I used to work for this horrible company, the manager Chris and assistant manager Damien always IM employees and cursed them out saying they were worthless.  They started me out at $10.00/hr than dropped the pay to $8.00/hr, they taxed any bonuses given (which was very small) it was a slap in the face plus taxed any other pay given on top of the federal taxes which is legal but not bonuses or other pay, they never payed me OT which is about $1,000.00 worth. 

I am currently suing this company because of failure to pay my overtime, the whistle blower's act, they hired Damien, right off the street (which they said the promote within) what a joke!!!  Anyway the problem is that Damien is a convicted child molester which they knew, they hid it from us.  When I found out I went to Human Resources and was shortly fired, their excuse was my leads were kicked back, I was there 6 months none of my leads were kicked back. 

You had to get over 107 leads a day or u was cursed at, told u was no good, they said we all sucked...than the violent messages got worse, they used racial remarks, the G--D----- word, called the girls B*tc*es!  Jason bryan is the "CEO" please he is a 23 yr old punk, he got the company from his mommy!!!!  He don't care about people, he fired a girl after her mom had a heart attack and she went in the hall way to call her family, he saw her and fired her for using her cell phone!  Don't work for this company!!!!!!

Employee Law Suit

I am an analyst for NYC based venture cap firms and scout for interesting portfolio companies.  In reading through the comments and rebuttals one thing is clear the CEO of this company has no professional control over the company’s staff.  This kind of situation is fertile ground for the accusations made by the former employee. 

 

The other issue that stands out as an investor is the fact that the CEO dose not communicate well in the written form.  The higher one travels up the corporate ladder, the more important the written word becomes.  This fact adds credence to the point that “the company was dropped on the CEO’s lap.” 

 

This brings me to a grossly simplified conclusion about Auto Cricket.  If a venture cap group were interested in entering this market space, they would more likely seek out a well run sophisticated telemarketing firm and attack Auto Cricket’s customer base from the top down.  Again, when CEO’s start talking to CEO’s the written word becomes very important.

Its cool my lawyers have all the evidence anyway...I am not a horrible or nasty person, I can careless what u idiots say about me.  I know what happened there, and yea u and Chris did curse people out every day!  U made that job a living hell so much people were afraid to come to work.  It was a horrific job and u guys made it that way!  I am a way better person than all of u.  Yea Damien there is a law suit on Auto Cricket, I was never paid OT nor did they settle with me, and I have the proof where they owe me a lot for OT pay!  I wasn't terminated bc of low leads nor did my leads get kicked back, my story is straight!  So have a nice life I will

To set the record straight I am the real Damien listed in the original report. I was called an hour ago by Dawn and told about the lies you posted about what happened and also about me. After reading everything I wished I would have fired you when Chris originally wanted me to. I held your job for a month after I was supposed to fire you. Nothing of what you have said is true. I was a regular employee for 3 months before I was promoted to the assistant manager. I started in June when Seph was the only MOD on. Then Carrie was an MOD. After Carrie moved to New York Jennifer tried out for MOD but did not cut it. That is when I was asked to try out. It was 2 months that I worked there before I was an MOD. Then over a month later in September was when I was promoted to Asst. Manager and went to Georgia for training. So I was not hired as a manager right off the street and I was promoted from within. Lie number 1. I worked my a*s off to get that position, so how dare you insinuate anything other. I never missed ONE day of work, always was on time, have a degree in management and several years of management experience, always made my quota and above, and was well liked and respected by almost everyone. THAT is why I made manager over everyone else.

No one EVER had their pay reduced. We were all salary of $400 a week and always made $400 a week unless you missed a day, the only thing that changed was we went from salary to hourly with a daily production bonus. Lie #2

I never threatened or cursed out ANYONE. I am a professional person when it comes to my job and have NEVER cursed out an employee or physically threatened one. There were never any "racial" remarks. I was dating a black guy and have a black step father remember? Lie #3

Your leads were kicked back and you were fired because of that. I know, I was the one that fired you. The night in question Chris was notified by quality control that you were marking hot leads on things that were not leads. He had me listen to them and then email them to him. He then told me to fire you on the spot. This was after a month before he wanted to fire you but I felt sorry for you and convinced him not to and that I would try working with you to help you improve because I thought you were my FRIEND. Boy was I wrong. Lie #4

There was no problem with me being a sex offender as you try to make sound as such a horrible thing. The company knew all of the details before hiring me and promoting me as well. So did many of the workers. Autocricket did not "hide" anything from anyone. No company I've ever worked for tells employees about another employee's past, especially if it is illegal. When rumors started by YOU and ERIN, that is when Jason went in the room and told everyone what the situation was. He didn't have to do that. Nor did I have to explain to everyone the truth. Especially after you LIED about what supposedly happened saying I kidnapped someone and all the other lies. I was 20 in 1995 when I dated someone that was 2 months from being legal. That is all that I was guilty of. That is why I was hired despite being a "sex offender", because my charge was not that of rape, child molestation, or kidnapping. My "victim" had a fake ID, lied about his age, and when I found out begged me to stay with him. So yah, I am guilty of making a bad decision to stay with someone underage when I should have broken up with them, but again that was what? 18 years ago?

