I had fallen behind in my payments due to both lose of employment and a death in the family. Several requests had been made to AmeriCredit via email and telephone conversations to either modify the payments or repossess the vehicle. They refused, stating, "we don't want the vehicle, we want the payment." I had even reported the aforementioned to the Federal Trade Commission (FTC). In December of 2008, I had requested that the repossess the vehicle. On December 16, 2008, that came and took the vehicle. I had decided to surrender the vehicle after the relentless amount of phone calls for collection that had been received. Sometimes four to ten times per day, the majority of these calls were hangups. Which, I might add, is a violation of the Fair Debt Collection Act.

On April 22, 2009, AmeriCredit had sent me a letter requesting a balance on the vehicle at issue after it had been sold at auction. I had responded to them on April 28, 2009, that their offer of settlement is unacceptable on it's face and that if they continue to harass me, I will, in fact file a complaint with the Federal Banking Commission.

Word of advise, stay away from AmeriCredit as their business practices are borderline extortion.

Illegal tactics

I have experienced Americredit's backhanded ways. Simply by the many replies Americredit has left on this site with personal information about their clients accounts, tells you something. They are under-handed, abusive and unworthy of doing business in this country. Go do business with thugs...that's the style used by this company. No service, no customer care, and they do what they want as witnessed by the rebuttals to various messages by Americredit employees, disclosing personal account information on a public website! Wow.

just a wise piece of advice dont think americredit has pitty on you.  I was taken to the cleaners by them.  I fell behind a few times with them and they did deferred my payments.   When I took out my loan it was for 60 months .  i had 14 months left on my loan the truck needed a transfer case replaced.  At the dealer they told me it was going to cost close to 2000 to fix it.  I only had 600 so I called americredit and asked if I could add on to my loan the repair.   americredit said no and we are not a bank. 2 days later americredit called and asked where is the truck now. I told them it is here and why. the woman on the phone said we have checked your payment history and you have been late or behind several times. She than said I owe last month and this months payment.  I told her I could pay last months payment now with a western union quick collect she said ok.  She than said how long before you can pay for this months.  i told her in 2 weeks why.  have you fixed the truck i said no i need 1400, she said ok i will check back with you . the next day she called and said your truck maybe pickup due to you not making payments on time and not maintaining it. 2 days later the repo truck came and took it .even after i showed him 2 days before i made another payment. he told me to call americredit so i did.  they said i would have to pay them 2500 to get the truck back or in 3 months it was off to the auction.  i could come up with that money i lost the truck and it was sold for 3500 less than what the dealer would of paid.  americredit is like loan sharks and they are getting away with it.

Those Ripoffs

Americredit truly needs to be shut down after all the hurt, pain and suffering that they gave their customers. It is truly unfair for people to say yeah they have had good relationships with them. To the person who had such a good relationship with Americredit, I can only say...So what and big deal!!!! Even people with better credit with others are now having problems with them. I mean even if you called Americredit, they give you the run around. Meaning either way, you are screwed. They claim they are going to work with you and they don't. They constantly bug you even when you tell them not to call you 20-40 times a day and at all hours of the night. Now, back to the person who has such a good relationship with them, please take this into consideration...

1. What if you had to take care of a loved one financially and forced you to miss a car payment.

2. What if medical situations came up unexpectedly??

3. What if you got laid off??? Americredit really doesn't have a care in the world when that happens.

You better hope you never get laid off or have any emergency situations arise, because the next thing you know, you will be a victim, just like the rest of us.

My experience with Americredit has been quite positive. In the span of a year, I fell behind on my payments two different times (1 month in one case and 45 days in another) due to a medical issue which forced me to miss work, thus reducing my income. Sure, they lit up my phone lines which is to be expected, but when I called them back a few days later, they bent over backwards to accomodate my situation. They deferred two payments, allowing me to catch back up on all my other finances, which enabled me to make my next payments on time. Never at any time was anyone rude or disrespectful to me, in fact just the opposite. I believe the key is to pick up the phone and call them to explain your predicament rather than dodge the calls. By contacting them it shows good faith on your part and I believe is more likely to result in a positive outcome.

Extortion?

Let's see you signed a contract that stated you would pay a set amount each and every month. For this agreement they would loan you several thousand dollars to buy a car. When you failed to pay on the car they reposessed it. It actually wouldn't have taken a call to the FTC, they would have done it anyways. Once it is reposessed that does NOT relieve you of your legal agreement to pay back the balance of the loan. So they can, and have, come after you for the balance. If you refuse to pay it you will probably be sued. This is not just Americredit but any other lender would have done the same thing.

Also, Americredit is an Original Creditor so the Fair Debt Collection Practices Act(FDCPA) DOES NOT apply to them. Only a couple of states that I am aware of(and FL is not one of them) have laws that cover original creditors.

So you can write the Federal Banking Commision all day long, but since these agencies have no authority over Americredit it really won't go anywhere. The only good news for you is that once Americredit sells your debt to a collection agency you can then hold that collection agency to the FDCPA.

I too am a client of Americredit.I lost my job in March and have tried to make payment arragements with them $250 per week they told me o.k. but now the late fees are adding up and they are still calling me at least 8 times per day.In these hard times when other creditors are willing to help why can't they.
