They say you can start a membership for $5, and if you change your mind, you just need to let them know in writing in 72hrs. Well, I later was told that the monthly membership fee was $30/mo and it would be automatically debited from your checking account.

The next day, I then wrote a letter to Bally's financial center office asking them to cancel my membership and refund my $5. Problem solved right? "wrong" - I received a letter in the mail stating that since I had cancelled my auto-debit, I was no longer eligible for the corporate discount and would have to pay the full regular annual membership fee of $1,300 - "WOA." I called Bally's to see what was going on since I new I had mailed my letter within the 72hr period. Bally's stated that the letter would have had to be received by them within 72hrs, and mine was not, so therefore, i was liable for the full membership price since a "Bally's membership is a contract."

Cancellation

You still were eligible for the cancellation and $5 refund. Your later stated that you wanted the Electronic Automatic Payment turned off. , (Which is different from reqesting to cancel you membership) Having your automatic payment turned off only results in losing a $5 discount on your monthly payments after the contract, during the renewal portion, (only if you wish to continue at that point. But on all membership you have the option to cancel your membership entirely based on "buyers remorse" some states even give you more than 3 days.

You should call the corporate office back and tell them your later was written with the intent of canceling the entire membership based on buyer's remorse. And let them know that the Correspondance department misunderstood your letter. They were under the impression that you were intending just to stop your automatic payment rather than cancel the whole thing out. Tell them u had intent to cancel entirely. I hope this helps. : ]

Rebuttal:

If there is one thing credit reports have in common is that the majority of reports run have fitness club collections on them.



Its a racket that the clubs run they get you to sign up with deposits and monthlies with the full knowledge they know the majority of people give up after a couple of months then they nail you to the cross for payments over the next two years.



The whole thing is BS it is not like you bought a car and stopped paying they are basically stating you HAVE TO TRAIN and keep coming to their gym or pay for not coming.



Why should you keep paying when you do not go there anymore? the gym has not provided any service past the point you stopped going and stopped paying.



Contract??? How can you contract the rights of someone's body??????????



Lets face it you fitness centers you are basically a big racket to tie people into your collection companies with the pretence pay up or we will screw your credit up..



I have yet to hear one good reason why monies are owed past the point of stopping, the only reason a gym can give is you signed a contract, if the likes of Bally's etc had so much faith in their gym's there would be no contract it would be pay as you go. But the fact is Bally's for example knows their gym's are crap and one big posers palace for the staff to hit on members and as soon as members realize after trying the gym for a short

period of time they just do not want to pay anymore.



Bally's real business is collections and as for the staff they lie and stretch the truth so they can get their commissions.



You want my advice



GIVE A FAKE SSN# FAKE NAME and FAKE ADDRESS if they want a drivers license tell them you were banned there is no way they will let you out the door because you do not have it, they will sign you up anyway because they want the MONEY$$$$$$$$$.
