On March 7th, 2003 I bought a cell phone and calling plan from ATT over their Web site. Even though I provided my Zip Code and physical location, they sent me a "GSM" mobile phone and "GSM" calling plan that will not work properly where I live.

I thought I had bought a digital phone, but that was not true. I complained immediately to ATT that the signal was weak, so they sent me a replacement phone, and charged me $9.99 for shipping and handling. This phone also did not work well. Sometimes the phone works; other times it does not work at all; mostly, it just works poorly.

Finally, after 4 and 1/2 months, an ATT rep told me that I have the wrong phone, and that in my area I should have a "digital" phone. I talked to 3 ATT reps over the phone and 2 more ATT technicians at local ATT retail stores, and they all said I should have a digital phone, or a phone that is both digital and GSM. I was also told that the GSM system works very well in Europe, but, sadly, I happen to live in Southern California and don't plan on moving to Europe in the foreseeable future.

One ATT rep advised me to buy 1 of 2 phones that might work better, although she would not guarantee that it would work completely. She said that there should be some improvement. I would have to buy either a Seimens phone or an Ericsson phone, at $99.99 or $149.00, plus shipping and 8.25% sales tax, in order to see if I would experience any improvement.

In the meantime, I talked with many other people who live in my area, and many stores that sell cell phones and calling plans here, and they all said that ATT phones and plans do not work very well here because of the valleys and mountains, and because ATT does not have enough transmission equipment and facilities in this area. I think that ATT should not have sold me this phone and plan, knowing where I live and that the phone and plan will not work well here. ATT is the expert in these matters, and not me.

Now, the ATT reps tell me that I am stuck with this plan for two years, or else that I have to pay a $175 "early termination Fee" to get out of it. I don't think this is fair. This goes against Public Policy and also violates California's law of the Implied Warranty of Merchantability, which states that a product should be suited for the purpose for which it is intended.

This phone and calling plan are not useful. The ATT rep said that I have "30-days" to cancel, but that is not fair or adaqate to test the system. They should have known that they were selling me a worthless system and have indicated that, or suggested something else, or a different company.

I am not paying the $175 and I feel that I am justified. This is just tyranny and am abuse of power.

My response to ATT

As I first explained, about a year ago, I gave ATT my ZIP code when I ordered the mobile phone and service. They sent me a phone and a service package that did not work in the area (i.e., the ZIP code) where I live. ATT admitted that to me. The product did not do what it was supposed to do, and that violates California's law of "Implied Warranty of Merchantability." The $175 early termination fee, for a product and service that do not work also violates Public Policy. In other words, it is a bogus charge. Furthermore, when I first complained of poor service to ATT, they told me the problem was a defective mobile phone. It took more than 30-days to finally figure out that the problem was not a defective mobile phone, or anything else except that ATT did not have enough equipment, towers, etc., installed in the San Fernando Valley to properly service the phone and the phone service that they had sold to me to use in the San Fernando Valley. I have filed charges against ATT with the FTC, Consumers Reports, the California State Attorney General and here, at the Rip-off Report. I also filed a statment with the two collection agencies that ATT employed to try and collect the charges they say I owe them. Both of those collection agencies stopped contacting me after I sent them letters explaining my case. I now have a Verizon mobile phone which works excellently in the San Fernando Valley because Verizon has adaquate equipment and facilities here to support mobile phone service. My wife is a Realtor here, and all 18 of the other Realtors in her office have Verizon mobile phones; none of them has ATT mobile phones. A few tried ATT, but when they didn't work, they changed to Verizon, which is one of the few services that will work properly here. No one should be required to pay for something that doesn't work. That's simply common sense, as well as the law.

Let me begin by stating that I am a customer service representative for AWS, regardless of the posted address.

http://www.attws.com/ has a large variety of phones. All phone descriptions will state which technology they will operate on. This information is provided to try and reduce misunderstanding between GSM and TDMA (Digital)

The GSM network within the US has advanced greatly since it's launch. Espcially since the agreement between AWS/Cingular/T-Mobile which grnts our customers access to parts of other companies networks to improve the advanced coverage already supported by AWS. Therefore, there would be no reason for you to move to Europe simply to use a GSM phone. The coverage is getting better, but nothing new, can start great.

The ATTWS.com website is open to everyone, and there would be no reason to restrict access to one area simply because the coverage is not the same as in other areas. Our customer service is available to your 7 days a week to answer any inquiries regarding coverage and many other issues.

The product is not manufactured by AT&T Wireless, it would be manufactured by companies such as Motorola, Nokia, Samsung, etc. The product IS suited for the purpose in which it is intended. However, AWS cannot gurantee coverage in any area. This information is clearly stated within the Terms and Conditions stated on the attws.com website, or, for easier use, you may simply cut and paste this address:

A process called "Reverse Migration" may be best for you if it has not yet been completed. You can purchase a TDMA (Digital) phone and change your service technology to TDMA. Of course, rate plans and prices are subject to change, but that can be explained in more detail by contacting GSM Customer Care at 1-866-293-4638 or 611 from your Wirelss Device.

As far as the $175.00 Early Termination Fee (ETF) is concerned, the main issues are also address in the Terms & Conditions link provided. Service is NOT guaranteed in all areas. These Terms of Service were agreed to the moment you signed your contract. Failure to complete a signed contract will result in an ETF being charged as per your agreement with AWS.

30-days not long enough to determine if a mobile phone works

Thirty (30) days are not long enough to determine if a mobile phone works because sometimes my GSM phone worked fine; other times it partly worked; and yet other times it did not work at all. When I reported this to AT&T, they said it was a "defective phone" and they sent me another phone. When it still worked poorly, I reasonably believed the problem was probably with the phones I was calling, or with other other mobile service providers. How could I know, in 30-days, that it was my phone causing all the problems? It took about 3-months for me to determine that ATT phones, generally, don't work very well in my area. But, ATT knew this, and they should have told me that from the beginning. I found out, finally, when I talked to several ATT reps over the phone, and two ATT technical people at ATT retail stores. I also talked with people who have mobile phones in this area, and none of them have ATT phones because ATT phones don't work well in this area. ATT is the "expert" on their own phones and they are responsible for informing consumers whether or not their phone service will work in that consumer's area. Whether the phone is analog, digital, GSM, or any combination of these, ATT itself has told me that they simply don't have enough transmission equipment, towers, or whatever, in the area where I live, and this is the reason that ATT service is poor here.

ATT seperates GSM and Digital

In order to keep things simple, ATT calls there TDMA digital. The poster does know what theyre talking about, and as an ATT dealer, her problem is not uncommon. I have probably seen it a hundred times since ATT launched GSM last October. But in ATT's defense, the 30 day trial period is one of the longest in the industry, and is plenty long enough to figure out if you get reception in your area. If you do chose between the Siemens S46 and the Ericsson, go with the Siemens, its a much better phone.

you said you need a "digital phone" in order for the service to work well in ur area. But little do you know that GSM phones are PURELY digital. There is not one speck of analog in them. So to sum it all up... YOU DUNNO WHAT UR TALKIN 'BOUT!!!!
