I do not want to file this report. Initially, I enjoyed working with Ben and the communication with him was great. My job was to design and host a website for my business. The cost was $1500 or so with hosting, via paypal.

After several emails and exchanges, Ben went dark on me. The sample website was pulled down from his servers and communication abruptly stopped. He said that his mom was in the hospital and he was busy moving. Both of which are valid reasons for a delay.

After several failed promises and missed deadlines I was unable to reach Ben Donley. It has been extremely disappointing and costly to my business. The web design was crucial to my marketing campaign.

To Ben's credit, I needed to change some of the content which probably caused additional work and some delay on his part. It did not merit him completely going dark and refusing to communicate.

At this point, I consider it theft. We have a signed contract and he has not met any of his obligations.

I was forced to hire an attorney and am currently pursuing legal action against Ben and BD Productions. I will do everything within my legal rights to effectively shut down his company and prevent him from stealing from potential clients.

I am unsure if I have been had or just dealing with a non-responsive web designer. Regardless, I need to protect my rights.

I will do my best to update this blog.

Final Agreement and Settlement

I am happy to report that I have resolved all of my issues with Ben Donley and BD Productions. Ben and I looked over the expenses paid and agreed on a fair price for the files he created. He overnighted me the difference and I released him from any and all claims.

It is my opinion that Ben Donley is very talented at web design. Something happened in his life earlier this year that caused his business to fall off track. Additionally, I think programmers that he had hired disappeared with work to be completed. Once project timelines started to not get met, customers started requesting refunds and chargebacks which intensified the problem for BD Productions.

This is a business, and as such, there are contract agreements and policies that I expect clients to follow in order to keep the work flow moving forward.

One of those policies, that has been posted in plain sight on my policies page and unchanged since January of 2008, states that if you file a dispute with paypal, or submit a credit card chargeback - and lose - I charge an additional fee of $400 before anymore work is performed, and any files are released to you.

My clients ready the policies and agree to them when they sign the contract - and yet .... there are always a few who decide that the rules dont apply to them. They file disputes because it takes a little longer to complete the work that what was originally expected, and feel they are immune to the $400 rule - so they do not pay it. As a result, I do not finish their site, nor do I give a refund, or hand over any of the finished work.

They know this upfront, and its their choice to accept these rules before even entering into an agreement and paying 1 penny to me for services, but yet can accuse me of being a rip off or scam simply because they cannot follow the rules.

When you go over on your cell phone minute - you are charged a fee. It is in the contract, and you agree to it. So if you go over your minutes and get hit with an additional charge on your bill - and shut your phone off if you dont pay it - who's fault is it. Yours ... or is the cell phone company a scam and rip off?

Its the same theory here. Read and understand the policies, follow the rules, and everyone wins. Or you can thinking that rules dont apply to you, and pay the consequences.

Ben Donley defrauded me

Well, here I am again to file an update on my previous report regarding Ben Donley.

Today, I have filed suit with Wisconsin County Court trying to collect my $1150 in payments to Ben Donley. He has done absolutely nothing since our agreement to continue working on the project.

He has not responded to emails or phone calls. I encourage anyone who is considering doing business with Ben Donley to find another web developer. This guy is a thief, plain and simple.

I plan on contacting the Walworth County District Attorney to see if criminal prosecution is an option.

Ben Donley and BD Productions should be avoided at all costs. He is incompetent, non-communicative and a hassle to deal with. He is also malicious and self-righteous. I intend to exhaust every effort putting him out of business.

Ben Donley contacted me today regarding my website design. He assured me that everything was on track, but temporarily delayed because of an illness in the family, a new house and a new programmer team.

I really liked the initial template. He assured me that he would do everything possible to complete my website as soon as possible.

I feel good about his quick reply and effort to get my job done.

I will continue to update this blog and will post a link to the finished website upon completion.
