Since I had such a terrible time with this insurance company, I was strongly advised by my attorney to attend the ticketed driver's court date to begin my suit with a conviction. The next car to follow was much much to late and an absolutely unvoidable collision ensued. As I sat wrecked, some dork asked me if I was alright and then attempted to begin a dispute as to who was at fault.

He obviously didn't know that you were supposed to call police when there was an accident so I had to tell him to get on his cell phone and call the police. I opted to stay with my car and not persue a trivial argument. I knew that they were at fault, so I'd just wait for the police to come write them their ticket wich they did for Failiure to Yield.

Before the cop left the scene, he told me that he would be issuing "Her" the ticket. I was surprised to learn that there was a female at the wheel because at no time, was I approached with any remorse what so ever. So back to the court room. The whole thing had to go to trial, and I wasted an entire afternoon waiting. On the police report and the statement from apollo, which I submitted, there were two conflicting stories (in writing!) as to what color the stupid traffic signal was.

These two got up there and lied gloriously and profoundly to the Judge, the States Attorney, The People of the State of Illinois. She hung herself with her own story when she exclaimed to the judge that I was 200 yards away so therefore, could have stopped on time.

When the judge did the math, the equasion came up incorrect. In other words, if I had been that far away, she could have made the turn and been half way up the street before I even entered the intersection. Then she got to ask the cop some questions, one of which was "Aren't the cars supposed to yield when people are making turns?" I caught the eye of one of the bailiffs and she just rolled her eyes. I did, too. Oh, yeah!

We just stop traffic all the time to yeild to people who are making turns. Stupidity or a parlor game? You decide. I sure can't. So after the story about the "red light", the court also had to say that if I had blown a red light, wich I had not, that would mean that she had blown it too. Go figure!

When her "witness" (passenger) got up he reinterated her whole story without shame and then let the sentence slip out-"We never even saw the car coming." If they never saw the car coming, how do you produce a story? Finally, the ticketed driver made it a point to notify her insurance company that I was speeding when the accident occured.

To that I have to say, If she was so busy nonitoring my speed, that would mean that she'd have been looking to her right as she made the left turn. When I turn left, I look to the left so I can see where I'm going. So do most intelligent people.

In my home State, Pennsylvania, we have no fault laws. I have had experiences where the other driver lied. It didn't matter. The claims were paid.

You should file the claim with your insurance company and let them go after the other guy.

Today I recieved mail from the Illinois Division of Insurance with apollo's response to my complaint. Now the story is that thier insured told them that the light was yellow and turned red and that I suddenly sped up and smashed the stupid car. I will be contacting my own insurance company for advice as well as my attourney because I will be persuing this to the fullest extent of the law. In my opinion, this insuance company is the absolute bottom of the pile. I will probobly have to sue the driver to small claims court, then if she knows anything about the way that this operates, she would be advised to sue Apollo, because unfortunately, this is the way it's going to have to go.
