bank of america started charging us multiple overdraft fees when we had money in the bank in turn causing us to go negative leading to more overdraft fees. we only went negative because of the fees in the first place. we called twice to try to get things straightend it but they said there was nothing they could do. we have the bank statements showing it was there fault. they charged us over 200 in fees when it wasn't our fault.

Bank Statement Does not Reflect Available Balance

It only reflects your account balance. Here's an example....

You have $100 in your account and available. You use your debit card to spend $60 on groceries. The merchant then processes your transaction in 48 hours.

The next day, you check your account balance and it says $100. But that's not what's available; you only have $40 available. So you go to the ATM and withdraw $60.00. Your account balance is $60.00, but your available balance is now -$20.00. Congratulations, you just overdrew your account and got hit with a $35.00 fee. Your bank statement would clearly reflect you had a positive balance at the time you overdrew your account....

Accordingly, your bank statement would not serve as proof......

This is a new policy the Bandits of America started back in 2008, following the lead of Wachovia. Here's the easy way to remember it.

When it comes to overdraft fees, the bank will charge these fees and get its money days BEFORE the transaction even posts.

When it comes to deposits, the bank will hold these and give you your money days AFTER it posts.

Make sense now? Very few banks (less than ten) charge overdraft fees this way.
