Both wife and husband owners were fully aware of the scam in their offices of Amistad Real Estate, located on Bird Rd. Miami Florida, had an employee forging documents and signatures to keeping deposits from customers (TO SAVE FACE WITH A FORECLOSURE BANK – THEY DID NOT WANT TO LOSE THE ACCOUNT).  They were knowledgeable that most attorneys were going to charge at least five thousand to take the cases, hence, the would ask for five thousand dollar deposits.

They had a manager in the office put the letter "Z" as my signature for the name Gary Matthews - Nothing like a "Z" I must add.  The realtor in the office stated he would testify on my behalf if I could get an attorney to take the case.  Spending Five thousand to get five thousand does not make a lot of sense, AND THIS IS WHERE THE TWO CROOKS LEVERAGE THEIR POWERS!

I have numerous documents stating "I will never give up my deposit and for them to cancel the contract if the time expired.  They did even greater scams!

Now, the office of Amistad gave me the key to the house I was supposed to buy before the scheduled closing, which was the next door house to the one I was living in at Malibu Bay in Homestead.  I had already moved my furniture and first belongings into the garage when, one day, I walk in the house and there is a German lady on the balcony... excuse me, what are you doing in here - WHAT ARE YOU DOING IN HERE SHE QUESTIONED - THIS IS MY HOUSE, I JUST BOUGHT IT CASH!

I could not believe this.  It's all documented.  They kept my deposit and sold the house out from under me to a higher paying German couple - cash deal!

This husband and wife team are nothing short of Devils in disguise in all manners.

I hope an honest attorney will read this and come to my aid!

Here is what to expect when you have dealings with this company and its' owners. Raphael Cervera Miami, Doral, Pembroke Piine, Cutler Bay, Weston, Hialeah.
Rented a house that should be condemned, ceiling collapsed rain through the roof Raphael Cervera and Patricia Cervera, rotting sewer water flooding the house on 10 occasions, refused to fix it right, stalle months then ast the end charged 1300$ took the deposit and avoided paying until we threatened to sue for it.

This is a complete and accrate account, for that reason this site will stay online and is completly factual in every way.

Raphael and Patricia are very Professional

              I am an employee and Sales Associate at Amistad Real Estate. I have worked for several Real Estate companies and I have had by far the best experience at Amistad Real Estate out of any company I have been with before, and that is largely thanks to Raphael and Patricia Cervera. They are hard-working, fair, professional, ethical, and honorable. Their word has a lot of weight with me because they always deliver on what they say.

              I have never seen them do or say anything unethical, and they have no reason to. Through their dedication, knowledge, expertise, and willingness to serve, they have managed to find success for themselves, and those around them. They have no need to forge a signature to close a deal. I have seen them help so many people find homes and make their dreams come true, who would otherwise not have the opportunity or ability to do it on their own.

              Raphael and Patricia do not discriminate based on a client's income, or any other factor. If a client comes to them for help buying or selling a property, they do everything they can to help them. They deserve respect and admiration for everything they have done for their, clients, community, family, friends, and employees. They do not deserve to be falsely accused.

Liars and crooks - who forged my signature

I could waste more time on these two thiefs, but it would almost be a waste of time, however:

1. I will pay for all him and his wife to take polygraph, I will hold the document that was forged in front of them, and ask them if they know who did it, THEN WE WILL NO THE TRUTH!

Two of thier previous employees told me they would testify against them, this should have some value.  The cost of an attorney to get my five thousand back is a wash out!  I did not waste more money on septic tank types of people.

Don't belive thier "Goody Two Shoe Christian Bologna" either - Two faced liars in my opinion, and others as well.

Fact:

1. Yes it was a forclosure

2. Yes I gave them five thousand dollars

3. Yes I had already moved move my personal items into the garage because they told me it was a done deal.  The house was next door to the house I still own.

4. Yes, they told me that I would have to foreit my deposit and back out, I TOLD THEM I WOULD NEVER FORFEIT MY DEPOSTI AND THE DEAL IS OFF - THEY CAME BACK TO ME AND SAID THE BANK HAD GIVEN ME MORE TIME - I GUESS THEY THOUGHT THEY COULD PULL THE DEAL OFF AND CLOSE - IT DID NOT WORK THANKS TO MY X-WIFE AND MY CREDIT.  THEY, SWEET HUBBY AND WIFE SUPER HONEST CHRISTIAN REALTORS FORGED MY SIGNITURE WITH THE BANK SO, AS THEY TOLD ME LATER, THEY DID NOT WANT TO LOSE THE ACCOUNT - THEY LOST THE ACCOUNT ANYWAY AND THERE WENT MY FIVE THOUSAND DOLLARS - THEY LIED, CHEATED, FORGED, TOOK A CHANCE WITH MY MONEY, AND GUESS WHO LOST IN THE END.

