The Attorney General's office contacted Dr. Jeffery Rempala about refunding my money for inferior dental work.

Dr. Rempala replied in a letter stating he is more than willing to refund my money.

The Attorney General's office can't get him to actually refund my money. Since they can't get him to pay me back they've decided no furter action is appropriate.

He told the Attorney General's office he would pay me back, he then refuses to pay me back & the Attorney General's office can't do anything about it????

What purpose is the Attorney General's offic serving if they have no power?

I say we kick them all out & close the office down. My taxes are better spent on something worthwhile.

No Cancelled Checks

Thank you Chris, your post would be helpful if I had paid using checks. I'll your advice in mind in the future if I go to small claims court.

But in this case, I obtained a Capitol One Healthcare Finance loan. Early on I contacted Capitol One to discuss a dispute & possible refund. Apparently, Capitol One Healthcare Finance loans aren't like credit cards where you can have disputes mediated & get refunds.

Capitol One told me all the could do was call the dentist & ask him to refund my money. They did & he said "No".

Last week I contacted the Better Business Bureau. They don't get involved in dental, medical or legal situations but they do get involved in customer service situations.

Since Dr. Rempala wrote in a letter to the Attorney General's office stating that he would be more than happy to refund my money, but hasn't done so, it's now a customer service issue. So, we'll see what happens with that.

One way to enforce a small claims judgement is to levy the bank account from which you made your original payment. If you have a cancelled check that you gave this person, the account info will be there. If you have the judgement and a levy order, the bank will comply.

Dental Board Complaint

Yes, I filed a dental board complaint. However the Missouri Dental Board is a regulating agency only. They can't get my money back. The only thing they can do is revolk Dr. Rempala's license or discipline him in other ways if they find he's violated their statutes. They won't consider any other aspects such as his lies or lack of concern for my health & welfare. It takes up to a year for them to investigate complaints as they only meet 4 times a year. Hopefully, they will find some vilolations & discipline Dr. Rempala. I'd prefer to have a refund but since he's unwilling to make good on his word, I'll take what I can get.

Small Claims has it's own problems

#1. Small claims court damages are limited to $5,000.00 or less. I paid Dr. Rempala $6,000.00

#2. If I won against Dr. Rempala, I'd have to collect the judgement myself. I've been through small claims in the past.It's impossible to collect a judgement unless the defendents employer or the officials where he banks agree to help.

#3. Dr. Rempala is self-employed and the officials at his bank are more likely to side with him. Even if they did agree to help I'd nee his account number which I'm sure he's not going to give me.

Small claims is a bigger waste of time & money than the Attorney Genaral's office.

You should take Dr. Rempala to small claims court to get your money back.
