My home loan was originally through CountryWide and ended up with ASC. I had decided to sell my home after my mother had passed away to relocate and reinstate with the government. My home (purchased in 2004 for $259K)was in escrow for $430K - Fresno), when the buyer backed out 3-days prior to closing in October 2005. I applied the buyer's $3000 deposit toward a payment as I had just shipped my belongings and car out of state.

I remained in contact with ASC and spoke with a different "representative" each and every time. I applied for, and was told by one "rep" that I had been granted a temporary "forebearance." After a month of still not receiving confirmation, I made another call and spoke with of course another "rep." I was told at that time that I had been misinformed and they of course had no record of my calls and that I was facing foreclosure.

I continued to try to obtain an equity loan ade numerous relocated to reinstate with the government, but remained in constant contact the different "reps" documenting all calls and saving all emails, copies of items faxed, and the transmittal forms showing the faxes had been received by ASC.

In addition, I contacted Wells Fargo and corresponded by email and phone with one representative on their end. It seemed hopeful that Wells Fargo was going to work with me on a forebearance.

Meanwhile, I contacted every refinance and equity loan company that I could. Although it looked hopeful on several instances, all was false information and the same answer..NO! By then I was just focusing on saving my home and had hoped to return and with an equity loan perhaps be able to rent it out until able to do so.

Due to my not being able to take out any equity, I lowered my home to what would have covered the loan and fees, and it was back in escrow with a serious buyer ($30K deposit). However, ASC continued to interfere rather than try to work with me and proceeded with foreclosure. It was in escrow with a huge deposit. The buyer backed out half way through the 30-day escrow when they found out that a foreclosure was pending.

At this time I was desperate to at least try to salvage my credit and contacted yet another "rep" with ASC to request a "deed in lieu of foreclosure." I faxed the information requested and received the transmittal confirmation. I waited another week and called and spoke...you got it! To another wonderful ASC "rep" and was told nothing was ever received...that I could resend, but they doubted there was not enough time to do anything about it. I sent the same fax after reconfirming the same fax number as before and on the original confirmation, and again was told days after calling that it had yet to be received.

I lost my home on May 1, 2006 to foreclosure. Yes, the bank bought it back. Needless to say I still tried to even work out something to repurchase it (fooling myself) yet was told that I would have to wait another year and would have to pay the original loan and all late payments and fees incurred.

As a single mother/grandmother I worked hard like the many others to save for my down payment and buy my home. I did a lot of upgrades and worked on improvements even though it was a new home while I was caring for my mother. I lost everything again including my equity and credit.

I have tried to contact ASC on numerous occasions requesting they at least remove the foreclosure from my credit reports, and provided them with copies of ALL of my correspondence over the course of October 2005 to May 2006.

I have tried contacting a few attorneys with the hope of pursuing a lawsuit, but no one seems to be interested so I am seriously thinking of pursuing it on my own behalf due to the documentation, correspondence including certified letters and emails sent and having been acknowledged as being received and/or responded to by this rep or that rep.

If you read this, don't do business with ASC. If you are losing your home...try not to give up and leave no stone overturned. My heart goes out to you. I know ASC is probably in a complaint line up with many other lenders, but their customer service is non-existent/definitely lacking. It is 2008 and I am barely beginning to see a light at the end of the tunnel. The last few years have not only been a sad and emotional time, but it is disheartening to think that no one "could" or "would" help.