I have all supporting documents and details.  I am not going to FREC and reporting them to the realtor board - I have the documents, I have the witnesses, and I now have the spare to to follow up with these two losers.

They should go to jail for forging federal documentst to tell the truth.  I will also now contact the banking folks and tell them what they were doing pushing loans through illeglly...  Creeps, give me my five thousand dollars back... you are so pretty, famous, and Christian honest... Wolf in Sheeps clothing.  Give me my money back.  I never gave you permission to reaease my escrow money to the bank - you forged my name with a single letter "Z"... I don't look like Zorro... and it does not match the forty of fifty signitures on all my contracts... now does it... Be honest, give me my money back, and we can forgive each other, me for trusting you, and you can forgive yourselves taking my money.

I will pay for the polygraph, as long as a court reporter is there.  And if you fail, you give my cost plus five thousand plus interest... moral?

You should be ashamed... Christians will allo answer for thier deeds.  The path is narrow and many will say, but Lord, but Lord, and He will say I don't even know you!  Beware, the Good Shepard is always watching, this is the way I live my life, and I do beleieve in good honest people, and as well, good honest Christians, you just don't qualify... Let me know what date you want to go and take your test of truth, I am available!

Amistad Real Estate is a great company

 I have worked with Amistad Real Estate several times. They are professional and honest and always make every effort to help their customers get the best service and find the right home. They helped us sell our home and get the best current value possible which later helped us get the home of our dreams. I highly recommend this company and if I ever need their service again, I will call them once again.

I think it estates volumes that after 38 years in the real estate industry, thousands of clients including some of the largest institutions in the business, both private and guvermental, we have never had a complaint with any regulatory organization, we have never been taken to court by anybody. This is the result of always doing the right thing, taking the high road and looking out for the best interests of our clients. Our many clients and employees can attest to this and we will ask some to chime in this discussion. We've been 15 years in the radio with open microphones and NEVER had a negative comment. 

Due to our help some of our clients have been able to retire in confort, some have been able to pay for their clidren's higher education. Whenever we thought that it was not in our client's bestn interest to do something, like when some wanted to go into subprime loans, we told them so and preferred not to do the sale than to get them in an unfavorable purchase.

What did we gain by this man losing his deposit? NOTHING, the bank took his money and we did not get one cent from it.

If anybody doubts my word I invite them to come to my office and I will show you all the documents and emails associated with this file. Truth always prevails over lies.

The story told by Mathews is full of inaccuracies and outright lies, what follows is EXACTLY what happened and we have every documents and every email to prove it.  He is a very ungrateful person! 

He knows very well the bank’s (owner of the property) title company had his escrow deposit. The bank’s asset manager, just got sick and tired of Mathew’s inability to perform, gave him one last chance and Mathews would not take it. 

This man is a very ungrateful person. We went to bat for him on much more than 4 occasions and convinced the asset manager to grant him extension after extension. But after going to 3 different banks/lenders nobody would give him a loan to purchase the home. Furthermore, it was in our best interest that Mathews would purchase the property because he was our buyer and we would make the sale. Ultimately what happened was someone else purchased. After all the time and effort we did not make the buyer sale of this property.

This following is a timeline of what occurred:

05/26/09 Buyer Mathews makes an offer on the property.

06/25/09 Contract finally executed by seller with a closing date of 7/30/09.

Contract had the typical wording of all foreclosed properties which includes “Seller has the right to nullify this agreement at any time”.

Sales price $199,000.   We convinced the bank/Owner to give Mathews $11,700 as a closing cost contribution or he would be unable to purchase.  Mr. Mathews came with a $200,000 FHA prequalification from Approved Mortgage out of Homestead FL.

07/29/09 Approved Mortgage is not ready to close, we obtained first 15 day extension.

08/14/09 Approved Mortgage is not able to close deal.  Mathews then goes to First Financial Mortgage. We get a 2nd extension, (14 days after scheduled closing).

08/29/09 we convince the Asset Manage to grant a third extension, the Asset Manager states “This is getting out of hand and I am about done with this buyer”( 29 days after original scheduled closing).

09/02/09 First Financial Mortgage is not ready to close.  Asset Manager tell the Title Company to terminate the transaction and to retain the buyer’s deposit.

