In 2002, after losing my job, I was behind 2 payments on my house. I filed Chapter 13 bankruptcy in order to pay off my debts, I was not running from my bills.

Ameriquest sent a notice of intent to foreclose which forced my bankruptcy. I filed on April 19 of 2002. Ameriquest filed foreclosure papers on both April 11 and 12 with the Travis County. I went to court to my bankruptcy hearing and Ameriquest was the only one of my creditors who showed up. They disagreed with a $300.00 amount. I paid my bills on time, including my mortgate for 40 months.

When I completed my term in 2005, I received a calll from Ameriquest saying I owed them $300.00. I said to send me something to verify it and I'll send them a check. She then told me I owed $5000.00. I said what for and she told me my payment had gone up during the bankrutcy and they could not contact me.

I said baloney as all they had to do was contact my attorney and he would contact my trustee. She said that was not true and my payment was going up from $1300.00 per month to $2200.00 per month! I eneded the conversation quickly as this person had no clue as to what was going on.

I subsequently talked to several people at Ameriquest/AMC and no one could tell me what was going on. I contacted a mortgage broker to refinance my home, which I designed and built myself, overlooking Lake Travis, Texas. He could not do anything for me as I did not own the house. I then found out by one of their daily phone calls to me that they had not paid the taxes on the home, even though I had an escrow account.

I went down to the county tax office where I was told that they had not paid the taxes and the county was filing suit for the back money owed. I also discovered that they had foreclosed on me in April of 2002, did not notify the court, did not rescind the foreclosure and had re affirmed it at least twice during the term of my bankruptcy.

Upon contacting my attorney, ha wanted to charge me $1100.00 up front to file a motion to get them to correct it, which I found out, was his way of being able to cover his over sight. WM Specialty Mortgage was who the property was bought by. The clerk at the tax office showed me several instances of WM Specialty Mortgage purchasing foreclosed properties from Ameriquest. They were the owner listed on my property since they filed the foreclosure in 2002.

Mind you I continued to make payments during my bankruptcy. I contacted the head guy over at (AMC) explaining the situation and requested my money back during my bankruptcy plus fees which amounted to $130,000. He denied any wrong doing and declined my request for compensation. I received a notice of intent to foreclose again, and I asked them how can they foreclose on themselves? They said they were not. I have proof.

AMC also told me my rate was going up to 10.75%, this at a time when rates where dropping! I bought a new home at a very low interest rate and moved. I checked the tax records up until the time of the second foreclosure and the owner was still WM Specialty Mortgage. The person who bought it that day? WM Specialty Mortgage. I have still been sent letters by them after this that my payment is going up to $2200.00.

They took my expensive lakeview property, which is 200 yds from the golf course, and in my opinion, they have stolen it because I cannot afford to fight a huge corporation. They will make a nice profit. I have all documents relating to the above statements.
