 : Sent on June 14, 2017, 11:30 PM Avi-Con Inc., DBA CA Construction: On June 14, 2017, I was informed by Well's Fargo Bank, that a "Cancellation Letter" was needed from Avi-Con Inc,/CA Construction, and faxed to Wells Fargo Bank, stating effective June 1,2017, AVI-Con/CAConstruction services were no longer wanted at our Fontana, CA. property, per our request, as they were fired by me and my husband Joseph, from the job. In our first request on June 1, 2017, my husband (Joseph) and I informed Avi-Con/ CA Construction, employee Brian Clark, that we were immediately terminating the relationship with Avi-Con/CA Construction and no longer needed their services effective June 1, 2017. We gave CA Construction one week, in writing via text, until June 9, 2017, to deposit the One Hundred Thirty-Three Thousand, One Hundred sixty-six dollars ($133,166.00) into our Chase checking account. On April 25,2017, an inspection was completed at our, property and the inspector informed Well's Fargo that the property was 50% completed, which was a blatant fabrication. This allowed Wells Fargo to give Avi-Con/CA Construction, an additional $53,000.00, after receiving two $40.000.00 checks, to work on our home. No work was started until the early part of May 2017, May and they failed the last inspection in April. On June 16, 2017, my husband and I requested another inspection, that was completed on June 20,2017. This inspection was rated 35% versus the 50% that was stated by the previous inspection conducted with Avi-Con/CA Construction's employee Brian Clark. CA Construction intentionally and willfully ignored our request to terminate the working relationship and sent us a letter via email stating they were willing to complete the project. Again we declined their services with and explanation.

For 10 months very little was done to our property to get us back in our home. At age 71, being displaced that long was and is totally unacceptable. We questioned Brian several times about the lack of progress on our home. We became tired of the numerous unacceptable excuses and nothing being done to make our home habitable, so we decided to hire our own contractors and terminate (fire) CA Construction. We informed Construction that we hired professional licensed contractors, that immediately began working on our home. We did not heard from Construction, who totally ignored our request to return our funds. This is our second request informing Avi-Con Inc./CA Construction, that we no longer need their services at our property. As of this date (6-25-2017) we still have not heard from them regarding our One Hundred Thirty-Three Thousand, One Hundred sixty-six dollars ($133,166.00), that they are still illegally refusing to return to us, that they are collecting interest on. On June 14, 2017, at approximately 1:35PM, I contacted Avi-Con/CA Construction, and spoke with Lisa Quintana, Payment Procedure Liaison, regarding the letter of cancellation required by Well's Fargo. Mrs. Quintana informed me that the only person to handle the "Cancellation Letter" is Naomi Avila, Chief Financial Officer, and she was not available. I ask Lisa if she would relay my request for the "Cancellation Letter" to Mrs. Avila, and send the document ASAP to Well's Fargo Bank and a copy to us at the Marriott Hotel for confirmation of the cancellation. I gave Mrs. Quintana the Well's Fargo's property Loss Department, fax numbers and the fax number to the Marriott Hotel where we presently reside. We have also filed complaints with the Better Business Bureau, the Contractors Connection, California State Licensing Contractor's Board, 12501 Imperial Hwy, Ste 620, Norwalk, CA 90650,

on June 14,2016,by Certified Mail, posted our complaint on Face Book, Yelp and Angie's List. Again, we have stated to Avi-Con/CAConstruction approximately 3-4 times via texts that we would appreciate them complying with our request, for the "Cancelation Letter" from Avi-Con/CA Construction to Well's Fargo Bank and send said "Cancellation", letter to us, effective immediately and deposit our funds in the amount of One Hundred Thirty-Three Thousand, One Hundred sixty-six dollars ($133,166.00), into our account ASAP. On June 19,2017, the below correspondence was sent from Avi-Con/CAConstruction, to our AAA adjuster vs me or my husband, to which we are highly offended, as our adjuster has nothing at this point to do with our home or the finances. Let me know if you would like to see any revisions or if there is a different format you would like to view. Please reference the start date on the schedule of June 5, 2017. As discussed, this is our go forward date for our completion timeline. Also attached is the supplement that Dylon has completed. As discussed, there are only a few minor items for the supplement. This will allow us to accurately charge and credit the project for work that was completed and work that was not completed. I am here to help and we will work with all parties to reach an amicable resolution in a timely manner. Regards, Aaron Avila How is this working with us as homeowners, when we fired them June 1, 2017? This is so disrespectful to my husband and I, that Avi-Con/CAConstruction can continue to withhold our funds, impede the work that needs to be done to our home and circumvent communication with my husband and I and placing us in a position to be homeless in 1.5 months when our insurance payments for the hotel runs out. This appears to be deliberate on Avi-Con/CAConstruction part.
