Bank of America Customers Cheated By New Banking Practices

Charlotte, NC (Consumer Watch Dog) Eric Florio, 23 of Gainesville, FL deposited a grand into his bank account with Bank of America and went about his business of using his bank card for whatever he needed. About a week later Eric was surprised to discover that his bank account was over drafted although he had spent less than he had deposited in his bank account, when he went into his local Bank of America branch he discovered that the bank had put a month hold on half the money that he had deposited causing his account to bounce although his online register showed his money as being available in his account. Eric is just one of thousands of Bank of America customers that has set up an account online and does not get a statement that has been or may be affected by Bank of America's policy change on February 5th, 2008.

Under Bank of America's new policy credit transactions on your debit card go through immediately instead of when they actually post on their website which makes the online balance registry that many customers depend on to balance their finances inaccurate. Like Eric, anyone who does not get or use their mailed statement would not have realized this change of policy as it was sent out somewhere on bank statements.

After I spoke with Eric the stories about people who have been burned by Bank of America started to pour in as they say. Stories like that of Anthony Edwards, 42 of Farmville, NC, who followed his online bank registry until Bank of America started bouncing his account with money in his account on his registry, and now his account bounces every week because he cannot catch up from the initial banking error. Mr. Edwards says that he knows 15 people that this has happened to with Bank of America in his little area that I have not even spoken to yet, so the numbers are just rising without trying to find the story really. Then there is the story of Deborah Arrington, she left Bank of America after she claims they ripped her off on a transaction concerning a rental car.

I myself became a victim of Bank of America's recent policy change in March. My mother had just died in February and I was back and forth between North Carolina and Florida so that I could be with my family and I depended on my online statements being accurate as they had always been before February. If you will recall, Bank of America actually encouraged the use of their online banking, but they never posted visibly on their website any notice of this change so being in FL and not getting my mail I never received any notification of this change.

My story is much like Eric's, on March 12th Bank of America over-drafted my account with money in there to cover it according to my online register. Since then they have over-drafted my account a total of 18 times, $630.00 in two full swoops. I had the money, I even put more money into my account even though some was in there to cover what was being bounced when they were bouncing my transactions, so that my car payment would go through and they bounced my car payment with $60.00 bucks more than my total car payment in my account.

The last thing we need in today's economy is a loss of trust in banking; we will be living in the 1930's all over again. I was shocked and appalled when this happened so I called Gail Brown, VP of the Kernersville, NC branch who was very helpful to me in the past the last time that Bank of America returned transactions when there was money available, and she blew me off for a week. American's today cannot afford this sort of breach of trust from their banks, just being blown off when it's our money and Americans are living tuff with rising fuel costs. After a week, yesterday, I finally got to speak to Gail. She informed me that since their policy change in February their online statement was no longer accurate so it was my fault even though I was not home in NC to get a mailed statement with the notice of this change somewhere in it. So, since then I have not depositing another dime into that account because I am afraid to use my own bank account, I simply cannot afford to pay Bank of America charges that are not legit. I will probably never use Bank of America again.

Bank of America made a change of policy that has affected many, and yet they did not make it clear, they did not put in on their website. Bank of America is entitled to change their policies yes, but they should make sure they are taking care of their customers and not ripping them off in the process. They should have realized that people depended on an accurate online registry as it has been ever since I have been with Bank of America, and they need to send out special notices and post changes this large on their website. Personally, I think Bank of America owes many people a refund. Can we really trust Bank of America with our money when they practice banking like this? Does Bank of America overcharging their customers with fees for doing nothing other than balancing with their online checkbook registry which was always accurate until February have something to do with the fact that Bank of America's market value fell below that of JP Morgan Chase & Co this week?

No, actually I'm not making assumptions. I'm taking your posts at their word. OP stated your car payment was rejected eventhough you had more than $60 more than that payment in the account. Well, since you don't write checks that means the car payment was adebit card or automatic debit. Since it didn't go through it means it was an automatic debit. That means you had debit cards holds for more than $60 on the day it was presented so the payment was returned unpaid. This causes a NSF fee to be accessed. Again, the only register this payment would reflect in is yours until after it posted. The bank has no way of tracking/knowing it was scheduled to come against your account. But you did. Why did you not leave enough money in the account for this transaction?

