To whom It May Concern: I would really like to thank the person who told me about ripoffreport.com and also about the ruthless advocate (Great Thorn) who goes after businesses that prey on minority consumers with predatory lending practices.

My name is Michelle Bass. My husband Roy Hall purchased a 2003 S-10 from Bill Heard chevrolet of Union city in October of 2002. At the time of the purchase I was visiting family in Arizona. I recieved a call from my husband informing me he needed me to co-sign on the new vehicle.

The car salesman later called me. My husband the car salesman and I had a conference call. I informed the car salesman (Edward Weems)that I could only co-sign with the trade-in included because we could not afford two vehicles. He said he understood and sent the contracts next day mail.


When I arrived in Atlanta the following week phone calls started with the prior financer of the Nissan Altima. They could not understand why they had not yet recieved a payment from my husband considering we had never been late with a payment before. We then called Bill Heard chevrolet to see why our trade-in had not yet been paid off. A man by the name of (Joseph Johnson) told us there was no trade-in and the person who was our salesman no longer worked at there dealership. During this time Bill Heard chevrolet had possesion of our trade-in.

Fortunately we were able to contact the prior salesman and we explained our dilema to him. He then called up to the dealership and explained to (Joseph Johnson) and to a man name (Paul Hewitt) that there must have been a mistake ,we did have a trade-in.

Paul Hewitt told us to come to the dealership and re-sign the contracts. He apologized for the inconvience because it was now early December. He also informed us our payments would be pushed back an additional 30 days because of the dealership mistake. Mr. Hewitt told my husband and I to come to the dealership monday December 16th to finalize everything again. This was now the third contract. When we arrived at the dealership monday we were informed that Mr. Hewitt had passed that weekend from a fatal heart attack.

We were very sympathectic and understood since Mr. Hewitt was handling our case that things would now take longer to resolve would now take longer. Mr. Joseph Johnson reassured us that

I was curious why the percentage rate on our contracts for purchasing the truck was 14.20%. I thought it would be lower because of my good credit. I was informed by Mr. Johnson that my credit was not good enough to lower the rate, but after a year it would decline.

In Februrary we were informed that the dealership was not going to pay off our trade-in nor pay any late payment that had now accrued on our new truck since October.

Hearing this we were very upset. We tried on many occasions to contact the General Manager of the dealership (Steve Johnston). We then contacted Bill Heard corporate office and they reffered us back to the Union City dealership. After we contacted the corporate office Mr. Johnson then contacted my husband and I to meet in his office about our concerns. Present during this meeting was Mr. Steve Johnston(General Manager), Kelly Burnett(public relation of Bill Heard chrevrolet in Union City) and Joseph Johnson(financer for Bill Heard).

Mr Johnston started the meeting by telling us what he believed our dilema was. My husband then told Mr. Johnston that everything he believed had happen with the trade-in was not true. My husband and I began to take turns telling him what really happen.

The entire meeting was strickly poignant. Mr Johnston did not believe us or did not care. We were sitting there with all those contracts and proof from the original salesman and no relief from Bill Heard chevrolet. Mr. Johnston did offer to pay our remaining late payments on our new truck, however if Bill Heard dealership had not put us in this predicament there would be no late payments. Four months later our trade-in was steal at Bill Heard chevrolet.


The Georgia office of consumer affairs contacted Mr.Johnston(General Manager). He informed the representative that my husband bought the car without the trade-in and later we both came to the dealership and ask would they take our trade-in because we could not sell it. Mr. Johnston also informed the representative that we had late payments on our new truck because it was around the holiday and we went shopping and spent the money. Those statements Mr. Johnston made to consumer affairs was an absolute lie. We incured late payments on our truck because we were told by Mr.Johnson( the financer)our first payment was to be thirty days after our contract was finaled with our trade-in included.

Mr Johnston(General Manager) got this idea from Mr. Johnson( the financer). Mr. Johnson was the last person working on our contracts and before he will look incompetent to his boss he will blantly lie on us.

Days after our meeting with the parties at the dealership they returned the trade-in that they had in there possession for four months. The prior automobile financer repossessed the vehicle and our credit is now trashed because of Bill Heard chevrolet.

I also noticed the finance rate for the new truck was 14.20% when my husband signed the contract without me. And when I co-signed on the contract it was still 14.20% with my good credit. It seem as though Bill Heard chevrolet never had good intentions when they sold us our new truck.

Nick, if you took the time to read I am not the GM of the store that is being complained about. I am the GM of another store that is agreeing that there seems to be legitimate concerns. I recommended that nobody should sign multiple contracts. I listed my name and location and email so everyone here knew that I was not trying to take meaningless stabs at anyone. I was offering to help explain or assist anyone who wanted answers. Grocers do get cash allowances for carrying certain products on their shelves... what do you call that? If you are going to give a rebuttal, please take the time to read carefully, so you won't slap the hands that are trying to help. Again for those out ther I the GM of a very large dealership, not the one in the complaint.... that is saying without question.. in my professional opinion... After reading the General Manager's rebuttal, it was hard to not laugh. He is literally comparring apples and oranges to a multi-thousand dollar vehicle. The deal is, grocers dont get "invisible" kickback for selling banna's from chaqueta! Dealers get these from the manufacturer, that is how they mostly make their profits, so yes, dealers are still making $500-$2000 on the car they sold you whether you know it or not.



