, 2010. My first notice that they alleged damage was written on July 29, 2010.  That car had to have been damaged after I left the garage by one of their employees or by another driver after the 23rd of July.

I did not take their insurance because I have Progressive insurance, a fine company and have a safe driver designation to boot!  Had I done damage to the rental car I would have filed an accident report at that time and taken care of the situation.

Progressive attempted to obtain proof that I had damaged the car and after 12 attempts, multiple communications [which I have copy of] they have dismissed the claim stating that Alamo has not provided necessary proof of damage to the vehicle. I also have communication from Progressive showing that they requested proof of damage repair verses an estimate for repair that they continue to forward.

Subsequent to Progressive dismissing the claim I received a letter from Jeffrey Fisher of Alamo stating "After making a good faith effort to settle our loss with your insurance, we have learned that your insurance coverage did not apply."  This too is a false claim; Progressive went out of their way to obtain necessary documentation and Alamo did not comply.

I would gladly take responsibility for any damage I may have done to the vehicle.  However, I am also an ethical individual who expects the same from organizations I choose to do business with, unfortunately Alamo is not ethical and I am appalled that this type of situation has happened to many other people around the USA.  [read here and Consumers Affairs]

I intend to continue to fight with Alamo and have filed like dozens of others with Consumers Affairs and now with this consumer advocate site!