If the change was in February, I would think the bank sent out information no later than January. This way if you didn't want to abide by the new policies, you could have time to change banks. I find it interesting that on this post you say you were not home to get the mailed statement and on another post here you say you don't get mailed statements. Again, no assumptions on my part. Just reading what you post.

Bottom line: the online banking can only show you what's posted and current debit card holds. Your register is the only place you should look for your balance. And yes, I did have my friend "brian' help read your posts.

You are a banker which means your best interest is for the bank and not the consumer. What is causing over draft fees is bank of America holding deposits for 3-4 weeks so that they can push through fees, clear your check after the fees go through, and then take your money. This has happened to many people, and it never happened before their new policy change. I did not say notice had to be made how we prefer it, I said policy change notice should be made CLEAR, which bank of America did not do, if they did we would not have thousands of people that feel cheated by this bank because there was no clear notice of policy change sent out, they hid it tucked within links of their site. Even the lady at Wachovia said this is insane, they send out notices of policy change and they still do their checking the way BOA did before this change. Also, you are wrong, a large number of BOA customers do not get a statement at all and if they use their receipts and the online register to do their check register then they would not have known about this change at all. As it was I was in FL burying my mother when this change was made. Not getting mail I would have had to guess that suddenly in February BOA made a change, and then go dig for notice of this change on their website. It would have taken all their customers being psychic to predict this change if they choose (As BOA offers) to not get mailed statements. Also, there was no notice of this change if the Feb online statement itself that I could find so it is obviously not very clearly stated at all, even online. Of course people did not notice this change on their online statement, they would have had to hunt within links to dig for it because it was not made clear on their home page, and BOA never sent out any special notice of policy change. If anybody reads this and would like to see my statement, all the checks they have held, the money that they have lost in deposits that I have had to have replaced, or how bank of America makes up the dates that transactions were made (I have the receipts with different dates to prove it, and they do this so they can steal your cash) then contact me! But whatever you do, do not bank with BOA, they are crooks, just yesterday on this site 3 more people posted with the same issues, they are ripping thousands off country wide! I have changed banks now, and the money I am just counting gone, but I am not going to stand quiet and let others get screwed! People, do not trust the rebuttals on here, they are all bankers and probably do the same thing to people! STAY AWAY FROM BANK OF AMERICA. They just call their other fee an "unavailable funds fee" and specifically mention this:

What is an Unavailable Funds Fee?

This is a fee assessed when an item has been presented for payment posts against the account and, due to a hold, there are not enough funds available to cover the item.

Note: The Posted Balance in the account may reflect sufficient funds to pay the item. However, the Available Balance may be less because of holds on the account, such as Check Card purchases, which are guaranteed for payment by the bank.

The sneaky part about the unavailability of funds is that you won't see it on a statement, but Wachovia's mention of Check Card purchases is the same across the board at all banks that offer Check Cards.

I don't see a ripoff here. A register that showed all the transactions including dating deposits when they would be actually credited (after the debits for that day! and after check hold times) would prevent this.

I just read their Deposit Agreement effective July 2006, and it's clear that they use available funds to determine the balance, and that they can change their posting order at any time without notice, and can even decide to clear different categories in any order. Again, no ripoff. Did you get the deposit agreement change in 2006?

Yes, I work at a bank, but not BOA. Again I've just tried to help explain what happened.

No I'm not the one making assumptions. The facts are these. When a bank customers writes a check they must consider that money spent at that minute. When a customer uses their debit card to make a purchase they must consider that money spent at that minute. When a customer authorizes an automatic debit/a check by phone/or any other method of payment they must consider that money spent at that minute. When you spend your money, you must by law have the funds available at that minute to cover the item. Not plan on making a deposit to cover it, not live on the float. The money available in the bank and then spend it. Very simple concept. Anything else and the customer is the one causing the overdraft fees and having no one else to blame but themselves.

