I am a disabled Vietnam Vet who took out a mortgage with Ameriquest in January 2002.The loan was prepared at the Wilkes-Barre, Pa. office

The loan person said that after two years come back and we will refi your loan at a lower rate. However, the original appraisal on my house was for $73000. When they appraised it in 2003, they said it was worth $40000. Quite a difference?

Now, they are forcing me into foreclosure on June 23, 2006. I have tried to get a copy of the second appraisal, both in writing and over the telephone. Of course, I haven't received one. I have a piece of paper that states my refi was cancelled due to poor credit, But from talking to the loan person, this was not the case. It was the original inflated appraisal!

I have tried to find a lawyer to help me, but to no avail. I have written to two Senator. I have not heard back form ---( vietnam???) and I get the run around from -----.

I called Donna ---- at Ameriquest and it is all words. We want to help you. We will call you back. Right??

Now with all the goings on with Ameriquest closing their branchesthey could just foreclose on me without a problem. I spent 39 months in the service of my country, yet some guy we saved from World War Two can grow up in America, rape the public and then become an ambassador. Time to leave this wonderful country!!

First off I would like to say that I find it horrible that a site like this can exist without confirmation of its contents. I am Mindy Chinworth and I was a realtor for Coldwell Banker in PA. I did not and have not had anything to do with Ameriquest Mortgage or any of the issues that were reported on this site but yet my personal information has now been put out there for the world to see and my child was the one who found this site by googling me while at school. I worked in real estate for years as an agent and have had many happy and satisfied clients through the years. As in any job that deals with the public you are always going to encounter someone who thinks they have been wronged by you or who are trying to get rich at your expense and at all costs. Those are the people that need to take a good look in the mirror and realize that the only way to get what you want out of life is to make that happen but not as someone else's expense. I have had not only a case of possible mistaken identity on this web site but also defamation of character either by someone who decided to google the name Mindy in the Philly area and come up with my name or by someone who is out to hurt myself and my family. Either way I pity you and your stupidity. Your ignorance is truly a disgrace and I only hope you dont teach your children to be as stupid as you have proven to be. In the future I would ask that before someone replies to a site like this or believes anything that they read from a site such as this one that they consider the source...one that is probably an idiot sitting on the other end of the computer with nothing else to do but try to destroy soemone for their own personal gain!

David you can try to sell the house to your relative but since you are in forclosure and this is a non arms length transaction thelender may limit the LTV to 80%. Another concern would be the value, if you owe more than what the house is worth and you try to sell you will have to pay the remainder of the mortgage balance. The lender will only lend up to the appraised value. One more thing, if you owe 30k more then its worth why do you want to keep it.

Mindy is listed as a realtor associate at the Coldwell Banker Diamond office in Phoenixville PA. Look it up. There is even a picture of her.

Well Mindy, ya gotta be careful about what you write on a public forum. It took me all of about 5 minutes to find out quite a bit of information. I have XXX through your address and your last name.

Based on the comparables and the other info I gleaned but not posting here, I would say that your home there in Gilbertsville, Pa is worth somewhere between the $348,200 shown as average and the $405,000 shown as high. Not quite the value you were stating to others. I also researched for your name in 30 other counties, but maybe I missed your other properties you were alluding to. Don't tell me there in your maiden name, I looked at that too.

Not nearly the $650,000 you claim, eh?

Here is an example of how Miss Mindy didn't read her purchase contract. Excerpted frm a city council meeting in the town. So Mindy, when you were trying to get a pool installed after you purchased your new home, were you mislead by the developer? Or did you just make a "miscalculation"? Maybe you should have had someone read and survey your property prior to your purchase so that you would have room for the pool.

Excerpt:
Mindy XXXXXXX ? Request for approval of variance request to construct a pool in the back yard. Mrs. XXXXXX would need a variance from the rear setback of 30' to install the pool. They were lead to believe that the lot they purchased would allow for the pool and a deck. There was a miscalculation and there is not enough room. Mr. Hiryak feels these kinds of requests are going to become more frequent as the lot sizes are smaller and the house square footage is increased. Mr. Augustine feels the contractor/developer should have to disclose the ordinances in effect at the time of sale so that the prospective buyer will understand the regulations before the sale. This procedure will help the buyer make an informed decision and help curb some of these requests. The Planning Agency has set a precedence in the past regarding the variance for swimming pool installation. The board feels the resident should work within the ordinances that apply to their lot. A motion to not recommend approval of the variance request was made by Mr. Augustine and seconded by Mr. Zern. Motion passed.

So how is that real estate career coming along? I see that 1 listing you have for $319,900 in Douglas is still there.

Seems like there is a lot more "bark" with you that there is bite.

I believe you and I are the only ones checking out what Mindy posts on here. She lies about anything and everything when it suits her purpose.