Now, these contracts sound really fishy, at best. If, in fact they are forged documents, and/or fraudulant, you need to see an attorney ASAP!!!! If you have a good case, the attorney will represent you with no out-of-pocket expense, they will simply charge you a percentage of your monies rewarded by the courts. Think of this not only for yourself, but think of the others that this dealer has bent over, and the future citizens about to be bent over.



There should be no reason for FOUR CONTRACTS!!! Luckily you are still in posession of all of them, most dealers would have suckered you into giving those back. (Destroy the evidence). Now, as far as "you signed, too bad for you.".......In most states there is a clause/statute, though sometimes hard to prove without video evidence, that states if you signed the contract under duress, that contract is null and void. Duress meaning under extremem pressure. That doesn't mean "they were holding a gun to your head", rather that they threatened you in any way, being they wouldn't let you leave, give your keys back on the trade, or coerced you in any way with any reason why you "HAD" to sign the contract.



In short, after reading the GM's rebuttal, he knows there's pressure on him. He obviously got word of this report, that means most everyone he works with, bosses included, got wind of this report. He's trying to cover his a*s! Do not let him get away with this. His rebuttal was total horsecrap. Stay on him like stink on crap!!!! At the very least, you can make his life at work hell, and possibly get him fired if too much heat comes to that dealership.



ADVICE: GET AN ATTORNEY ASAP! I hope some of this information helps you in the fight!

I think they should be the judge of each of their situations... as "I stated before... there is never a reason for anyone to sign multiple contracts... if anyone asks you to... DO NOT SIGN!!! I hope I did not offend anyone... I did not hide behind anonymity... In posted my full name...position... and email address in an effort to explain a few do's ant don'ts. I believe this site is a good way for those that do not know answers to get them..



My only rebuttal was not to suggest that all dealers are that way... One should do business were they are comfortable. I hope I helped... was again I will post my email... not suggesting that I am perfect or that my dealership is.... but as a hopefully helpful source to help those that truly want help. If you just want to complain... this is the site for you..



This site helps link those together that have had similiar experiences and help to establish if a dealership has a pattern of action. I think that is great. I would be a fool to think that my dealership is not somewhere in this site... but I think if you are fair and balanced you will see that those that have attacked me have no need to be on this site compared to the experiences that have been discolsed. Oops... rambled again. sorry... hope this helps. again if it doesn't seem right....DON"T SIGN ANYTHING!!!!!



You ultimitely have the power to sign or not sign...I think all will agree... that "they forced me to sign" probably is not true... if they did... go get them great thorn.

Kendall Hopgood I have copies of all four car buying contracts that her car dealer had her sign in this Rip Off Report. How can anyone at any car dealer feel there is a need for a car buyer to sign four contracts?

I was emailed this from a client that recieved an email froma friend. It seems on the surface that there may be some legitimate concerns, however please don't take that to be the norm of ever transaction. thousands of vehicles are sound everday, one would hope everyone is satisfied. It is amazing that we don't drag the furniture store through the dirt as they mark-up their merchandise as much as 400% and we go smiling away, or at the grocery store where we pay a 265% mark-up for bannanas, where is the great thorn now??? it is ok for these industries to fleece America and the automotive industry is a rat b*****d for trying to hold 2 1/2 to 3% ??? get all the facts ... if they bare out then fine.... go after them... but there are those who work just as hard as the butcher at Krogers, or the furniture salesman at Rhodes that it is just as iresponsible to lump them in with a few bad apples. I'm sure that any industry can have a few bad ones but to suggest that everybody is a crook a "slime ball" that is a slap in the face to those of us who work hard every day and provide a service to those who seek it. Lets not forget that every complainer here was not solicited int their homes, but physically went to the dealership and wanted to purchase a car. I don't see anywhere where a gun was held to their head and told them to sign. I think it is the responsiblity of all to help inform people who do's and don'ts... for example don't ever sign more than one contract when purchasing a car.... do get a copy of everything you or your spouse sign... if it says something on the contract other than you were told... DON"T SIGN THE CONTRACT that is your best protection against having to spend the morning whining to the rest of america about a bad decision... there have been many bad choices I have made... oredered the steak when I should have ordered chicken... but I don't call the cook get mad at the cook for giving me what I ordered.. I just order chicken next time. To say all Dealerships operate the same because of one bad experience would be an injustice to those who work hard to provide a great place to purchase an automobile. If I were to say that All Democrats cheated on their wives because President Clinton did, you would say I was jumping to conclusions... please give those of us that have not broken the faith the opportunity for a pleasant transaction without the black cloud of previous offenders. I hope that I have not rambled on too much .. I am only trying to offer a balanced view to what seems as a one sided ordeal. READ THIS BEFORE YOU BUY A CAR!!!