In the above paragraphs you say several things about how "good" you are, how good of a job you did, how you don't have a lisp or horrible phone voice. You are wrong on all counts. You were always one of the lowest, if not thee lowest in the room for lead counts, every hour on the hour. We called them out, remember? Everyone there knows you sucked on the phones. How can you even THINK you were doing your job well? You were behind the average almost every day by 10 or more leads. Your job was constantly threatened because of it. And you did have kickbacks, several of them. I know because I heard them. And then Chris played the 10 the night you were fired to the group the next day in the morning meeting. You do have a lisp a very gayly sounding lisp that most of the people always made fun of. But you know what? I defended you. I told them that was not nice. I even helped you when you were stranded and couldn't get back to work and home. 3 times I believe. And THIS is the repayment I get? Lies told about me? You trying to make me look bad? Then when people like Chris and Dawn get on here and tell the truth you cuss at them, call them names, and lie even more? What kind of person are you?

Also, you are not suing anyone. Stop lying. I checked the court filings. There are no filings against autocricket from you other than a labor board one that was summarily dismissed because Autocricket already settled with the labor board and payed out $75K to past employees.

All of your ranting and raving shows now nothing other than you are a compulsive liar and when presented with the truth and facts resort to name calling and childish cursing. Grow up and stop being such a P.O.S.

Christopher I don't even know who the hell u r so 4 me to HIT on u was wrong, and why would i even bother I have a boyfriend!  I had many friends in there, n I have no lisp u idiot!  I asked Carrie if any of my leads were ever kicked back and she said NO!!  As far as for Erin she was a b***h, I kicked her out of my house b/c she was a back stabbing b***h!  The OT pay I never got that is also in the suit, I had proof and gave it to the lawyers.  I can care less of what u 3 idiots say about me but I am a gr8 person, so u all can go to hell!

First off, I am not homophobic in ANY way as some of my best friends are gay and I used to be cool with you until you started flirting with me. As far as the bonuses go, you are dead wrong. I asked my manager today and he told me that all bonuses are taxed and that is the law. Even gifts given to employees over $10 are taxed and reported. So YOU are the moron that needs to get his story straight. And you had MANY kickbacks and Chris had brought it up several times in front of the whole room and told you if you got more he would have to fire you. Autocricket also did not "hide" anything about Damien. When it was found out they told everyone the situation. That is not hiding anything, that is being honest. What company that you know of would just volunteer someones past criminal history to all of the employees? No one. And the person whom responded before me was so right. You are a nasty bitter person. Defamation of character? LOL Damien is the one that should sue you and that evil wench that tried to get him fired and lied to all of us about what he supposedly did. All of your rumors that you started about him were lies. And Dawn was right, Damien did go out of his way to be nice to you and any other person that came to him for help. And just so you know, the labor board investigated Autocricket and already passed judgement on the "overtime" you "say" you are suing about and its already been handled, many ex employees got checks issued to them because of it. The only truth in your statements is that Autocricket needs to be shut down. The rest are the rantings of a mean spirited nasty souled person.

ugh you always were a drama queen and such a bold faced liar. You WERE horrible on the phones, everyone used to make fun of you about it. They warned you SEVERAL times in front of everyone how you needed to catch up as you were always one of the lowest when we counted.  Chris wanted to fire you several times and Damien actually backed you up asking him to give you a chance to improve. Your leads were constantly kicked back and the person you responded to was 100% RIGHT. Your leads were played back after you were fired for the whole room. 10 of them if I remember. All horrible. You have a horrible lisp and do not sound "great" on the phone at all. Also you are VERY wrong about "bonuses" ANY bonus given to an employee is taxed, its the law and I know this because I work for the state. And no, not everyone got the same amount of bonus money. And Damien was hired before I was and did not become a manager until I was there at least 2 months so you are wrong there as well. Seph was the manager and then Carrie for several months before she moved. Damien did not become a manager until Carrie moved. If I'm not mistaken Damien was there at least a month before me. As far as being "liked" the only one that liked you was Erin, and even then she said horrible stuff about you behind your back like how neurotic you were to live with and how she couldn't wait to move out. And I don't ever remember anyone getting "cursed out" like you imply. Sure there was some cursing, but never directed at someone and I've never heard Damien curse while he was talking to anyone. YOU cursed more than most of the people there. And whomever wrote that rebuttal was very truthful, especially about you. You were horribly flamboyant and that wasn't a homophobic statement at all it was the truth. You constantly broadcasted how "gay" you were to everyone, it was pretty sickening. And before you call me homophobic I am a l*****n. And what did the owners "hide"? What are they suppose to broadcast everyone's past criminal records so everyone would know? That is the stupidest thing I've ever heard. No company is under ANY obligation to divulge an employees personal information put on their application to any other employee. THAT is illegal. So what they "knew" about Damien? Damien is a great guy, although sometimes he was a bit of an a*s when he got stressed out, all in all he was the best manager they had and really cared about us. Many of us quit after he left and a couple of people actually cried. You are a horrible, bitter, nasty person to try to lie and defame him like that..everything you said about him is a twisted half truth at best and just mean. And you say YOUR not judgmental. If I'm not mistaken it was YOU and Erin that started rumors about him that were lies and then tried to get him fired and this was after I know he helped you and Erin out when your vehicle was broken down. That is a shame. That man went out of his way to help you and her and be friendly to you and all you did was back stab him then and now. Yes, Chris was a horrible person but to bring Damien into this as well makes YOU a horrible person. Many of us think Damien is the best manager we have ever had, there or anywhere else I've worked at. Grow up and stop being so nasty.

