Beverly Loan Company and Jordan Tabach-Bank were sued in Los Angeles Superior Court in a lawsuit that was filed March 18, 2011 by an elderly 70 year old woman for the following offenses:

1. Breach of Contract
2. Restitution of Rescission for Failure of Consideration
3. Breach of Fiduciary Duty
4. Conversion
5. Fraud
6. Intentional Infliction of Emotional Distress
7. Recovery of Usurious Interest Received
8. Financial Abuse of An Elder

The lawsuit file number is BC457578 and claims that Jordan Tabach-Bank personally participated in and benefited from the unlawful acts and misconduct.

The lawsuit also mentions employees named Deanna Acosta and Lynette Marks.

The lawsuit says that the contract states that her collateral, a diamond necklace, would be stored "on the premises" of the pawnshop but that the statement was false. Employee Acosta told the elderly lady that the necklace was missing and they were not able to find it. Mr Tabach-Bank called and told the victim that her jewelry was "officially missing," states the complaint.

In other words, the accusation and apparent admission is that Beverly Loan Company and Mr. Tabach-Bank lost the elderly lady's jewelry worth approximately $200,000 for which they had given her a $15,000 loan.

The claim is that the defendant, acted with oppression, fraud and malice, that the defendants knew their representations were false, reckless and without regard for the truth.
