My son went to Ballys thinking he wanted to try the free 2 week membership. He had just turned 19. They whirlwinded him with sales pitches, took advantage of him and got him to sign a contract. But he didn't have any money to put down a payment on it, so they told him that they would hold on to it until he had money to put down on it. He never did, and told them when they called that he didn't want it. They process the contract anyways, and with out a payment.

He never even got a chance to use the facilities he went there for in the first place. And we have had Asset Acceptance calling and I told them what happened, and they didn't care. I told them that what they were doing was wrong. Taking advantage of younger adults like this to make a living. Now they dropped off some papers to me last week for small claims court. How can something like this go on for 3+ yrs? Can anything be done about this?

Any advice would help, I called an attorney and was told that an attorney can not be involved in small claims court. The amount is about $1,5000. Not that we can afford an attorney anyways. But it was awfully nice of them to give me the information that they did.

I don't know what else to do to help him except to go into small claims court with our story, and print out common stories(if there are any) from online and bring them to court with us. Is there anyway these people can be stopped? Court is in about 24 days. Thank You

This is unfortunate and was very exploitative on the part of the salesperson (no doubt trying to meet his/her sales quota or be fired)....

However, your son was of legal age and he did sign a contract and there's no way around this. This is a lesson learned the hard way....Just be glad it wasn't for something more expensive like a new car.
