Athas Capital Group took money from client for work that was never done and is refusing to refund it back Agoura Hills California

I submitted two new loans to this company by the name Athas Capital Group because I heard they had a stated income product.  When I submitted the loans to them I was told I had to use their AMC Company (Appraisal Management Company) to order the appraisals, so I did.  The AMC company requires the client to pay for the appraisal and the clients credit card is taken down , but no charged until the appraisals are ready to be completed. 

The client decided not to proceed with the refinance and wanted me to stop everything, I said no problem and turned down the file.  A day later I get a call from an angry client saying why did Athas charge $900.00 on his card.  I said I have NO idea, but I'll find out.  I contacted my Rep with Athas Brandon Rodriguez and asked him why they charged the client's credit card when the cleint cancelled the loan and the appraisals were never done, his response was that's our policy. 

I said you guys can't charge a client for something that was never completed, he said he would look into it and conatct me back.  A short while later I get an email from a Todd Kaplan the National Sales Manager with Athas saying he isn't refunding the client back the appraisal money because the client signed a paper saying NO REFUNDS.  I replyed back that the appraisals were never done, the loan was cancelled before the appraisals were scheduled.  He didn't respond after that.

Lets take a long look at this.  You have a Rep.(Brandon Rodriguez) who charged a clients credit card AFTER the client cancelled the loan. You have a National Sales Manager (Todd Kaplan) who flat out states he's not refunding the client back the appraisal money that Athas Capital Group charged the client for appraisals their company never did. 

The loan was cancelled by the client before the appraisals were even scheduled to be completed, how can you jusify STEALING this clients money?

 Although I find it interesting that you, COURTNEY CHAMBERLIN, would take the time to actually write this up, it does not surprise me. Even after you and your company INFINITY LENDING GROUP  have agreed to refund them personally for the appraisal fees. Why would you do that? Let me tell you why:


 In fact, per a converstation with the borrower you refunded your borrower $900 to keep this under wraps yesterday afternoon. (7-29-2014)

 Let me recap the transaction in a nutshell and provide, you the reader, with an actual portrayal of the scenario at hand and what led up to this post.

 At Athas Capital we leave no margin for error in our processing of files. When our company issues a Conditional Loan Approval we make every possible assurance that our clients are aware of our process. Once an approval is executed, signed by the client, and delivered back our process begins. Along with our conditional loan approval is a credit card authorization to perform an appraisal by an outside service. There are 3 big bold black bullet points above the clients signature. They read:


1. I understand that by providing this information I hereby authorize Pacific Appraisers to debit my credit card and authorize appraisal services at the property stated above.

2.  Pacific Appraiser’s policy to not issue refunds. Before authorizing this transaction, please make sure you read and understand all documents.  

3. There will be no refunds issued for cancelled orders even if the appraisal has not been completed.

 Our approval and appraisal authorization came back to us dated on 7-25-14 and subsequently the appraisal had been ordered and initial disclosures went out. However, there was one MAJOR issue.

 Their borrower was not made aware of our loan, it’s terms, cost, absolutely nothing. Again the borrower never even signed our approval.

 It wasn’t until the broker on the file Chris Voss was contacted by their client asking about disclosures that were mailed to the borrowers home as well as the charge to his debit card.

 Now why would INFINITY LENDING GROUP slander and defame our company when they were in the wrong and provided us the lender with forged documents? Your guess is as good as ours. Some never learn that forgery and slander do not get you far.
