Alexander Leonio sold fake Lacoste rubber shoes through Ebay San Bruno California

Mike and Alexander ar 1 and the same scammers!

Bided at ebay on an item claimed to be authentic. Item Significantly Not As Described: Lacoste Thrill Sz 10 Mens Shoes Green / White (#7746875154) Payment Method: Bank to Bank Wire Transfer Payment Date: Mar-07-2006 Additional Details: item not at all authentic. you can buy same item in Greenhills (PLACE KNOWN FOR SELLING KNOCK-OFF COPIES OF FAMOUS BRANDS)for a significantly lower price or PHP950- US$18), without having to pay for the ghastly over priced delivery (was charged US$50 for a local registered mail worth less than PHP 15- about US$3). I had bidded on the item since the seller had stated that it was "authentic". If you considered the charge of the shipping and the description, you will definitely see FRAUD here.

Tried to get in touch with Mr.Alexander Leonio aka nmachiaveli through email and through his "contact seller" at Ebay- he ignored it. Went through the whole process of mediation at Ebay. Ended up being called a "liar" as he called all who called his product a fake.

Filed appropriate report at FTC, FBI IC3, Interpol, and Ebay.

But Ebay continues to allow him to trade rip-off items through their facility! I believe that Ebay must also be held liable since on the oset of getting bad feedbacks for this person they (Ebay) should have cut-off his account to prevent future victims.

His other Ebay account is badminton_blue. You may check the items he had sold -mostly rubber shoes and compare the way it was presented in both accounts.

Latest bad news, Ebay allowed him ot keep the comments against him private. Ebay seems to be protecting him than his victims!

A criminal case had been filed against Alexander Leonio and his cohort.  It is currently being heard at Branch 60 of the Metropolitan Trial Court.

Mr. Alexandeer Leonio, jennifermla, mikea , or whatever your name is hasn't even attented a single hearing.  Could it be that the name Alexander Leonio is also an alias?  Hmmm?  But I did include the name of the person who owns the bank account of which he has directed me to deposit the payment.

 

So, Mr. Alexander Leonio, with all your treath of suits of libel. I did file a suit against you and a Criminal case at that.  Be brave enough to face the court.

UPDATE:

At long last, the complaint has moved from the prosecutors' Office to The Metropolitan Trial Court Branch 60. Criminal Case No.102823 Estafa and other deceits under Article 318 of the Revised Penal Code.

Once a complaint has been elevated to the court, it is considered that there is prima facie evidence against those who committed the crime. In this case the title of the case is: People of the Philippines versus R. Vlayo & Alexander Leonio.

A warrant of arrest has been requested against Alexander Leonio. If there is a need to have him extradited so be it!

So where's the so called civil case he was suppose to file against me?

This is also a notice to this blog. That since it is now formally a case, this is therefore Subjudice! You may be liable for contempt of court even if both parties do agree with Arizona as the venue. A case can be filed right here.

Internet sites like craigslist and eBay need to do more to protect honest users from scam artists like Richard Yapco (information given by eBay). As previously stated, if your high bidder or buyer writes to you claiming to be from the USA, but wants the item shipped elsewhere that should raise a red flag. Do NOT accept overpayments from scam artists like Richard Yapco for items where the buyer is asking to be reimbursed for overpayment. These scammers can come up with a million excuses so if you receive such offers, please report it immediately.

He claims that Ebay had notified him that I, Richard Yapco, is connected with jerrcollins69 aka lordowel-06. This is purely an invention from his own mind!

He won't list the other 50 positive feedbacks received from honest eBayers because that would ruin his credibilty. These are malicious individuals who either chose not to issue payment or demanded a different item after winning an auction in which all sales are final. The bottom line is it's unacceptable to change your mind after winning an eBay auction because it is a legally binding contract. Richard Yapco is not fooling anyone. He came across fake Lacoste replicas at his local market, and would rather keep those instead of the authentic pair he won.

The non-paying bidders either have an overall negative feedback score or are no longer registered users. The negative feedback they left were simply retaliatory and defamatory. Too much time has been wasted on con artists like Richard Yapco. The final objective of this post is to make sure others will not fall for his scams.

The online auction site eBay gives the option for members to make their feedback comments private to help remedy situations like this where retaliatory and defamatory feedbacks were received from dishonest eBayers like Richard Yapco. He won't list the other 50 positive feedbacks received from honest eBayers because that would ruin his credibilty. These are malicious individuals who either chose not to issue payment or demanded a different item after winning an auction in which all sales are final. The bottom line is it's unacceptable to change your mind after winning an eBay auction because it is a legally binding contract. Richard Yapco is not fooling anyone. He came across fake Lacoste replicas at his local market, and would rather keep those instead of the authentic pair he won.

The non-paying bidders either have an overall negative feedback score or are no longer registered users. The negative feedback they left were simply retaliatory and defamatory. Alexander Leonio has never sold a single fake or misrepresented item. That is the truth, and the evidence will speak for itself! All items from his collection were purchased in the USA over a period of several years.