As far as the notification, again, it doesn't have to be made as you or each and every customer of the bank would prefer it. It has to be done in a manner that each customer will receive it. Gee, include it in the statements, since everyone gets a statement. If they get an electronic statement they get a link with the information. I don't bank at BOA, but I guarantee that there was a link provided for those with electronic statements to inform them of the change. You may not have noticed it but it was provided by the bank.

So go ahead and spread all the stories about BOA ripping you off that you want. Just be aware that many you talk to will be intelligent enough to see that you ripped yourself off.

You know reading this over very carefully, you way wrong! Under Bank of America's new policy every charge you do on your debit card now goes through the second you make that charge. I was used to balancing everything on a delay. Besides that the Bank has lost deposits they have had to add back on numerous times and they have held my deposits for up to 3 weeks ever since Feb when this change went through. I am not banking like that, and I have never had a bank hold a check for almost a month before.

This is crazy, and then the moment Bank of America can put a charge through, the put through the charges, clear my check they held for three weeks, and then take my money. I am not staying with them and this was not my fault, I do not care what you say. Fox news did not think it was my fault after I showed them 9 years of Banking history with no over drafts, my extensive quicken records, and then showed them my online statements where they could not find any visible notice of Baking policy change. If it were so visible one of these people besides me would have been able to find it! I am sure it is there, but you have to hunt for it don't you, and I mean hunt beyond their home page!

My register (which has never been in the negative until this, I make good money) is updated daily, and I hardly think any of these cases is people skirting responsibilities; you are obviously a banker justifying crooked practices. I think all these complaints are regular customers who were caught unaware a Bank of America policy change that no clear notice of was sent out, and you saying that it is the client's error is nothing more than assumption on your part.

I do not use checks, so there is never a check that I wrote waiting to post! Because of online bill pay checks are a thing of the past, and I always put every bill that I pay right into my Quicken when I pay it. Not a good example!

Does this bank have no heart at all? I do not think so, they should have fixed this! I think the Bank has the right to make these changes, they should make them 100% clear though, and they did not. I feel like I have been punished with a large sum of cash for leaving town to bury my mother, and that is so wrong. So today, I think I will be calling other banks, telling them my story and what Bank of America did, tell them I was out of town for a funeral, and ask how they would handle it, anyone not heartless would have refunded my money as it was a Banking change that caused it, and not really customer error. I am still leaving Bank of America, I also am having my other half pull her money and leave the bank as well. I have already convinced for friends to leave my bank which was not hard to do when they saw all the charges coming through on my statement when I was not in the negative at all. I will make sure everyone I encounter knows what a crooked bank Bank of America is!

Vista Credit Union, my old bank, notifies it customers with special mailers through e-mail that states in the subject of the e-mail "Policy Change". This is called caring that your customers notice any big changes that they could be charged for and not hiding it somewhere that is not even on the homepage and not sending out special notices at all like Bank of America did (who obviously does not want to make changes apparent so it can rip of its customers). I mean I just got an e-mail yesterday from the DNC because they changed their policy and they do not even handle my money. I am leaving Bank of America, and I am going to make sure nobody I know joins and that I can get as many people as I can to leave by showing them my bank statements where it clearly shows charges being pushed through while my account while it is in the positive. I have seen many of your posts and none of them seem of the helpful nature, most seem like you are insulting people who I am sure did balance their check books, and your post works on the assumption that they do not, taking the stance of any banker that would want to justify fraudulent charges. I balance my Quicken every single day, and in 9 years I have not had one banking problem until this policy change, it is a banking problem that many people I know personally here have had the exact same issue with, and if you read rip-off report, it is a nationwide problem with Bank of America. The truth is in the numbers, just on this website there are almost a thousand people who have been ripped off in the same way in just a few months. This would not have happened has clear notices of policy change been sent out. Bank of America can reserve whatever right they want, I reserve the right to leave their bank and tarnish their name for the rest of my life with the truth of how they rip their customers off!

Try to help poeple and see what happens.

The bank has to provide the notification. If you get a printed statement it comes with the statement. Everyone says 'oh I thought it was just adds and threw it away". If you get electronic statements they give a link which for my bank is very obvious to disclose the information. The responsibility of the bank is to notify. They have several methods to do this. Just because you didn't see it is not the bank's fault.

