On March 20, 2005 my family and I rented 5 ATV's from Aztec Motorsports. I placed a $1250 deposit on 2 of the vehicles and we paid $688 in cash for all 5 of the rentals. One of the bikes, a 2004 Kazuma 50cc was wrecked by my nephew. When we returned the bikes, Aztec took my brother's credit card information and told us that it would be one week before they could contact him with a total for the damages. I was told by Lonnie at Aztec that the deposit charged to my card would not go through and that he would deal directly with my brother to handle the damages since my brother's son had damaged the bike.

On March 29th, Lonnie from Aztec contacted my brother and told him that the damage to the ATV would cost him over $1000 in parts and 10 hours of labor at $65 per hour. He told my brother that he could just sell him the bike for $1250 because that was how much it was worth. My brother offered to buy Lonnie a replacement bike from another source and trade it for the damaged one. My brother also requested that Lonnie fax us a copy of the repair estimate and a receipt showing that the ATV was worth $1250.

Lonnie agreed to these terms but never sent us a fax. My brother decided to contact a few local ATV shops and discovered that the damaged parts are only worth $150 and a brand new bike is worth only $600.

Since the last time my brother spoke with Lonnie, we have made several attempts to contact Aztec via phone and sent them a certified letter with no response. Aztec has charged my credit card for $1250 and will not communicate with me or my brother regarding the charge to my card or the replacement of the ATV.

We had an agreement with this business to handle the damages that we made to the ATV. They have stepped outside of that agreement and overcharged me by 100% of the value of the bike and furthermore, they will not respond to me or my brother so that this issue can be handled in a fair and timely manner.