One posting she claims her home is worth 500K then another it's worth 650K. So I'm thinking it's probably worth about 40K. Plus, anyone who feels the need to brag about how much their home is worth (which we all know isn't valued at what is stated) has very low self esteem and is hoping to achieve acceptance on this site. That won't happen considering she's been caught in way too many lies and has put too many people down. People she knows nothing about but feels the need to comment anyway.

I believe absolutely NOTHING she writes. She thrives on other's misfortune so that tells me she has some really big issues. Could be about her intelligence (we all know how low that is), her looks or maybe even her weight.

Anyway, she rarely responds to my comments. Why? Because she knows she cannot dispute the lies she has been caught in. It would only make her look more like the idiot she actually is.

And, Rex, you really should take a course in shorthand so you can understand the jibber-jabber she writes. If that is shorthand, the A I got in high school for this class must have been wrong because I certainly couldn't understand it either. Should I now say HAHAHA?

I just want to tell you that I believe ALL of my comments - while harsh - are all well intended and pragmatic.

The suggestion that EVERYONE should take responsibility for their decisions and seek objective, professional help when refinancing their home - INSTEAD of going in blind and unknowing - is the most useful advice I could offer.

Mindy has been a little harsh at times, but sometimes people need to quit whining and take some positive action that will "fix" their situation.

She is right about selling the home to a relative. You need to be careful about how the tranasction is constructed with respect to creating a taxable event or changing the tax basis. Any basic real estate attorney will know exactly what to do.

I have helped homeowners that I could not refi for various reasons do this. There are some very important reasons why you might consider doing this. If you can do this before the "Notice of Default" is issued, long before the foreclosure begins, you will not have these on your credit. If you let it get to this stage, you are screwed for 24-36 months depending.

An additional suggestion:
As soon as this sale to sister, brother, etc., records, get your name added to title as an owner. So after 12 months or so when your credit is cleaned up and the "new" 12 months on title gives you "seasoning", you can refinance back into your own name, sister can quit-claim her share of the property over to you, and everybody is happy. Don't forget to give sister a little extra in her Christmas stocking that year.

This technique, and others WILL work, but you must act SOONER than later.

Laura, quit with your bullshit about someone stealing your name. Dave is trying to get help and you are hi-jacking his friggin post. Idiot.

Anyway Dave, sorry to hear about your predicament. I have a practical suggestion, no pie-in-the-sky bullshit dreams. If you follow this advice, you will have your home back, and your credit back, in 12 months. If you choose to tire yourself out with litigation, well, you will lose. Trust me. They are too big.

First, have an independant, objective appraiser do a new report. OR, better yet, ask a realtor to look at it. Tell the Realtor you may consider listing your home for sale.

Ok, now, see what the value is. If you owe just a LITTLE LESS than the home is worth, this idea will work with no problem.

Find a brother or sister or someone that cares about you that has GOOD CREDIT. Sell them your home. If it is a family member, you can avoid transfer tax in some states (I think PA is one of those states). By selling the home, Ameriquest's loan will be satisfied and off your back. Also, since whoever you sold the home to has good credit, the NEW loan will have a good rate and a nice low payment.

Now, you continue to live in your home and YOU YOURSELF send the mortgage payments in with YOUR check. After 12 months of making payments on time, you will have what we call "equitable interest," which means you can refi the home, change the title to reflect your name, or whatever you want.

Please, ask me for advice if need be. I worked for AMQ for 6 months, and Fidelity and Citi for 7 years prior. I am also a licensed Realtor with Caldwell Banker Diamond.

Believe me when I tell you, you MUST take the time now to sell your home, rather than let them take it.

If you DO let them take it, u will hae no one, and I mean NO ONE to blame but Dave.

Do not trust this man. I have been dealing with him the past several months. He said we could work something out regarding my mortgage. Today he calls and says I got goo loan and there is nothing I can help you with and we are going to foreclose.

He also said he found th second appraisal of my home: this is after I have tried to get one for three years. Now he says that I do have equity in my home, more than enough to pay them off. He said he sent me a copy of the appraisal. Can't wait to see this, and check the dates and names on the appraisal!

I am still trying to find a lawyer. I did find an attorney in Pittsburgh who is investigating Ameriquest. But this will be aa class action suit and won't save my house.

Any ideas, anyone??

I have contacted numerous law offices to no avail. It would be easier if I new the individual who leaked my info but the irony is AMC will not release that name because of privacy laws. What bulls***. Did that individual think about my privacy?

As I see AMC is liable for their employees so my contract the one the individual breached should be null and void. Like I said I'm still trying to find an attorney to atleast listen to me. Maybe once I get all my signed docs from AMC and the title company maybe I'll have more to this than just the leak of personal information.