09/09/09 we convince Asset Manager to grant a Fourth Extension. This time the bank/owner requires a $100 per Diem penalty if Mathews goes over the specified time.

09/14/09 Mathews now applies with Bank of America, the 4th lender (45 days after scheduled closing).

09/16/09 Asset Manager wants to close before 10/01/09.  Bank of America says they cannot and that they need more time to process the loan.

09/18/09 Email sent to Mathews you need to sign extension with the Per Diem or the Asset Manager will cancel.  Also he is informed that there are 2 Cash offers as back up offers (this is the 4th extension).

09/18/09 we inform the Asset Manager Mathews has not signed the extension with the per Diem  and are instructed to send Mathews a release.  Mathews refuse to sign (apparently thinking that if he doesn’t sign the bank can’t get another offer) Asset manager instructed us to put the property in the market.

09/18/09 Buyer obtains conditional commitment with conditions from Bank of America, but can’t close before 30 days.

09/25/09 we ask Asset Manager Do you want to take a lower Cash Offer or continue with Mathews, Asset Manager ask if buyer signed extension. Answer is NO.  Asset Manager states, “RELIST immediately, this deal is DEAD”.

09/26/09 Loan officer says to our office “he (Mathews) will sign extension on Monday ” this would be 09/28/09.

09/26/09 we get an offer sent into our office.

09/28/09 we get another offer sent into our office.

09/29/09 we get another offer sent into our office.

10/06/09 Mathews emails us.  “I’ve been told you have an issue with my closing. If you don’t sell to me I’m suing and going to DBPR, Miami Board, and Florida Associating of Realtors.  I have signed an extension (after the Asset Manager Killed the deal).  This extension was never signed by the bank/owner.

10/06/09 Loan officer contacts Title Company as if he was from our company requesting more time.

10/08/09 Mathew’s emails our closing coordinator (after using profanity with her in prior emails) asking for more time.  He is clearly aware that he does not have a contract with the bank/owner.

10/09/09 Cash offer is accepted by Asset Manager.

10/09/09 Mathew’s informs us that his Attorney is looking at the case, as per CC line of Email is Allen Glenn Attorney, William Glenn, sawlaw@.

After going to the Attorney and all the regulatory institution, nothing ever came to us. This is going back now more than 5 years.

Another agent sold and closed the property.

We kept trying to help Mathews to purchase this property and in the end he lost it thinking the bank would have to wait for him if he didn’t sign the release.  In the end his inability to obtain financing is what killed the deal. 

How is it that we stole Mathews deposit when his deposit was never in our possession? Mathew’s original closing date was 07/30/09, it is now October of 2009 more than 2 months past that date and he still did not have a clean approval to purchase the home.  As for his $5,000.00, deposit it was retained by the Banks Title agent and forwarded to the Bank/Owner. We had no say or choice in this matter. This was a direct request from the bank/owner of the property to the title/escrow agent.  

Also let it be is clear, the last loan application to Bank of America was a conventional loan with a 20% down payment, not the original FHA Loan that was that had applied for that only required 3.5% down payment. The lenders at the time (3 in total) did not find Mathews to be a good risk to loan to, even at a lower loan amount.  It was stressed to Mathews on a number of occasions (verbally and via email) that he was in jeopardy of losing his deposit to the Bank/Owner. We had stressed that he sign the last extension requested on 9/18/09 as of 9/28/09 the document had not in fact been signed by Mathews.  What Mathews apparently does not understand is that we were not the ones to cancel or extend his contract, it was the Bank/Owner of this home.    Mathews also makes a claims that we gave him the keys to the home prior to him purchasing.  This is an outright lie on his part.  Neither Raphael nor Patricia gave him the keys or permission to store any personal items in the home. This is clearly trespassing on his part and charges could have been brought on him, which they were not.  Now Mathews claims that the home was sold out from under him when he was given time after time to close and was not able to.  The Bank/Owner has a right to sell the home to whomever they chose, especially after waiting the time they did and giving various opportunities.  They sold to a Cash buyer who offered the Bank/Owner term acceptable to them and closed within the timeframe promised.  

It is understandable the anger and frustration that Mathews felt after losing this home and his deposit, but clearly his anger is pointed at the wrong source.  This is clearly inaccurate in all that is being stated by Mathews and has not shown anything other finger pointing without reason.   At any time we can be reached to show how we did all within our reach to help Mathews close on the home.

We take pride in how we help both our sellers and our buyers.
