Ashton Woods Homes Ashton Woods Refused to do VA Loan and not refunding deposits for 4 - 6 weeks Pearland, Texas

We entered into contract with Ashton Woods for a new home and selected structural upgrades that are standard options.

We spent 2 days at the design center with them and selected the interior upgrades we wanted and then paid for them at that time in full.

We had informed them during both processes that we were working with the lender for a VA secured loan and they pointed out the VA/FHA clause that stated if the appraisal price didn't meet the cost of the home we could back out of the contract at no cost.

We had no intention of doing this in fact we were putting over 20% down to ensure a lower payment.

Ashton Woods sent a request to waive the VA/FHA portion of the contract and would only grant the base price which was 80K less than the structural price as a guarantee.

We refused and they canceled the contract.

Now we are told that the 51K that we put down will not be refunded for 4 - 6 weeks which prevents us from moving forward with another purchase.
