We purchased a new (older model, manual transmission) Kia Spectra from Banner Kia. While waiting to sign the closing papers (we have copies of all closing documents, signed by both parties), we visited the service area, and was told that if we ever change our own oil (which I sometimes do), that this could void the new car warranty!

When doing the final task, the next morning (delivering the check for the signed deal), I expressed my displeasure with what I was told, as far as servicing this vehicle. Later that day, the sales manager called me, without warning, and said they "cancelled the sale".

After thinking about it, we (on our end, anyway) had never decided that we wanted out of the deal, and we had the signed deal that had already been done, that we wanted to honor. So, I went back, to get the car, but the sales manager told me the "window of opportunity" for me had passed!

Is a signed contract, by both parties, a "window of opportunity"? Lets say I wanted out of a signed contract, would they let me out, because I didn't want the "opportunity" any more?

I do learn things most days. am I missing something, here? Is this type of stuff allowed, and legal? For most of the sale, I really was a big fan of this dealership - from what we found out, before we went there, they had a good reputation in our community, and this abrupt change of behavior really shocked our family!

So, we have all of these signed agreements, and they have a check of ours (that was not cashed) - we feel they need to deliver the car we signed for, and apologize for all of this delay at the end, or give us a real explanation of how they can cancel-off everyone's signatures.

"Clarification" of the "why", from the dealer....

Because we offered an honest observation of something we noticed at the dealer, and happened to mention some possible "do it yourself" work on the vehicle, they chose to break the deal, and get us complaining now, instead of "taking the risk" that we could possibly complain, some day, about something, down the road! It was really amazing, to us, they were willing to break a signed deal, and not cash a big (cash) check, because of a "possible" survey, somewhere in the future! The only thing I agree with them on is that we WOULD fill out a survey accurately.... when things don't seem right, I comment on them - it is the years of "customer service" training..... and, as you read above, I also comment on GOOD customer service (which they had, for a majority of the time we spent, with them). It was also lousy that they have that signed deal, still in their possession, and our signed check - and they don't have to return it, and that they can just act like their signatures on all of those documents never happened.

We, like our friends, love to read the Rip-Off report, but WE missed this "mistake", that we made! They were willing to give up a lot of time/ negotiations, and a sale, because of the chance of a possible lower "score" from one of their departments! Apparently, from a worker from a dealer we have previously purchased from, this is not only a problem for this dealer, but is an "industry-wide" problem. The corporate people are unreasonably pressuring these dealers, on these survey results.

It is a shame that those surveys have them (the sales managers) so paranoid that they cannot even accept any honest criticism of the dealership (that was not even going to change any outcome), and it makes them come after the customer. Of course, this can be avoided if you or I purchase "used" (where you can tell the seller what is on your mind). I was also told that buying "used", even at a dealer, is not as "pressured", as far as surveys go.....

Yes, we were treated very poorly, and not delivered the car we purchased (even KIA, and other departments of the SAME dealership, are calling us, asking us how we like our new car- after all, the transaction was completely finished), but "God don't like ugly", and I am sorry I entered this complaint, regardless of how right it is. They obviously wanted to keep the car, for some reason - I'll never really know why. Hopefully, they will never do that, to any other buyer, ever again. We liked the car, and wanted it (we signed all the papers), but there are plenty others, out there!