My hats off to you guys! Way to go exposing the fraud! Too bad, this could have been all avoided if they hadn't simply taken the dealers word for anything. It is what is in writing that counts, and only what is in writing. NEVER ever take a spot delivery on a vehicle. Make sure all of the contracts are ready and approved (read and re-read them until you understand and agree to all of it) prior to driving off the lot. Car dealers will move heaven and earth to get you committed to a car deal..and after that, you are on your own.

Michelle my fellow advocate has sent a very clear copy of the credit app your dealer sent to the bank that you send your truck payments to. I want to take this time to discuss what I see and what I feel.



First My fellow advocate in Scottsdale, Az tells me that at the time of your purchase at Bill Heard you were paying $600 per month for your apartment that you are living in and that the dealer put that you were paying only $450 per month. Car dealer lied to your bank, FRAUD!



We also had a chat about your income. The fact that your income was falsified on your credit app. My Fellow advocate tells me that you told him that you were getting MUCH less than the numbers that were on your credit app.



He also tells me that none of the writing on the credit app you gave him was in your hand writing except your signatures.



It seems like they had you fill out a credit app and sign it. Then after you went home they took a second credit app and made it look real good so the bank would like your income and the bank would like the fact that you were only paying $450 for your apartment instead of the REAL $600.



I feel that they put their photo copier to work to use their version of your credit app and photo copied your signatures at the bottom of their version of your financial info.



He told me that your husband at the time of purchase was earning about $19200 bucks a year and that someone put on your credit app that your hubby was making $48,000 bucks a year.



Again none of this info was in your hand writing or your husband's hand writing. The word that comes to my mind right NOW is FRAUD!



I also have been told that the dealer kept your car that you were led to believe that you were trading in was in their trade pen for over 4 months.



Maybe a good attorney could hold their feet to the fire for the damage to both of your credit reports for the repo. That would be VERY COOL.



If they knew at the time of sale that they had plans of kicking your trade OUT of the deal, why did they not return the car to you that day? I will tell you why they did not return your Altima to you.



They wanted you to believe that you were trading it in until they got a bank to pick up the paper on your Chevy S 10. I have been told that they waited 4 MONTHS to give you your Nissan Altima back. Again FRAUD.



Seems to me that Fraud is the only word in this dealer's vocabulary.



At this time I want to tell ALL car buyers after you do any kind of car deal, make sure that you call up your lender and ask for a VERY CLEAR copy of all documentation that the car dealer has sent to the bank when they got you approved for a car loan.



You just might get a big surprise. If your bank is not willing to give you any copies of all documentation, maybe they sleep in the same dirty bed the car dealers are sleeping in.



Now I would like to help this car buying VICTIM find an attorney that is a TRUE SHARK and is not afraid of going up against a big car dealer.



If you are a good attorney I challenge you to prove you have a BIG SET of balls, let's ROCK.



Consider this a request that Michelle is searching for a good attorney. Contact the editor for her contact info only if you are ready to ROCK.



I will see to it that any attorney that is willing to run with this case will get one of the most POWERFUL expert witnesses in the country.



I am sure that a jury would see FRAUD all over this car deal. I am also very sure that a jury would love to have my special expert witness tell them what he knows about auto dealer fraud.



Michelle I will do what I can to help you. My fellow advocate has told me about your meeting with him. I am aware of your situation. The Rip Off Report an all of us here are on your side.

Michelle You have to think of yourself and your husband as a Victim of automotive dealer deception.



Let's get some facts out in the open.

1. If your car dealer had no plans to take your car as a trade-in why is it that they never asked you to take it home?



The answer is that they wanted you to think they planned to take it in on trade until your financing got approved. This car dealer kicked your trade out of the car deal because they knew you were what is called "Upside down" in a big way.



You must keep in mind that car dealers think they are above any laws. Most car dealers think that most car buyers do not have the money to go hire a good attorney.



For you to expose this dirty car dealer, I have went deep into my computer to find some contact info of people that need to read your Rip Off Report. This list below is very big for one reason. TO EXPOSE!



I want you to print off a "Printer Friendly Version" of your Rip Off Report and fax it to all fax numbers that I have posted below. Next I want you to email EVERY email address that I have posted below and send them ALL a direct link to your Rip Off Report.

First let me say you have the opportunity to write a short rebutle to the three major credit bureaus which they must send to anyone who's inquiring about your credit. But more importantly. let me ask you a few questions...



based on your posting here, would you say you had a really bad experience with this Heard store? I'll bet the answer is a resounding "YES!" So then I ask you, WHY DID YOU REWARD THEM WITH BUYING THE CAR???



They probably lied to you, they treated you poorly and in your opinion they messed up your credit and what did you do, by purchasing the car, you told them "Its OK to do that to me!" I'm wondering, what kind of dealer fee did they stick you with? $600? And they lied to you about that claiming its for secretarial and administrative expenses. Right. Sure. Too many car dealers treat people poorly because they know the customer will simply roll over and buy the car, giving them the profit.



I'm sure after the deal was done, they all had quite a laugh! Bill Heard is one of the most slimy dealership chains in the USA. That's a fact!
