On Sept 7, 2002, I went to Bill Heard Chevrolet. I traded in my 2000 Nissan Altima for a 2002 Chevy Caviler. I went back to Bill Heard Chevrolet a few day later to make the final deal. I also gave them $2000 cash. The first car note was due on October 14th. On October 1st, I had not received anything from the folks who were going to finance me so I called Bill Heard Chevrolt and spoke to Phillip Minor, the finance guy.

He told me that he would look into things for me and call me back. He never called me back. After numerous phone calls, and no calls back, I ended up speaking to Gene on October 9th, who was in charge on new car sales. Meantime, my temporary tag has expired and I had to go get a new one. Gene was very rude to me and told me that he didnt care how many times I have called and who I spoke too that he would look into things. After yelling at me on the phone and basically telling me I was stupid, I refused to deal with him anymore. .

All I wanted was to pay the car note or else get my Altima and $2000 back. On October 10th, I started talking to Anton Manley, who was Genes boss. He was very helpful int he beginning. However, he told me that he was here to help me and that he would call the financing folks. What it boiled down to is that Chevy had installed a theft device on the vehicle and the finance folks said that they would not finance the car because if that problem. The finance folks also kept calling me at work and I didnt fully understand why.

After 2 weeks of talking to Anton, I was starting to get real up set and said this was enough, I was coming to get my car. When my husband and I went to get the car, we were told by Gene and Les, the new finance guy, that the feal would be taken care of tomorrow as it was night time. I asked if the Altima was still there and they said it was in the mud pit and they didnt have anyone to go get it. We said fine, we would be back tomorrow. Anton called me the next day at work and said that everything was taken cared of and that the financing was done. Meantime, I had purchased an additional vehicle with a different dealer and I had no problems. I got the tags and notification fromt he financing folks within 1 week. So this was not a credit issue on my behalf.

During this time, Bill Heard Chevrolt had not paid off my trade-in and NMAC was calling me asking me why I was late paying the care note. I told them of the situation and they said I was still responsible until the car was paid off. On October 29th, Anton called me at work and said that the finacing didnt go thru and to bring the car back. I said no problem, I would bring back the next day and to have the Nissan and my $2000 there as well. I asked him about the late payment fees and I was told to deal with it that it wasnt his problem. It clarly stated in the contract that if financing was done in 14 days, then the Nissan and $2000 would be refunded.

I called Anton on October 31st and said we would be there to pick up the Nissan, he told me that I didnt have to do that that Bill Heard Chevrolet would finacne the car themselves. My husbacnd called Anton today and told him that since they had a breach of contract, we were coming to get the car. Anton said we couldnt get the car because it was already sold! The Nissan was sold to someone else without Bill Heard Chevrolet paying it off!

This is the short version of the events, but Im sure that you ge the just of it. Now we are being forced to take legal action against them.

Sounds like everyone is getting the short end of the stick

How can they sell your car without the title? They can't get the title unless they pay it off. What about the person that "bought" your car. What did they tell him/her about the title. Sounds like everyone is getting the short end of the stick except the dealer.
