I need some help. Assett Acceptance is at it again. I sent a letter to them to prove my debt that was 30 days ago. They are still reporting it as a bad debt to 2 of the 3 CRA's.

Trans Union removed it because they couldn't verify. The other 2 say there are getting verifictions???? This debt is from 1997 and was obviously sold to Assett. What are my options? Once a debt is sold can the original creditor still continue to report the debt as bad? This is why the debt is showing up twice on my credit report... Advice anyone?

Thanks for the advice to everyone, the 2nd letters to Asset will be sent on Monday.
Trans Union seems to be the best at getting rid of junk on your credit report. Does anyone see the same thing? Equifax and Experian are saying they have verified the info but the info hasn't even been verified to me, there lazy and its starting to upset me. I have not had any problems with Trans union doing there job.

I have asked experian and equifax for the contacts of there verification but nothing, this has been going on for over a year now.

Tom,

The original creditor MUST state on your credit file the actual status of the debt, ie:

charged off, sold. etc..

The buyer of the debt MUST list the original creditor.

Equifax and Experian are getting very lazy, and/or cutting costs on verifications.

Under the FCRA you have a right to obtain a copy of any such verification, including all correspondence and names of contacts.

They are overwhelmed with disputes and only verify properly after being sued.

I am going this route with them right now.

Experian and Equifax are perpetrating consumer fraud. After all, the creditor pays them big bucks to use the service.

Keep in mind that the reporting arrangement is between the creditor and the credit bureau, not between you and the credit bureau. It is a total fraud.

They want to make all of the money, and make us do all of the work!

Write To Them Again!

Send them a second letter demanding validation of the debt (I guarantee you they can't provide proper validation) and send cc's to the CRAs who are not removing the item from your credit reports. If they can't provide you with validation of the debt, they can't provide the CRAs with validation. Make sure you send everything certified mail, return receipt requested. If they continue to refuse to validate debt, you may be forced to sue them.