Online statements/transactions are accurate and 100% as far as what has posted. However if the check you wrote for $100 or the automatic debit you approved for $323 has not posted, it is not reflected in the posted or available balances. But it would be in the register that you should keep with all transactions recorded. Basically these are cases of poeple shirking their own responsibilities and claiming that they are a victim.

As far as leaving BOA, that's certainly your perogative. However, please accept my last bit of advice as the assistance that I was trying to provide when you decided to jump. Most if not all banks utilize this same process. How soon will it be before you're complaining about this same thing with your new bank?

I said, clear notice. A change this big should not be tucked within a link within a link that I did not even think to look at when I was in FL because my mother had just died. This is something Bank of America should have posted clearly on the Home Page of their website, not hidden within paragraphs of legal crap where Bank of America knew that most people who do not get a mailed statement would ever think to look. This is deceiving and the bank knows this, news stations here agree, and I as a journalist agrees. I think it makes a great story and I think American's will be glad to know that Bank of America is stealing from its customers. Also, you and everyone else who has your post should know that I did go back to my February statement to look for any legal notices and there was no link for that even. I still have not been able to find any notice of this change on their website or in the statement for that month. You probably just work for a bank and are trying to justify fraudulent banking practices. Point blank, if I cared about my customers in today's economy I would have made sure that everyone knew of this change with my Bank, why didn't Ken Lewis? I would have sent out fliers to make sure, put it on the TV, and made certain the change was on the homepage of my website. The fact is that I was told my online 100% accurate daily, and for 4 years I they have been. I use Quicken daily, I make good money, I have never before this bounced anything in my life. I can print 9 years of Bank records to prove that because Quicken stores it for me. I have always used my online register and it has always been accurate and for those of you who like to scorn for using the online register, Bank of America encouraged me too, they told me it was 100% accurate and so for four years I did and it was. In the end, I am leaving Bank of America, and I will make d**n sure that everyone I know or encounter knows this story and never joins.

I never spend money I do not have, the fact is that according to my online registry that Bank of America stood behind being accurate, they even offer the option to cancel your statements though the mail and use your online registry, this would not have happened. The reason I depended on my online statement being accurate in the first place is because I was told by the Bank of America representative when I opened the account that it was 100% accurate, and that has always been true until this policy change.

Also, you are incorrect, I would not have bounced a thing if the online statement had no idea what has cleared the bank, Gail said that the change of policy makes everything to you use as a charge on your card go through immediately, there are now taking money before they allow money to be deposited. I was perfectly fine with the way it was, when your charges did not come through immediately, as I said I use Quicken and when it was that way the register was always accurate, and I would be fine with this change, the bank has a right to make changes, but they did not take those who do not get mailed statements into account with this change. They did not let their customers know with any special notice about this change, and something this big should be on the HOME PAGE of their website.

Online statement notification...

If you have online statements and the bank sends out a enclosure with the mailed statments, you will get a link next to the link for your statement that is titled legal document (or something similar). If you go back and look at your february statement the link is probably still there. So the bank has provided the notification. If you did not read it, it is not the bank's fault.

BOA representatives are ignorant!!

Okay, so I'm sure not all of them are but my past two experiences left me speechless. Unfortunately, I do not have a transcript of the first, but I am posting the last conversation here. Now, I'm not really complaining because their ignorance just happened to be in my favor, but I wanted everyone to see the professionalism (or lack thereof) of some BOA reps.

I obviously had a similar problem with BOA (as posted in my own rip off report). It angered me, BUT you can get your money back! Just keep trying! I have spoken to two different representatives and gotten one O/D fee reversed from each one (even though I didn't even ask for it and made it clear that that was not my concern on the second one~read below). For everyone with the ever so popular use your register comments~ it does absolutely no good when the bank rearranges your transactions! I gave up on keeping mine! And also to everyone that says the charges and the way they rearrange transactions is fair-no it isn't and BOA reps will even admit to that! It causes your own register to be misleading and it is exactly like taking your money before you have spent it. Case in point-one of my transactions resulting in an O/D fee was a check that had posted and left me with a positive balance before they rearranged it. Okay, fine they have the unfair high to low procedure BUT they went back and rearranged my check to a date before the check was even written! How is that ethical, even legal?

