We made the mistake of re-financing our mortgage with Ameriquest in 2004. At first things seems to be moving smoothly, the first warning was when we were not given a copy of our appraisal, asked for it 3-4 times. We are in the process of re-financing to get a 30 fixed rate (NOT with AMC). Our mortgage person got a copy of the title and asked why we had our (my husband and myself, son was on the title)names removed. We said we did not, the title was in my son's name only and we did a quit claim to add my husband for tax purposes.It seems AMC did not do what they told us, they said all 3 of us had to be on the title, so we signed papers and assumed we were all 3 included.

It turns out they REMOVED our names and only left our son on, what if something would have happened to him.....this has delayed the whole re-finance process because we now how to do another quit claim and get the title back in all our names.

I am also filing a compliant with the Attorney General's office.

You are correct, we checked with the county and they have the same info, only my son is on the deed. We were "verbally" told as we were signing the deed, that all 3 of usd would be on it. I guess we "assumed" what we were being told was right and did not thoroughly read what we signed. When the copy came in the mail, we filed it away.
We have now filed a new quit claim deed, but the county is 9 months behind in their filing.
We also asked for a copy of the appraisal numerous times and never received a copy.

What happened to the Original filed with the County Recorder?

In Cali most lenders and title companies are not fans of Quitclaim Deeds as they are not as concrete as they used to be and have been voided through Courts from time to time, so almost always these days the Lenders and Title Companies prefer the use of Grand Deeds.

Having said that, what happen to the Orginal Quitclaim Deed filed with the County Recorder? After submission of the Quitclaim Deed to the County Recorder you should and received the original (conformed/stamped) back in the mail. At the time of filing the Recorders office generally will give you a temp. conformed copy that day but keeps the original till it is put on the system and then returns the Orginal Conformed copy to you.
