Bader Insurance Company Denied water damage claim due to a storm when the draines didn't hold and water poured infront of my unit going under the door and damadging boxes of clothes, pictures, a laptop, and a tv. Indianapolis, Indiana

I moved to Colorado in a job transfer. I rented a unit for one month and during this time they had 3 storms. On the 3rd storm I went to the unit to take out some items. I found that the draines that ran above my unit was over flowing. There was a camera that was directed toward my unit so I called the Storage Company they stated to call the insurance company. I said I would but I wanted to make sure while I was there that I called it in so it would be documented at the time I found the unit. It was getting dark so I took some pictures with my phone as well. The unit had to be opened slowly with me on the ground in mud and water because the boxes in front that got wet had colapsed causing the items on them to push into the door.

The items that got wet were boxes of clothes, pictures, baby books, lap top, and a tv. The clothes I was able to wash and dry, the pictures were destroyed and the lap top doesnt work. The tv works but the buttons in front don't work properly.
I called Bader right away and filed all the proper paperwork including the pictures. Never got a call again and then a denial letter saying the building didn't colapse. I called and spoke to S. (man who sent the letter) supervisor R.L.. She said he filed out the proper forms so I was denied. I stated I would call my lawyer. After I saw the other comments on here I knew I was in for a fight. I explained I paid for water damadge protection and this was water damage. Not by me but by faulty drains.
This company is terrible.

Your plight is all to common place with mini storage policies. Having handled thousands of such claims for the mini storage industry in the past decades. Most denied claims are fraught with improper investigation and mis statements made by you and them both. The collateral damage abounds from the claimant trying to self adjust their own claim relying on honesty and integrity on the part of the insurer. They have no duty by contract to be forthright, but you do owe a duty to be truthful. Even then most facts are left uncovered or your own  terms for the cause of loss is quasi at best and used against you in the denial of your own claim. What you say will be used against you. Dont try to determine your cause of loss for them to your demise, let them determine the cause. Saying less is always better in a claim when you are not an expert forensic adjuster. Be cooperative and truthful but dont adjust your own claim and be a volunteer.  

Flood water or surface water entering your unit is not covered, a justifiable denial. They owe you no bailment as you stored it at your own risk and lock it up with your own lock. If you purchased a mini storage renters policy it still does not cover certain acts of God, or surface water or flood waters.

However thats where the inconvenient truth ends and most inexperience claims adjusters (inside claims clerks) or those indifferent to the truth rushed to judgement and denies the claim. They fail to do a proper investigation or ask the right questions for fear of finding a covered loss. Again, they owe you no duty to prove your loss, thats your job. 

Assuming they denied your claim righteously under your own policy (1st party policy) then you have only a 3rd party liability claim to pursue. That means you may have a claim against the facility for faulty maintenance, poor housekeeping, construction defect or neglect in repairs by maintining the overhead drains free of debris annually. I they are guilty of liability by the facility for improper maintenance (clogging of the drains- or improper installation of gutters and drains) that can be proven as the proximate cause of your loss, regardless of the heavy rainstorms, then you have a 3rd party claim against the facility insurer. This does not sound like a viable claim under your own 2st party renters policy, but a strict liability claim against the facility owner.

The Indiana DOI can do little in this case unless they fail to respond to you. You can use them for leverage to get a claim filed but they have no judicial authority in Indiana, but can help get responses for you if the mini storage fails to respond, if they are not self insured. The DOI has no authority over non insurance entities as self insured.  As for Bader, they are not known for being  the direct insurance company , but a broker/agent/ARM/ underwriter concern placing their business thru one of a few mini storage insurers for renters policies. The facility insurer for CGL -Liability would need to be determined and a claim filed against them if they are negligent, which sounds more likely here if flooding/surface water was not solely the origin of your loss.  

Suggest when getting a denial, consider using an expert as a  Indiana claim advocates or policyholder adjuster who can guide you thru the pitfalls of the claim maze. These are claim experts with decades of actual claim handling experience that have been thru these traps and will explore all avenues to find coverage, where the insurer will not.

  You should contact the CO Division of Insurance.   They regulate insurance companies in CO and have employees whose job it is to assist consumers with issues like these.    No guarantees, but going to the regulators usually gets a company's attention.
