NO TITLE-purchased vehicle from BMG Motors January 17, 2004. Dishonest, Misrepresenting, Fraudulent liar... Title is not clean as BMG Motors stated in Ebay ad.

I purchased a 1999 Mercedes Benz CL500 off of Ebay from Bmg motors/cars. I was impressed with their rating on ebay and all of the feedback that other ebayer's left for them. I was sold on buying from BMG when I read these statements:

If you are not 100% satisfied with this beautiful car I will refund ALL of your money! It's that nice! We guarantee you will be elated when it arrives at your front door! But let's face it ... when you buy a car sight unseen it all comes down to one thing ...trust! That is why when you purchase a car from us we give you our personal commitment that the car you get is everything and more we promise it to be. BMG Motors
sells only Preowned Quality European Automobiles with
a clean title history. Our feedback speaks for itself
... how many used car dealers on ebay have an impeccable 100% feedback rating? We have this rating because we have very high standards when buying our cars and we only sell the cream of the crop! Our cars have no frame damage, flood, fire or rust damage and are as close to showroom new as can possibly be. We inspect all of our cars for performance and safety and when your car arrives at your front door, it's ready to drive safely and efficiently. You have my word

I truly believed that bmgmotors/cars were honest and that I could trust that the car would be safe to drive. So
I bid on and won one of their cars. However, since
purchasing and taking ownership of the vehicle, I have
found things not to be as truthful as they were stated
in their Ebay ad.

I flew down to pick up the car, I asked the driver,
Jason, was there any thing wrong with the vehicle that
I should know about? I was told that, The brakes had
been done and the front tires were replaced and the
left head light had burned out and that one will be
sent to me the following week. It was never sent.

While driving the car back to Texas, I had a blow out
on one of the rear tires which put my safety at risk.
The tires were bald on the inside and the one that
didn't blow was in such bad shape that it had strings
showing and it could have blown at anytime as well. When I pulled the spare out of the trunk, there was a hole in the trunk with a sponge tucked in it. Based on the condition of the rear tires, and the whole in the trunk, I would have to question if this vehicle was inspected for safety as it was stated in their ad rather than to believe that these tires were noticed and not corrected when the front tires were replaced.

I called Darrin the next week after purchasing the vehicle to let him know of the problems I was having but, Jason answered his phone. I told Jason about the blow out. I asked him about the floor mats that were suppose to be in the vehicle according
to their ad and I also asked about the front headlight that he said I would get mailed out to me. Jason stated
that he would let Darrin know of the issues and that
he would give me a call back because Darrin and Lance
were at the auction.

Unfortunately, before I spoke to anyone again, the check engine light came on and remained on until a purge valve was replaced by the Mercedes dealership for $300 dollars. I had to replace the rear tires for $600 dollars plus an alignment. The Mercedes dealership told me that the whole left headlight assembly needed replacing ($1600 dollars). The Mercedes dealership informed me that there is an electrical shortage some were in the vehicle. I agreed because the lights on the dashboard instrument panel will only come on when I tap the plastic glass in front of the clock, and the radio sometime remain on after I turned the car off.

I do understand that when buying a used vehicle that
there will possibly be some repairs that will need to
be done. However, when an item is advertised as being
as close to showroom condition as possible. You don't
expect to be having to call the dealer back with the
problems that I am encountering whitin 72 hours.

I purchased this vehicle off of ebay from BMGmotors based on their ad comments and their reputation as a trust worthy and honest used car dealer. I called Lance to discuss the problems that I am having with this vehicle. However, since purchasing the car on 1-17-04 up until now (11-17-04), none of the issues with the car have been corrected. More suprisingly though, I have yet to receive the title to this vehicle(11 MONTHS and counting).

Lance's reply to the issues of this car:
When the car was inspected by our mechanic he
informed Derrin that car needed new front tires
and a headlamp. We replaced the front tires and
were never aware that the car needed rear tires.
I assure you I would have never let the car leave
CA if I knew the back tires were bad. I was also
told that the headlamp was $180 which I told Derrin
I'd replace. I want to help with a refund check but
you have to understand that we paid $23,000 for that
car and I would have NEVER sold it for $20,000 if I
knew the car was going to require a lot of expense.
I would have taken it back to the auction and sold
"as is." I apologize for the issues surrounding the
vehicle but please look at the car as an incredible
value even after shelling out a few bucks to make it
perfect.

Best Regards,
Lance Benedict

My reply:
I don't think for one minute that you lost any money on
this car. Now you are falling way short on convincing
me that you knew nothing about the issues that were
brought to your attention. When the mechanic
inspected the car and informed Derrin that the car
needed new front tires and a headlamp, then why was a
brake job performed? Furthermore, when the brake pads
were being replaced, why were the bad rear tires not
noticed then? I have to believe that the problems I
brought to your attention in my previous email were
already known and not reveled to the consumer. You
stated in your ebay ad, "The vehicle was as close to
showroom condition as possible". Again this car was
purchased from you based on your reputation, your
feedback from other Ebayers and your trustworthiness.
Clearly we have a misrepresentation issue.
There are several problem with this vehicle, however, I
am requesting that you reimbursed me for the headlamp,
the rear tires, and either send the floor mats or the
cash for them.

Lance did not respond......In the meantime, the tags expire on the car. I send Lance emails asking for updates on the status of the title.

That was not an attempt to burn you. I have sent you
several emails with some of the issues I am having
with the car...It's been 58 days since I purchased
that car from you and not one of the issues have been
corrected. And your reply was "I apologize for the
issues surrounding the vehicle but please look at the
car as an incredible value even after shelling out a
few bucks to make it perfect". As it turns out I will
be shelling thousands of dollars as opposed to the
"few bucks" you spoke of. Again this car have more
issues than I would have tolerated had I known this
before making the purchase. These are the issues I've
found to date:

1. electrical short
2. a pinging in the motor
3. the power steering is making a wining noise
4. rear tires were no good
5. had to replace a valve($300) because the check
engine light stayed on.
6. no floor mats were in the car as stated in your ad

7. some of the dash light up and some of it doesn't

NOW YOU TELL ME WHOSE GETTING BURNED.

Lance file a complaint against me with ebay trying to get the negative feedback removed. His final offer to me was $1,000.00 and a replacement title. I declined his offer because by law I should have received a title from him by now anyway. I called DMV in California on 11-10-04 and was told that there hasn't been a title application submitted for the car since before I purchased it on 01-17-04.

My finance company contacted Lance several times about the title to the car and was told that it was in the mail. However, according to CA. DMV records, there are no title activities for this car since I purchased it on January 17,2004.