The real con artist here is Richard Yapco. It's unfortunate that scammers from overseas can register themselves inside the USA with fake information, which he did with a couple screen names. This scam artist not only fabricates his stories, but will also try to ruin your overall feedback score. He is connected to at least two other eBay accounts with overall negative feedback scores (jerrycollins69 aka lordrowel_06). This past year has been the worst for scams. Buyer beware has now been replaced with seller beware. Lesson learned, if your high bidder writes to you claiming to be from the USA, but wants the item shipped elsewhere that should raise a red flag.

Sounding legalistic does not cut at all!

Selling off knock-offs (still have the packaging and material with me for evidence.) on Ebay.

If you want to read the comments made by the customers of Mr. Alexander Leonio through his Ebay username of nmachiaveli, simply google "nmachiaveli". Even if he had requested Ebay to have it private you can view it from there.

If you truly believe that your item is genuine, you'd offer to give refund- yet you don't.

It isn't libel if I can prove that it was fake from the very start. By the way, I still have copies of all our communications plus reports to Ebay plus the other "unhappy" customers you had.

Richard Yapco made untruthful statements about a person, Alexander Leonio, and had them published in writing through broadcast media. The conflict began when the defamer, Richard Yapco, purchased a pair of authentic Lacoste shoes from an auction Alexander Leonio had on eBay. When Richard Yapco changed his mind and asked for a refund, Alexander Leonio denied his request because nowhere on his eBay listing did it say that refunds or exchanges were accepted. So when Richard Yapco demanded a different style, his request was again denied. Alexander Leonio had one pair of authentic Lacoste shoes from California to list on eBay, that's it. When Alexander Leonio took a stand and denied his demands, that's when Richard Yapco started to falsely claim that they were fake. Richard Yapco is a malicious scam artist trying to injure a person's reputation and standing in the community. Because libel is a tort (a civil wrong), Alexander Leonio has brought a lawsuit against Richard Yapco, who made the false statements. The bottom line is defamatory speech distributed over the Internet will result in civil liability for the defamer.

The following are present in this case to establish defamation:

1. A defamatory statement (or material) or imputation;
2. The statement (or material) identifies the plaintiff; and
3. The statement (or material) is published to a third person, i.e. at least one person other than the plaintiff.

Unfortunately, the defamatory statements made by Richard Yapco have already been published to at least one website. Once a person views the material that has been uploaded, sent or posted on the Internet, that material is regarded as having been published. Republication is also a recognized form of publication. Accordingly, taking defamatory material, copying and distributing it will result in a defamation claim against the original writer of the material as well as the persons who copied and distributed it. The truth is Alexander Leonio has been very professional and polite in trying to resolve this matter. Unfortunately, it was not possible to do so amicably with a con artist like Richard Yapco.

As soon as I got the shoes, I assumed that it was as "authentic" as he stated it was. But after a few days when I visited a local market that is famous for knock-offs, it was the same shoe at their display!

I emailed Mr. Leonio twice! One through the regular email, which he ignored, and another through ebay, which he ignored, too!

I went to report it to ebay through "article or items not as described" and tried to get his response. His typical reponse is to attack by calling people liars!

He now hides his feedback since 4 to 5 buyers of his had said they were sent fake items (not authentic!)

If he feels so strongly that his item is "real", then he should offer a refund plus shipping for return of his goods.

Anyway, if he is willing to open up again his feed back column, I dare him to, you can compare his and mine and clearly I have an immaculate feedback as compared to his.

BTW, am coordinating with other government agencies and am willing to send the fake shoes to them as evidence plus all the emails that was sen through and from Mr. Leonio!

Let the evidence speak for itself!

These accusations by Richard Yapco are absolutely false. He even left me positive feedback because he received the item in the exact condition they were described to be in, and the parcel arrived within the guaranteed time period. I then received an email from him demanding a refund or different style. I wrote him back denying him because that's not the way eBay works. You don't bid on an item, win it, try it on, wear it..then change your mind. You can't demand another style or size, and it is ILLEGAL to make FALSE accusations. The item description is written CLEARLY on the listing and a picture of the item is even posted! First of all, my item is authentic. They were NOT purchased from this Greenhills place. I don't own anything fake. Nothing in my collection or home is fake so when he tried to use that to get his way I didn't buy it.

Second, EMS International tracking does NOT cost US$3. I clearly wrote down the Expedited Flat Shipping and Handling rate on my listing. Every RESPONSIBLE bidder knows how much shipping and handling is before bidding on an item. I was very polite and professional in communicating with this individual, but I don't trust this guy. It has come down to his word against mine. I strongly feel that he should receive some kind of warning and suspension for filing FALSE reports with eBay, FTC, FBI IC3, and Interpol because these are serious offenses!
