We have always had problems with ASC as far as them claiming to receive late payments. We would receive their monthly payment stub late sometimes, at times almost a month late. When we did get the payment stub on time, and we would send the check in, they claim it was late. They would call before the payment was due at times and try to work out a payment even when there was no late payment due.

On August 29, 2005 Hurrican Katrina made landfall, and that is when things got really bad with ASC. They restructured our loan and gave it a different loan number without notifying us. So, when payments where made to the original loan, even though they would cash the check, they would not post payment to the correct loan, thus claiming we were default on the loan. This went on for some time until June of 06. Were were contacted by a foreclosure company telling us that our house was going to be auctioned off.

After trying to contact ASC several times, we were finally able to work out something with them. We had to pay interest only payments twice a month of $250 for 6-9 months to pay the interest of the loan until they could restructure it yet again. In March of 07 we finally began making regular payments again. We received a phone call by an individual asking about our house that is being put on auction in August of 07.

This is the first we have heard of it. We cannot get in touch with anyone to see what is going on. They are also supposed to clear up our credit report that they have ruined due to all of this, with no luck. What can we do?
