I beleive there is enough people out there who have been ripped off by bank of america on overdraft fees alone to qualify for a class action suit.
Even though bank of america qualifies these fees under thier guidelines and we as consumers (saps) agreed to these guidelines, I think we are being treated unjustly , unfairly and being taken advantage of by bank of america. Anyone who has been charged with an overdraft fee (sorry I ment fees, they come in three's) knows what I am talking about.

Is there anyone out there who knows how to get something like this started or even just getting a list of names together.

Paul, the account agreement you signed allows the banks to change some of their rules with no notice to the customer. You affirm your acceptance of the terms by continuing to keep your balance there. It's not something you need a lawyer for; it's just something to consider when you open an account anywhere. The fact they change the rules on you - is not a lie. If they decide to start charging you for the account, you have a choice: you can change the account to another that won't charge you a fee, you can close the account and move the account to another bank, or you can simply pay the fee....

OK, I'll give you the specifics... When I opened the account they said it was free. After 3 months they started to charge a monthly fee. What they say and what is in writing is two different things. So what is the answer all you do gooders? Bring a lawyer with you just to open a checking account? Next I was charged $143 for buying a $6 salad with my debit card that had a balance of $450. You figure it out.

Never write a check or use a debit card to exceed your AVAILABLE balance and you will never have another NSF charges. I've been with BOA for years and have never had a NSF because I never exceed my Available Balance. Deposits are NOT posted into your account in a timely basis but checks are credited immediately. You have to keep track of this. Good luck. Don't waste your time on a lawsuit - you agreed to all the terms the bank has.

You're late to the game on this; most every bank was sued and the bank's won. The bank was found by the courts to have the ability to charge whatever they wish provided it is all documented in the account agreement you sign. There were some banks who had to adjust their disclosures; Bank of America was one of them and there was no repercussion from the lack of disclosure. Whether you feel this is unfair, unjust, unsavory, unethical, is undeniably irrelevant. It only matters what is legal and what is legal depends on the account agreement.

I don't know what caused the fees, but the likely culprit is the debit card the bank gave you for free. People who stop using the debit card and start using a credit card will see their fees decrease, if not eliminated. Best of luck to you.

No one like these tactics by the big banks.

And no one like to get hit with any kind of fee.

But the whole issue is that the banks have their policies in writing, and people do agree to these terms and policies - in writing. No one is being forced to do anything. If you do not like how this bank, or any other big bank operates and performs their business, you are more than free and welcome to do so.

How can you think that a suit is going to be filed under these circumstances?

"Yes your Honor, the bank provided me with a written policy and terms. Yes your Honor, I signed stating that I agreed to these policies and terms. What do you mean I have no legal basis?"..........

Unjust and unfair is all relative to which side of the situation you are on.

Bottom line is that if you dont want to do something, then do not agree to it. If you do not want to suffer consequences for something, then avoid it.