Please I know I did my job correctly, none of my leads were EVER kicked back, I don't know who wrote this rebuttle but It is totally false and 4 u to say anything about me being gay is homophobic u b**ch!  I had a lot of friends there who backed me up on everything!  Chris is an idiot and yes they did curse people out in the room also via IM!  My voice on the phone is great, never had a problem before, I will make sure to tell my lawyer to add defamation of character to the suit.  Point blank is the company is a horrible company and should be shut down!  The fact of the matter is that the owners knew about Damien and hid it, I am not judgmental, he was the 2 weeks before he became assistant manager not 3 months!  Who ever wrote this F**K U!!!  Your not worth my time!  No bonuses are not taxed they are rewards, and everyone got the same amount of bonuses not just me!!!  Get your story straight u moron!

"Tim" the "Whistleblowing" Liar

There are several innaccuracies with this statement. I want to start of by saying that I am no fan of Autocricket Corporation and that it WAS a horrible place to work, but this "Tim" is a flat out liar. I know Chris and Damien as well as the owner. First, "Tim" claims that they "curse people out". That is not true. While Chris has cursed out his managers, neither he nor Damien had ever cursed out an employee that anyone saw. The pay "drop" is completely untrue. While the "base" pay was $8 there was what is called a production bonus that everyone recieved up to an additional $16 a day. Which in a 40 hour work week equates to $10 an hour. The only way you were ever reduced to the base was if you were wrote up, did not show up to work, or your weekly lead average was well below everyone else. The reason this was is because when the company first started they had everyone on salary of $400/wk, but due to state regulations they had to disband the salary, as the employees' job description did not qualify as a salaried job. There were people whom volunteered to come in early, eat breakfast, and start off by setting up their stations. No one was ever required to do this. The additional bonuses, yes, were taxed. But isn't that the law? That all payments made to an employee must be taxed? I believe so, so I don't understand why that was even brought up. Everyone knew that bonuses were taxed. Damien was not hired as a manager right off of the street. Damien was hired as a regular crew member. The managers at the time were Seph and then Carrie was promoted. Seph was fired for hacking the computers and making them automatically clock him in and out when he was not there. Carrie moved to New York. Damien was promoted into the manager position after already having been there for at least 3 months. I know this because I sat next to him every day before he became a manager. "Tim" also fails to tell you that Damien has a business degree, never missed a day, was very professional, and had extensive managrial experiance. Also, while Damien was a "sex offender" that charge was from when he was 21 in 1995. There also were no children employeed at Autocricket at any time, there was no "hiding" this-  why WOULD a company disclose an employees past criminal history to other employees? Once the subject became an issue the CEO of the company came in and addressed it saying that his company belived in giving people that made mistakes in the past (in Damien's case over 15 years ago) and that Damien showed great character and was promoted for that and the other reasons mentioned above. Other than a couple of disgruntled employees (maybe 7 out of 500) Damien was very well liked and was missed once he left. "Tim's" leads were kicked back several times, and his leads were played back to the rest of us once he was terminated as to give an example of what NOT to say on the phones. I am surprised "Tim" lasted there that long. Most of us wondered as well as we heard his calls. He was always among the lowest 5% of lead generators (which his extra bonuses were always low when he did get them), and while I am not homophobic, Tim was flamboyantly gay always trying to flirt with other guys and talk about his boyfriends. He had a horrible lisp and sounded awful on the phones. No one ever used racial remarks, especially Damien, as he comes from mixed race household and always was nice and associated with people of other races. There were also no "violent" messages...no threats to hurt anyone. I don't think a company would still be around if there were recorded threats of violence - that statement makes no sense. The only "threats" were that of job loss. It was simple. There was a goal. If you could not make that daily goal on a weekly average somewhat consistently you were not producing what is needed for your position. Its simple math. X amount of money needs to be made to pay x amount of money to the employee. If the employee is severely under his quota constantly why should a compnay pay that employee while they are also losing money on that employee? Also, the girl that went in the hallway to call her family was not fired for that. She was fired because she told a lie. Her mother never had a heart attack, it was shown that she left the room without permission from a manager and when questioned said it was because her mother needed to go to the hospital. What was told to everyone by friends of hers is that she was having relationship problems with her boyfriend and that is why she was on the phone. I hope this helps clear up "Tims" statement so everyone can see the truth of the matter - which is he was a very disgruntled employee that just did not produce as the rest of us did. 90% of the room clapped when we found out he was terminated, and this may be mean to say, but beacause he was so annoying and weird.
