Yep, I am having problems with Asset Acceptance too. Four years ago, they started crap with me, so I asked for a debt validation. After 30 days, I heard nothing and nothing appeared on my credit report, so I figured they found they had made a mistake. Fast forward...here they are AGAIN, wanting money for what they say is an old credit card debt(??) They claim it is for a credit card that had a $2000 limit, yet here they are, asking for $5700, so, once again, I asked for the debt to be validated.

Guess what, they ignored my CERTIFIED letter to have the debt validated and filed suit anyway!!! I called the court and sent them a copy of the letter I sent to Asset Acceptance, clearly showing that they filed suit BEFORE they validated the debt and showing that they had my debt validation letter IN THEIR HANDS, but filed suit anyway. And, to make things even worse, the day after they filed suit against me, they sent me a letter saying that they were going to make me an offer to settle for 50% less than what they say I owe (another thing the court was MOST interested in.)

Really, the left hand doesn't know what the right does in this company. Are they suing me for $5700, or will 50% of that amount 'take care of ' things? And how can they sue me when I really don't think this is my debt? So now, lets see if they can validate the debt.

I asked them to provide me with a complete credit history associated with this account, as well as dated of credit increases as well as a complete payment history (which, I am told, they MUST be able to do) and an explanation as to how they arrived at the amount they claim I owe.

I am tired of dealing with these nuts, they have a horrible reputation and seem to be borderline unethical. If they intend to sue someone, they should have all the facts and figures ready and verified BEFORE they waste anyones time. And when they cannot verify this debt in a timely way--we, as consumers need to be able to put this to rest once and for all--not allow them to come after us AGAIN years later.

Asset Acceptance Corp.(AAC) is now a publicly traded company. (Nasdaq: AACC)

They purchases old portfolio's of mostly worthless charged-off accounts for pennies on the dollar. Once owned, they inflate the value of the portfolio, send out dunning notices and try to collect at a ridiculous profit.

Don't be surprised if you notice the date of last activity on your credit report, as stated by AAC is WRONG! Deliberately changing the date of last activity is a way to scam consumers into thinking they are entitled to money they would not legally be allowed to collect.

This is standard procedure for them -- from "re-aging" the debt on the credit history, to suing on what is probably a statute of limitations claim, to reneging on a written promise. These liars, thieves and snake-oil salesmen are trying ALL the con's known, to grease their pockets with your money.

Watch out too for the mystery $50-$75 payment that is claimed to have been revived on the account. When pressed, they claim to do an investigation and "discover" that they made a "clerical error" and mistakenly posted someone else's payment to your account. (LIARS!)

NOTHING this 'House of Cons' does should be believed or taken at face value. They have proven over and over they are liars and thieves!

Under federal law, the Fair Credit Reporting Act (FCRA) an account may ONLY stay on a credit report for seven years. One of the cons being used by Asset Acceptance is to claim you made a $50 payment, which would have re-started that clock. Unfortunately this is a 'bogus-claim' by AAC, is illegal and violates your rights.

Asset Acceptance Corp has earned the distinction of one of "AMERICA'S WORST COLLECTION AGENCY'S". They lie, steal, cheat, misrepresent, file bogus claims, create phony documents and commit perjury in the court system JUST to increase their bottom line. Courtesy of>>budhibbs.com.

I hope this helps you better understand who you are dealing with.

These people NEVER respond to debt validation requests with the info requested.

You should sue them for FDCPA violations after filing multiple FTC complaints on them.

Things just keep getting more interesting.... I sent a certified letter to Asset Acceptance asking to validate this debt. It took them over 10 days to sign for the letter (no, I did not send it to the PO Box) I received the validation letter, and it contains NONE of the information I requested. It simply says my name, the original creditor, and the amount they want me to pay. They ignored my request for proof of credit history, they ignored my request to show how they arrived at the amount they say I owe.

They ignored my request to show they have a right to collect the debt. They ignored my request for proof that they are licenced to collect in my state as well as a request for thier licencing information. The info in the validation letter is nothing more than the info ANYONE could come up with. Oh yes, and also, the day the debt validation letter arrived, there was also ANOTHER letter saying that I can settle for 50% of the balance of what they say I owe. Now...are they suing me..yes, we have a court date. So why do they continue to send me settlement letters??? I understand that they MUST provide a complete payment history (case fields vs wilbur USCA-02-c-0072) Once again, I think they are after the wrong person as this had never appeared on any of the 3 credit reporting agnecies files and it seems they can't come up with concrete information.

Do your research to determine if the Statute of Limitations has expired on this debt. The SOL does not prevent them from trying to collect, however, it does prevent them from winning a lawsuit if you assert it as an affirmative defense in your reply to the court.

If you have not already dones so, file a response to the suit with the court ASAP. In most jurisdictions you have 30 days to file a response, if you do not do so they can win a default judgement. In your response, also file a counter complaint against them for violations of the FDCPA. Additionally you can compel "discovery" in which you demand they provide you with all the documentation you were seeking before. It is likely the court will order them to provide this documentation. In the best scenario they will not have it available, be unable to comply and things will go in your favor.

Don't ignore this, if they win a default you may find your wages or bank account garnished.

Keep in mind, even if you win the lawsuit there is a high likelyhood they will simply sell the debt to another collector in the future. The SOL prevents them winning the lawsuit, but nothing prevents collection attempts indefinitely.
