I brought my 2007 Mazda in for an oil change on Nov. 15. Four hours later my car died on the turnpike. We towed it to Pepboys. When we came home there was a great deal of oil in our garage. where our car usually stood.

We had it then towed it to the dealer on Mon. The dealer stated it was the oil change , or lack of oil, that caused our engine to seize. We had to replace the engine on a car that had 20,000 miles. Pep boys refuses to acknowledge fault. We are going to try to file a garage keepers liability claim.

As an EX employee I will give you some insider information.

1. Pep Boys relies heavily on good BBB ratings. File a report with the BBB. It will increase your chances of Pep Boys accepting liability.
2. DONT WAIT TO EXPRESS YOUR RIGHTS. Pepboys will use time in their favor, especially if it goes to court. Keep calling them, keep being a pain in there butt, and document EVERYTHING. Record the names of everyone you talk to, and write down the exact times, dates, and what was said.
3. Take them to court if they dont accept fault. Many times the corporate lawyers will just decide to settle out of court. If they feel they have a weak case they will settle with you rather than face the exposure. My shop settled out of court in 7 of 10 cases.
4. GET DOCUMENTATION FROM ANOTHER SHOP!!! Make sure that the dealer documents what they found and you have copies of it. If they found the drain plug loose, or the oil filter loose, make sure it is documented by them, and bring that paperwork to court with you. Make sure it is dated, and carries the dealership header on it.
5. You will not get anywhere fighting with the Pep Boys Service manager. He has no power in settling with you and he will fight you all the way on it. The settlement will effect his bonus. You need to talk to the Area Director, and you need to be direct. Tell him that you have the documentation from the other shop. Tell him that it happened the same day that Pep Boys changed your oil. Tell him you are reporting Pep Boys to the BBB, and tell him you plan to goto court if pepboys does not pay to have your motor replaced or rebuilt.
6. Pep Boys is not required to pay for a brand new engine. They are however required to pay for an engine that has equal miles on it, be it used, or rebuilt. The law states that you are to be "Made Whole". Being made whole means to return your car to the state it was in before the negligence occurred. It does not mean being made better than whole, which would be the case if they paid to put a new motor with 0 miles on it in your car. I know this because I have been to court on similar issues many many times in the Auto Field to represent various companies. Just a heads up.

when you allegedly had oil on your garage floor did you not go immediately back to Pepboys? How long after this oil change did this mystery oil allegedly appear on your garage floor?

Ok so PBY changed your oil at the Hazlet location and you broke down on the Turnpike. How many miles did you put on the oil change ? How many days later did you break down ? Also in your post you should include that the Turnpike is approx 15 miles from the store. And that is if you went directly to the Turnpike. So if it is PBY's fault it should have happned alot sooner then 15 HIGHWAY miles later.......Just some food for thought !!!

This is a common occurrance, it usually happens when the technician Double Gaskets the oil filter (not checking when removing the old oil filter if the gasket came off with it). This will cause the oil to drain out very fast causing an "OIL OUT" in which case you should call 1-800-PEPBOYS (corporate office) and complain.

In our store alone we have replaced several engines with new ones due too this problem, as well the technicians who caused it were terminated. But our store is far from the average.
