Americredit Auto financing Americredit lied to us, told us that we would get a deferment due to health reasons then harrassed us and did not give us a deferment causing us to further get behind, sent no letter to me, repossesse Charlotte, North Carolina

We were misled about the quality of service we would get from Americredit.

We were not behind on our loan for many many months, until my husband had a heart attack while driving and a wreck also. We applied for a deferment but were automatically turned down first.

We were then called back and promiced a deferment for three months but did not actually receive one for that length of time, it was for a month or so. We asked for them to work with us long enough for my husband to recouperate and get back to work, and were turned down for that. We did make a payment  then during that call and everything was supposed to be alright.

They called us back in less than a month's time and started threatening us that they were going to repossess the vehicle. We called them again and they lied to us again about working it out with us. They said everything would be ok.They came at 2:30 in the morning and scared us half to death banging on the door, waking our neighbors and embarrassing us.

I am also a stage 4 breast cancer survivor, and now disabled from the botched up re-constructive surgery but do draw a long term disability benefit and a SSI benefit. I had offered them a post dated draft agreement to pay my entire check toward what we owed which should have caught us up but they refused to accept that.

They told us that we had until Nov.2,2011 to pay just $2458.38 and we could come get the vehicle but then they turned us over to the credit bureau and ruined our credit, calling it a repossession, while over the phone telling us that it would not appear on our credit if we paid the $2458.38 by Nov. 2nd. They have constantly lied to us over and over and  strung us along thinking that everything would be ok, and that was a lie. They refused to answer some of our phone calls or return them.

We feel that we have been wrongfully treated, lied to, harassed and that they are guilty of consumer fraud and should be punished for all of the lies that they have told us. We wish to join a class action suit against them, ASAP. They stole  G.M. Certified Hummer H3 that had only 43,000 miles on it, it was new and they stole it from us. I had paid $8,000. down on the vehicle at the time of purchase.

So sorry for your problems, but NO lender can take any of that into account.  Their concern is keeping the account current.  They cannot accept these reasons for relieving their clients of their obligations.

If they did, anyone could claim hardship and defer of avoid payment.

How could it have been called anything else...it WAS a repossession.

What consumer fraud laws have they broken?  What would be the reasonl for any "class action" lawsuit? Who, potentially, would the other members of this class action lawsuit be?



You DON'T have a case.

Tell me, exactly how they "stole" this "new" Hummer from you?

This "new" Hummer that had 43,000 miles on it?

Without regard to your husband's condition, there are no provisions in the contract of any lender I've seen which will let you skip three months of payments. Secondly, no contract I've seen gives you, me or anybody else a "pass" because someone is sick. It is true they have refused to "work with" you. They have no obligation to do that and nor does any lender, especially subprime. The reason you are being financed by them is you have a credit reputation of not paying your bills on time. They didn't do this to you...you did. Subprime lenders have heard all the excuses and reasons for somebody not living up to the contract. They usually don't believe any of them because they get lied to everyday. Nobody stole your car...it was a repo as per the contract. The amount of $2400+ that you say they want tells me you were a lot more than just one month late as you allege. It certainly is a regretable situation which has come about as the result of your husband's heart attack but subprime lenders don't mess around. That's why it is imperitive to develope a good credit reputation. In the future, if somebody tells you there's some type of agreement to defer payments, get a name and employee number, then have that agreement placed in writing and sent to you...otherwise there is no agreement. And no, I don't work for them.

In summation, you failed to make required payments on time...there are no special provisions in the contract for so-called hardship cases...they began collections efforts...they did a repo. Nothing illegal or unusual here.