So anyway, here is a copy of my last conversation with a BOA rep. I never got my question answered but as you'll see I excitedly quit while I was ahead. I will make sure to make a deposit in order to prevent my concerns from becoming reality since I obviously got nowhere with my original question! You pick and choose your battles. I may have been able to push to get my question answered, but it could have cost me the refunded overdraft fee which I was NOT willing to risk!

But the problem today is that I have 33.52 in the bank and I know there is a check that will most likely post on tuesday or wednesday before my deposit goes in. I made several purchases yesterday and I am wondering just how many will be rearranged and how many more fees I will be stuck with

But the problem today is that I have 33.52 in the bank and I know there is a check that will most likely post on tuesday or wednesday before my deposit goes in. I made several purchases yesterday and I am wondering just how many will be rearranged and how many more fees I will be stuck with

BOA representatives are ignorant!!

Okay, so I'm sure not all of them are but my past two experiences left me speechless. Unfortunately, I do not have a transcript of the first, but I am posting the last conversation here. Now, I'm not really complaining because their ignorance just happened to be in my favor, but I wanted everyone to see the professionalism (or lack thereof) of some BOA reps.

I obviously had a similar problem with BOA (as posted in my own rip off report). It angered me, BUT you can get your money back! Just keep trying! I have spoken to two different representatives and gotten one O/D fee reversed from each one (even though I didn't even ask for it and made it clear that that was not my concern on the second one~read below). For everyone with the ever so popular use your register comments~ it does absolutely no good when the bank rearranges your transactions! I gave up on keeping mine! And also to everyone that says the charges and the way they rearrange transactions is fair-no it isn't and BOA reps will even admit to that! It causes your own register to be misleading and it is exactly like taking your money before you have spent it. Case in point-one of my transactions resulting in an O/D fee was a check that had posted and left me with a positive balance before they rearranged it. Okay, fine they have the unfair high to low procedure BUT they went back and rearranged my check to a date before the check was even written! How is that ethical, even legal?

So anyway, here is a copy of my last conversation with a BOA rep. I never got my question answered but as you'll see I excitedly quit while I was ahead. I will make sure to make a deposit in order to prevent my concerns from becoming reality since I obviously got nowhere with my original question! You pick and choose your battles. I may have been able to push to get my question answered, but it could have cost me the refunded overdraft fee which I was NOT willing to risk!

Here we go again....

We have some people complaining about the "change in policy" that says they don't withdraw the money immediately but re-arrange transactions from highest to lowest when they post in order to get the most Overdraft fees. Then we have this person who says that they are now withdrawing the money immediately when the transaction happens instead of waiting until they actually post in order to get the most Overdraft fees.

WHICH IS IT FOLKS?

Or is the answer none of the above because, the policy has not changed?

In the "old" days people wrote checks. Well of course it was impossible for a check to "post" until the bank received it. This was sometimes 2-3 days from the time the check was written. But even then you had no control of when it posted so if you didn't get the money back in time you could still overdraft. The only difference now is that the time a merchant could process a transaction with a debit card is shorter and shorter. Notice I say "could" because you still have no control over when they actually send the debit to the bank. This is why you can NEVER spend money that you don't have.

Why did you depend on your "on-line" statement to be accurate. It is YOUR responsiblity to maintain an accurate register. You remember the register don't you, it is that little book that comes with your checks. Your On-Line statement has no idea how many purchases you have made that have not made it to the bank only YOU do.

For example your on-line statment shows you have $400 available, but you wrote 1 check for $390 that has not been deposited and a debit card transaction for $5 or wait was it $15 that has not shown up. This makes a difference and if you kept a register you would know if it was $5 or $15. This would be the difference between having $5 left and overdrafts.

To some people using a register seems like a big bother, but if you refuse to use it then you open yourself up to these problems. If you refuse to keep a register go back to the old days where you actually carried cash around and do not use that debit card for the $5 cup of coffee. At least if you take $20-$40 bucks out of an ATM you would only be hit with 1 OD fee rather than the multiple OD fees for those small purchases.
