I recieved a voice mail from Alliance One in reference to an account that has passed to collections. I called them back and asked what it was in reference to, and this very rude woman answered the phone and I gave the information that was asked of me.

The person on the other end of the phone started grilling me about who's phone i called them from (due to the fact that I have no home telephone, and then she preceded to tell me that I need to pay for the accounts.

Right at the present time I recieve public assistance and all of it goes to keep a roof over my head and over my son's head. I tried to tell them that and the person that answered the phone told me to grow up because services are not provided for free.

I was extremely pissed off due to the unprofessional behavior of a grown adult that is supposed to be dealing with the public. I am disgusted that they employ such tactics to collect debts.

Wrong, No Debtor's Prison in the U.S

WRONG.  There is no debtor's prison in any state in this country. In Beardon v Gerogia, the Supreme Court has ruled that the state courts cannot jail anyone because they do not have the funds to pay a fine and that a hearing must be held to ascertain if the failure to pay is willful.  If you cannot pay you can ask for a hearing and explain to the court your circumstances. Even old tickets can be put back on the docket so you can pay the court directly. Many places will allow community service instead of fines.  If you are threatened with jail by any debt collector, record it and call a lawyer who specializes in consumer law.  

Further, Alliance One seems to have trained their employees that they do not have to file the proper papers in order to garnish, including sending mandatory notice under RCW 6.27.140.  So if your bank account is garnished and you have not gotten notice contact a consumer attorney.  If you are a veteran or your account is funded by SSI or SSDI, or VA disability compensation they cannot legally take any money from that account soley funded by those funds.  Further, the bank is mandated by law to check if your account is so funded and is not allowed to permit the garnishment/levy if your account gets direct deposits from those sources.

This collection agency exists soley to collect Court fines and overpaid or fraudulently obtained State benefits such as TANF, food stamps, workers comp and unemployment. The agency was created because the individual Courts and State agencies were spending too much money and time working on collecting money from people who won't pay their court costs.

Alliance One is subject to many of the same State & Federal collection laws as any other collection agency with one very notably exception: if you won't cooperate or don't pay or heck, if they don't like the tone of your voice, they can return your account to the State/County as uncollectible and the State/County can revoke your probation, suspend any plea agreements and issue a warrant for failure to comply/failure to pay and throw you in jail. And the State/Federal debt collection laws will NOT protect you from being jailed for failure to pay. Nor does the debtor have to be served, cited or summoned (by Alliance One) because they aren't being gailed fro failure to pay a consumer debt, they are being jailed fro failure to pay money as ordered by the court.

Contrary to popular belief, unlike traditional collection agencies Alliance One employees do not work on commission nor does the agency buy or sell debts.

        Incredible! How is an economically disadvantaged person going to "come up with the money legally?"  This company stomps on people who, for whatever reason, have come forward to try to get their life together. I am sure none of these people claim perfection, by any means.  Do you suggest going to the bank to get a loan? A-1 ruins these peoples credit rating by listing unpaid tickets on their credit reports. Also, they have been known to garnish poor people without notification!!! I know some Ex employees of this totally screwed up company, and the stories they have told me  have led me to believe this company is in need of an audit. Pedatory collection practices in this state are illegal.  However,there is a definite legal quandry. How does a court system sue a corrupt company that they have contracted to in the first place? Believe me, A1 knows this, and therefor still operates today with impunity, accountable to no one. You might ask, why am I writing this? Because I am one of those people who have been screwed over by this company. Because of their inabity to process timely payments (they totally lost my first one),Total lack of effective resolution, unprofessional communication, unclear policies, ect., I lost my supervisory job, and my drivers licence. I couldve sued them, but did not have the money for an attorney.   I just want you to know that I am an honest hard working man. I would give you the shirt off my back , if it would help you. I am married, with 2 kids. Somehow, through all this stress, my wonderful wife has stayed by my side. Since A1  said I was no longer eligible for the program, I have spent the last 3 years without a licence. Tell me, mister---do you think thats fair?

So you are proud that you ripped off the people you owe money to. You borrowed the money, did what you wanted to do with the money and just filed bankrupty to keep from having to pay it back. What is the diffrence morally between you and a thief??

I've too been harassed by these people...mainly a guy named "Mr Bradley" at phone # 877-560-4693. Had a SERIOUS attitude problem and when I asked the name of the company he first mumbled it and I asked a 2nd time for him to speak clearly and he said it again and then said "Oh ma'am, is that the BEST you can come up with" in a super s****.> What I would recommend doing:
1. You can send them a cease and desist letter (make sure it's sent certified with return receipt) there are nice examples on various websites for doing this.

2. Get the phone company to turn on call screening for you. This can be set up dialing *60 and enables you to totally block their number so they have to go through a special operation and confirm who they are when promted before the phone company will let their call through, it's extremely handy and gets rid of all the unwanted scum like this!