Thank you but requesting a lawyer on here is non existant this website will delete any of that info. I have also contacted the FBI, attorney general, attorney's, Dept of corporations here in Calif. now I am just waiting for a reply from anyone. I need to request a signed copy of my loan docs from AMC because I do not have a copy of them as well as copies from the title company. I will be doing that Tuesday. This is so frustrating that this country still allows this company to exist. You would think with the lawsuites and many more that will come that they would be shut down. I just hope some attorney on here will call me. Like I said I still need to go over my loan docs because all I have right now and obvioulsy it is not enough is the leakage of our personal information. Any other suggestions will be helpful.

Laura, I have had a hard time here in pennsylvania in attempting to find a lawyer. I think that most don't want to, or else they don't know anything about the situation!

Perhaps some of the others on the site such as Ken or David in Michigan could refer us to a lawyer in our respective locales.

I have called the FBI who brushed me off and also the federal prosecutor for the eastern distict of pa.

So, I am keeping on. I must keep fighting. They just try to wear you down.

Do yourself a favor and don't ask anyone on here for legal advice...

Agents "sold" loan information daily to each other. It happened a lot at Ameriquest because others get paid more than what they do on their loans, so the other broker pays the ameriquest agent for the information and they sell the customer non ameriquest terms that may be better than what ameriquest could offer. It is a way employees made money for themselves off of loans that they couldn't do.

And yes, it is highly illegal and yes, you can contact a lawyer, but only if you know the identity of the individual at ameriquest you dealt with as well as the individual who tried to do business with you.

David I am new on here and I am also dealing with Ameriquest also known as AMC I've posted my own report regarding how AMC leaked out my husbands and mine personal information to third party brokers. Included is possibly our social security, phone numbers (which we are now being harrassed by other mortgage companies) and other information. have you obtained an attorney? I am looking for one who will atleast give me the time and day to plead my case. We signed a contract lived up to their terms and conditions and they breached that by allowing an employee to give out sensitive information to people other than AMC Mortgage. Can anyone help me I am starting to study law but I still need help. I live in California and I know I am not the only one this happened to.

I just sent Donna Platt a list of my grievances against Ameriquest.

I do not think she will respond. I told her I wanted her response in WRITING!

Also, last week, she handed my case off to the "famous" Oscar Berga. Guess what? Donna said that he has been temporarily re-assigned. How convenient. More delay and stall!!

These people are just unbelievable!

Can anyone recommend a lawyer to me, either in Pennsylvania or Nationally. I am having a hard time finding one here. I think that they don't understand the situation, or the law or both.

Thanks for your concern and help. I would be glad to help anyone who has been wronged by this company. The thing that gets me most about Ameriquest is the way they to try and stall you. They try to cover up .

When I tried to refinance I had gotten behind in my payments due a head-on-car crash and then a few months later I had to have surgery for melanoma. Th loan person told me no problem, everything is O.K. We just need an appraisal. When that came in low, I received a statement of credit denial. In other words, they hid behind this letter instead of a low appraisal. However, On the same letter is the statement that I have a right to a copy of the appraisal. Naturally, I never got one.

Then, I decided to file chapter 13 since I had been unemployed for six months. Then, I developed a heart problem, no doubt part of which is due to Ameriquest. I had to have the Chapter 13 dismissed. Now I don't have the money to refile for bankruptcy, since the new laws require lawyers to charge more.

Thus I hired a stop foreclosure firm to try to make a deal with Ameriquest. As far lawyers go, no one wants to touch me or this case. I guess that there is not enough money for them.

It's amazing that I have to negotiate with these guys when they don't have to comply with anything. I think that the only thing they will understand is a law suit. Maybe I will have to file one myself.

David, I posted your story on the other website and got some info for you. There are other sites out there, just look up mortgage servicing fraud.
I am hoping that in some way by sharing our story with others we can all help each other. I feel for everyone who has been affected by this company, I myself am a victim. They also told me that after two years I could refi and when I called they said "Oh, sorry, your loan is too much to refinance" And that's funny cause they made it that way...:(

Response:

Unfortunately, you are in one of the most non-consumer protective "States" in the Nation. The Commonwealth of Pennsylvania has a reputation of being an easy place to run scams, rip-offs, and out and out fraudulent corporations. Keep calling for a copy of your re-appraisal - you paid for it, and you are entitled to a copy (by law) - don't let it slide. What about the class action settlement - that may offer you some help. There is one place I can recommend you go to - call PA Banking and ask them to refer you to an appraiser who will do a forensic appraisal for you (If you have problems with this, re-post here and I'll get you the info). Also, you can go to your Recorder of Deeds, and using tax parcel numbers, pull up comparable properties (that means similar sized homes, with similar property, and if in the City of Wilkes Barre, within at least 6 blocks - if you are in a development, they must be in the same development) with sale dates within 3 months of the time you purchased or refinanced. Then, as a Vet, I suggest you contact the VA - they may be able to assist you. If not, get a good attorney (good luck with that in PA, there is maybe one or two in the entire Commonwealth, and before you sign any contract make sure he has never been "disbarred" (lost his license to practice).) Also, make sure you have an up-to-date credit report, and start working on any errors now!
