Mr. David J. Cohen, Esq. has yet to pay for interpretation services we provided with a certified court interpreter two months ago with the following details for the deposition.


Time: 4/9/2010 10:00 AM - 2:00 PM


Place: Bay Area Criminal Lawyers, PC, 300 Montegomery St.  #660, SF, CA 94104


Case name: Candido Bonavente (Plaintiff) v. Blatteis & Schnur, Cameron Baird (defendants)


Case number: unknown

According to the opposing counsel, the case was settled.  However we were not able to reach Mr. Cohen because he refused to answer our phone calls.  Our emails sent to him went unanswered.




We filed the complaint to the Better Business Bureau and the State Bar of California.



Cherie Beasley with email crbeasley@bayareacrimlaw.com and phone 415-290-2560 asked to talk to us.  David Cohen says that he "won't pay me anything" if I don't withdraw the complaint.



I said yes, I would withdraw the complaint if he pays me.  However, he refused to pay the $100 overdue charges.  



The first email Cherie Beasley sent was



"Hello Samuel.

Please send an email confirming that our agreement is that you will withdraw the complaint within 24 hours of receipt of payment of the $609.50.   As soon as I receive an email stating that you agree to do so, we will mail the check, which is signed and ready to be sent.  Thank you.

Cherie"




Then, she sent me another email




"This means that you agree to send us proof in the form of written attachments and/or letters within 24 hours , that you have withdrawn your complaints against us with both the State Bar of California and the Better Business Bureau, in exchange for our today mailing to you a check in the amount of $609.50.  Is all of this correct?"


Then received another email from Cherie Beasley:





Samuel - Thank you for your email response dated July 7, 2010.  We discovered another complaint that you filed on Google (in addition to the complaints filed with the State Bar of California and the Better Business Bureau) shortly after our last conversation.  You did not mention that complaint to me during the course of our July 7, 2010 conversation.  This has caused Mr. Cohen great concern that you have not been forthright about the number of complaints that you have filed against himself or Bay Area Criminal Lawyers, PC.   We need written confirmation in the form of an email or letter that you will do the following within 24 hours of receipt of the payment of $609.50.:


 


(1)     You will produce a list of all complaints filed against our firm.


(2)     You will withdraw the Google complaint.


(3)    You will withdraw the complaint to the State Bar of California.


(4)    You will withdraw the complaint to the Better Business Bureau. 


(5)    You will withdraw any other complaints that may be included in the list.


(6)    You will provide written proof of the withdrawal of each complaint.


 


In addition, you agree to the following:  In the event that you do not include a complete list of the complaints and/or do not withdraw all complaints, you will pay a liquidated damages amount of $10,000.00.


 


        As earlier stated, the check remains here in the office.  We are ready to send the check out immediately upon receipt of written confirmation that you agree to the above terms.  Cherie R. Beasley, Esq.

Update:

We finally received the check from Bay Area Criminal Lawyers.  

Thanks for the attention to this matter, and we have to thank Cherie R. Beasley, Esq's assistance in helping us to resolve this issue.

Does anyone know how to remove the previous two complaints that I posted?  I cannot find a way to do it. Thank you.
