October 19, 2010 For Whom It May Concern: My complaint is with the Better Business Bureau in Austin, Texas . I spoke with Brian Blessing and left voicemail for Carrie Hurt. (1) The first complaint is the ratings from the BBB for the business named in my complaint; A is the rating given for Full Service Master Car Care. The business became a member of BBB May 2010 and received two complaints within the first month ("in the last 36 months" reporting period is misleading). Mine makes three known complaints OF THE SAME NATURE (i.e. "misdiagnosis of problem", "inferior workmanship", "work performed without authorization.") within two months of their joining the BBB. (2) The BBB doesn't adhere to their rules of Arbitration. For example, after the first arbitration I prudently made timely objections ; contrary to the BBB rules of arbitration, a new arbitration was immediately scheduled, before the arbitrator made his decision which I later learned was ruled in my favor.

(3) The Arbitrators are not trained well, and do not know the art of negotiations, or how to fact find by asking questions that pertain to the complaint. He did not even look at the best piece of evidence made available to himmy car, nor did he contact any expert witnesses or others involved to adequately discern the facts. It is questionable whether the arbitrator even understood the facts as his "Reasons for Arbitration Decisions" reads like a dissertation on the human condition more than an analysis of the facts pertaining to my complaint. Moreover, he believed at face value all that the business owner claimed although documentation clearly revealed the owner made several false statements. (4) The BBB wants to emulate our legal system without using the fundamentals of law. The first arbitrator who I was told ruled in my favor was a lawyer and these arbitrations should be conducted by either a lawyer or a professional within the automobile industry. (5) The BBB hides behind an arbitrators decision as if they were separate in and of themselves. They claim there is no appealing so that those who do not read the rules in full dont realize there is recourse.

(6) The BBB persuades the consumer who contacts them to file a complaint with them rather than the court of law. Statements like low cost or free, easier than small claims court, faster and you dont have to know the law, most courts will refer your case to mediation anyway and it could take a long time, etc. This has taken so much time and energy and justice still has not been served. Had I filed in small claims court and the ruling was in my favor would THAT have affected the BBB ratings of this business? (7) I requested a conditionally binding arbitration but was told the BBB now only conducts binding arbitrations. I am not under a court order not to discuss the matters as to the business named in my complaint and or the BBB, like the BBB would have consumers believe. In fact I think I will write a bookor contact the local news troubleshooters. The bottom line is misrepresentation. How can the BBB claim to be a neutral party in a dispute resolution when in fact the business members fund it? How many complaints do business members make with the BBB in regards to consumers? Where do these "volunteer arbitrators" come fromhow do they qualify and why do they volunteer in the first place? Actually I think I want to volunteer because the consumer deserves some voice within this organization created for the betterment of the community.

These arbitrations could only be considered neutral if an outside independent mediation service was provided. I will pursue justice to all ends if a lien is placed on my vehicle based on findings that contain factual errors and omissions and negligence in mathematical calculations. I request a thorough review of my initial complaint, the arbitration proceedings and the findings. The further this matter persist the greater detriment is caused to others and myself.
