We purchased a new car in October 2008. All our loan documents showed SunTrust Bank. No documents were received showing anything differently. Dealership told us in November that our loan was with BB&T. They could /would not give us a loan number, contact info, etc. - told us that BB&T would send us that information. A week or so later, I called BB&T, explained the above - and was told they did NOT have a record of approving a loan for us.

The very first correspondence we received from BB&T was in mid-November 2008 showing TWO payments due with a late charge included - with the total being due by the 21st. I called them on 11-17-08 - explained this was the first correspondence we had received, and that we could not make both payments then, but would mail one on 11-21-08 and then make the other one as soon as funds were available. (Like everyone, our income had taken a severe blow.) The lady I spoke with said that was fine - to just not let it go past December 1 with two payments due. (BB&T did NOT cash our check for 17 days after it was mailed to them.)

On 12-04-08, Rick Crutchfield shared non-public financial information about us with a non-affiliated third party. We were made aware of this by the third party calling us!

I, personally, talked to Rick Crutchfield, BB&T Loan officer in the Knoxville, TN office, and asked him why he intentionally violated our privacy rights - and his response was "because we hadn't madse a payment and he was trying to determine what was the best way to do it" - (Does this make sense to you??)

The next week, we began receiving harassing telephone calls four to five times a day. Each time we were available to answer, the rep was told the same thing. But still the calls continued - only now with hang-ups as soon as we answered.

On 12-15-2008, we faxed a complaint to Mr. John Allison, IV, BB&T Chairman and CEO, 200 W. Second St., Winston-Salem, NC 27102, fax number 1-336-733-2509. To date, we have NOT received a response from him.

A complaint has been filed with the FDIC - their investigation is still pending. In the meantime, a complaint was filed with the State of North Carolina, Office of the Commissioner of Banks, 4309 Mail Service Center, Raleigh, NC 27699, 919-733-3016. Daniel J. Rozelle, Sr. Vice President, Sales Finance Product Manager, 101 S. Elm St., Greensboro, NC 27402, responded to the Commissioner with non-supported statements that in essence said BB&T had worked with us (Failed to say when and by whom) to remedy this situation - our loan was current - and that they would eliminate any delinquent references or counters regarding this loan-and that the late fees charged would be credited back to our account. His letter is dated 01-26-09. Our February statement showed a late fee being credited to our account - then we were charged for two more late fees!

We were not satisfied with his non-supported answers, so we again contacted the Commissioner of Banks requesting copies of the "standard dealer agreement", a copy of our original loan showing that it was sold to BB&T, a copy of the written agreement with the specific wording highlighted that verifies Mr. Rozelle's statement that the manner in which they handled our privacy rights is consistent with the FDCPA and other applicable laws; and a copy of the agreement stating that "the dealer has financial responsibility for the contract, especially before three contractual payments are made by the buyer. The Commissioner requested a response by 02-24-09.
No response has been received to date.

Then today, we received a letter dated 02-25-09, from Violet Reese, BB&T, P. O. Box 1793, Charleston, WV 25326 - 304-347-4416 or 800-954-6416, stating that we are currently due for our 01-21-09 payment and that we are presently in default. The purpose of her letter is to inform us that BB&T is accelerating the unpaid balance and demanding payment in full - within ten (10) days. (We have a copy of our cancelled check for the January payment that cleared our bank before the due date.)

We feel BB&T is ticked off because we filed complaints with the FDIC and Commissioner of Banks - and this is their way of getting even. Like other Rip-Off reports, numerous credit inquiries have been made on our credit reports. A copy of the "demand" letter is being faxed to the Commissioner of Banks.

If this matter is not resolved within the next ten days, we will be contacting our attorney. We do not want to have to take this action unless forced to by BB&T. All of this could have been avoided if BB&T would have apologized for their employee discussing our personal non-public information with a third party - and their accounting department would post payments timely and correctly - and last but not least, they cease to harrass us and communicate in a sensible, business like manner, with a little common decency thrown in for good measure.

No wonder our account is so messed up with employees from Knoxville, TN, Greensboro NC and Charleston, West Virginia all taking an active part - plus the Customer Reps who are calling from heaven knows where......It's no wonder information gets misconstrued and interpreted in so many ways...
