Carol Junglov, President Of Body By Design ripoff paid for procedures not received refused refund Edmonds Washington

On February 17, 2003 I bought twenty endermologie sessions from the business Body by Design in Everett for $900. I attended 13 sessions and had 7 left to go when I broke my foot.

I contacted the business and told them that I wouldn't be in for a while. My broken foot then turned into blood clots in my leg. I went through some hospitalizations and medications.

I called the president (Carol) to try to get a refund for the remaining sessions knowing that pressure should not be put on my leg and was told that I couldn't receive a refund but I could "bank the remaining sessions as maintenance sessions." Then last June the business closed and the president moved her equipment to Edmonds and stated that her sister was leasing her equipment.

It took me several weeks to reach Carol after that time. She did not have the professional courtesy to call me and inform me that her business was closing. In fact, the staff at the former office location informed me that she was going into business with her sister in Edmonds. I left her many messages on her cell phone, which was the forwarding number from her business, and she didn't return my calls. After researching the parent company I discovered another phone number for her and began phoning that number, which turned out to be her home number. Carol was very hostile with me at first and after many conversations said I could continue my treatments in Edmonds at her sister's clinic.

I had not spoken to my doctor about the treatments until July, when Carol decided I could continue the 7 sessions in Edmonds. After I spoke to him and took in the literature that Carol had provided me with when I first began the treatments, he decided that I shouldn't continue them. At that point I reminded her that she had told me that another person could receive my treatments. I told her that I had a daughter, who was over 18 and could use the treatments in Edmonds. That option seemed fair to both Carol and myself.

The last time I heard from Carol was in August of 2003. She had phoned my cell phone to tell me she was going out of town for a few weeks. Her message stated that she would consider giving me a refund and let me know when she returned. I left her two more messages after that which she didn't return, and I then wrote to the Better Business Bureau. Carol waited until her business license had expired to respond to my complaints. All of the BBB's letters to me contained Carol's cell phone number on it as the contact number. After I waited 30 days to hear from them they said that she had not phoned them back.

After trying the BBB I wrote to the Attorney General's office. She wrote to their office and stated that she closed her business in Everett and that the corporate license expired on November 30, 2003. In addition she stated that the corporate ban account had a negative balance of $1.30 and she was unable to give me a refund.

Consequently I paid $900 for 20 sessions and used 13 of them, meaning that she either owes me 7 sessions or a refund of $350. She ripped me off!
