I moved to Arizona and needed a bank account. My mom had BOA credit card and I heard good things about them they were nationwide and in case I moved back to Michigan I could transfer my account there. When I first got my account I didn't have any problems at all. I started working and had my check direct deposit and then had my husband. We didn't have to many problems at all. Then my husband got laid off and then our problems started. I paid my bill online so I did not have to write checks and I knew they were paid. Well I kept getting these bounced check fees all the time. Someone had hacked into my account and was making purchases with my debt card and using my routing number and account number on the bottom of the checks. I called them about it after I got paid and they took my whole check for overdraft fees. That is $600 dollars that I had nothing to do with. So I told them that they should not be allowed to take someone paycheck and leave a family of four with no money for two weeks. I asked to talk to a manger and she put me through. Well this manger needs to be fired! I told him about it and that the charges I did not make and that they need to credit my account. I did not want any more overdraft fees to come out. But they said I had to file a claim to get the money and fees back. It has been two weeks or more since then. The money for charges I did not make are still coming out after I closed the account. The manger also told me that I need to balance my checkbook and not to go by my statement or the phone or anything else. But Its hard to balance your check book when you have overdraft fees coming for no reason. I wrote a check out and really thought I had the money in there and turns out that I didn't cause they took out 70 in fees. So now my account that is suppose to be closed is accumalting fees and I will not pay them at all.

Do not use this bank unless you want to owe them more money that you make. Plus my work has quit using this bank too cause of this problem. I can't say where I work for their sake but its a BIG COMPANY that is known in the us and canada. They are a non profit company so they can't afford to be in the whole all the time. My boss was offered a job with boa and refuse it cause of this problem and he does not bank with them because of this. Plus here in Arizona they will give non citizans checking account. Just don't trust them as far you can see them!

Make sure any fraud claim is in writing.

And any other contact you have with the bank is also in writing. If the only contact you had with the bank is by telephone, you will need to follow it up in writing and file a signed affidavit for any fraud claim. The bank should have given you a provisional credit while they investigate. But they will only do so after they have received your affidavit.

You should also file a complaint with the Office of the Comptroller of the Currency. They will investigate and determine if BofA followed regulations in investigating your claim.

Look through your account terms and conditions or possibly the banks web site. There should be some information on how to file a fraud claim and where to send it.

Good luck.

Finally, a real rip-off. Now, they may continue to charge fees until the settlement of your case. However, if the case turns out to be in your favor, then with that information - you need to have the NSF fees reversed. All of them.

The problem I see is whether you will actually receive all of the fees back to you; the claim will have information that is weeks old - meanwhile you're still incurring fees and they're not part of the claim. You need to do a little accounting and math, total up all of the fees incurred - included in the claim and those happening subsequent to filing the claim - and present that information to BofA to verify and reverse.
