Thank you for taking the time to read this letter,

Last Monday afternoon i was in a car accident, went to the doctor and was given pain killers. I took Tuesday off of work and was doped up on my couch relaxing when i recieved a call from an unknown area code. I would usually let this go to voicemail, but assuming it had something to due with my insurance claim I answered the phone. A gentleman speaking broken English english asked for me, I confirmed my name, asked my addres, I gave him my current mailing addres, then he said he was from Asset Acceptance and began to "hound" me for a little over $8,000. As soon as i realized who he was, I told him he had my current mailing addres and all correspondance needed to be done through the mail. Today I recieved two letters in the mail demanding payment. One for the the $8000 debt, something that originally defaulted in the summer of 2000 and has since been removed from my credit report (as of this morning, but I know it can be relisted). The second was from a credit card that defaulted the same summer, the original lender FNANB has been removed from my report, but the listing from "AA" still appears with no opening date, but a balance date of 10/2007. What, if any, options do i have. Any help is greatly appreciated as I am now temporarily out of work.

HI,
Hope I can be of some help on your problem with asset acceptance. Like the other person said, the statue of limitations has expired and they cannot legally collect on that account for the $8,000. Do a internet search for "Statue of Limitations for credit card accounts" and you should pull up some listings that will help you. And do a search for "Fair Debt Collection Practices Act" that should also point you to getting the Statue of Limitations for all the different States.

Like the other person posted, do not make any payments to Asset Acceptance as that will start up the Statue of Limitations all over and they can legally try and collect on that account. And do all communications with them by Registered Mail with Return Receipt so you have proof of contacting them just incase you would need proof in the future.

File a complaint with the Federal Trade Commission, you can get info by doing search for them on internet. The more people that file complaints on Asset Acceptance then maybe the Federal Trade Commission will close Asset Acceptance down for good. And also file complaint with Better Business Burea and also your State Attorney Generals office. The more complaints filed the better chance of getting Asset Acceptance shut down.

And yes keep no the Credit Bureaus to that off your credit report.

And do not give in to Asset Acceptance, no matter how much they threaten you. And do not do anything over the phone with them, get it all in writing.

hi i have had dealing with this company the only thing that stopped alll calling was filing a police report and going to small calims court. they said i owed 7734.56 on a fraudulent crecit card opened back in 2003 over the internet using my info. it finally stopped but in my opinion these folks need to be stopped.

FIRST, Do not allow yourself to be bullied by these people into making any payment. Don't let them use scare tactics like: We'll send the sheriff to your house tomorrow if you don't make a payment...They can't do that to you.

This debt is outside of the statue of limitations, which means that they cannot take legal action against you. They can still try to collect the debt, but their options are limited to just annoying you with phone calls.

Send them a "cease communications" letter (do google search) via Registered Mail with Return Receipt. Per federal law they must stop contacting you.

Again, DO NOT make ANY payment on this debt...if you do it will re-start the statue of limitations, which would enable them to sue you.

They cannot re-age old charge off accounts....It sounds like they did this. Send a letter to all 3 credit bureaus stating that this is a re-aged charge-off that needs to be deleted from your credit file.

DO NOT speak with these people over the phone...nothing good can come from it...KEEP ALL COMMUNICATIONS IN WRITING
