I spent $35,000 on a poorly constructed pool. The company did not fix anything and blamed me for the problem, although I provided video of the damage and their service person reported the damage weekly, so he said. I have not had the pool for one year and the tile and coping has been falling off of the pool. All of the executives lied to me about honoring their warranty and replacing the coping and tiles. I've been a lawyer for 10 years and have never dealt with a more dishonest company. As I begin litigation, I would like to know whether anyone else has had problems with this company honoring their warranty. Please contact myou law firm, Lynum & Associates, PLLC. Thank you.

LIARS: ALL SEASONS POOL

AUTHOR: - ()

POSTED: Wednesday, February 24, 2016

DON GARDEN, the President of ALL SEASONS POOLS is without morals.  He lied in the above message and is so dispicable that he called Sumter County Code Enforcement and lied about my pool deck only to learn from Sumter County that he is a liar and nothing was done to my deck that required a permit.

I'll be happy to share the public record of his lies to Sumter County Government with anyone.  The 60 day demand period under Chapter 558 for dead beat contractors and liars like ALL SEASONS POOLS is soon expiring and I'll be able to depose Mr. Garden on the non-arbitrable claims.  I suppose he'll have his lawyers reach a confidential settlement but I think...

...THIS COMPANY WILL RATHER SPEND 10 TIMES MORE ON AN ATTORNEY VERSUS FIXING THE PROBLEM.  IF YOU ARE NOT A LWAYER LIKE ME WHO CAN, WILL AND IS FIGHTING BACK, DO NOT HIRE THIS COMPANY.

All Seasons Honors Warranties

All Seasons Pools constructed a beautiful pool for Mr. Lynum. There was an issue in December regarding a loose piece of bull nose coping that was repaired under warranty.

The pool was built with a poured concrete deck and precast bull nose coping. The tiles on the outer wall of the spa are installed prior to the concrete being poured. The deck is poured and finished up to the outer wall of the raised spa. This is intended to be a permanent installation of the tiles and the concrete decking. Because the deck is poured and finished against the tiles, it would not be out of the realm of possibility that by removing the concrete deck in order to install pavers that the tiles would be pulled and broken from their position of original installation. After Mr. Lynum added a wood deck and attached it to the concrete deck, he has since had the concrete deck removed in order to install a deck consisting of brick pavers. By removing the concrete decking by demolition, it has compromised the integrity of the tile installation. All Seasons Pools stands behind its products and their installation. Had this been found to be an issue with the installation, there certainly would not have been a question as to the course of action taken- the repairs would have been made at no expense to Mr. Lynum. It was assumed that permits were retained by a licensed and insured contractor. It does not appear that any permits were retained for the construction that ensued after the pool construction was completed. The course of action taken by this contractor should preclude All Seasons Pools from bearing the responsibility of the damage that ensued.
